CALL TO ORDER
Mayor Bret Jordan called the October 10, 2011 Regular Meeting of the Medina City
Council to order at 6:31 pm.
ROLL CALL
Council Members Present: Patrick Boyd, Doug Dicharry, Bret Jordan, Katie Phelps,
Janie Lee, and Mark Nelson
Council Members Absent: Shawn Whitney (excused)
City Staff Present: Donna Hanson, City Manager; Bruce Disend, City Attorney,
Kenyon Disend; Dan Yourkoski, Acting Police Chief; Robert
Grumbach, Development Services Director; Joe Willis, Public
Works Director; Nancy, Adams, Finance Director; and Rachel
Baker, City Clerk
Mayor led members of the audience, council members, and City staff in the Pledge of
Allegiance.
A motion was presented by council member Nelson seconded by council member Dicharry
to excuse council member Whitney from October 10, 2011 Regular Meeting, and motion
carried 6-0 (Whitney absent) at 6:32 pm.
APPROVAL OF MEETING AGENDA

PRESENTATION
Eastside Pathways; Bill Henningsgaard, Board Chair (6:32 pm)
Medina resident Bill Henningsgaard introduced Eastside Pathways and requested the city
council consider the City becoming a member of Eastside Pathways, explaining it would be
valuable if Medina could endorse and support the vision and goals of the non-profit’s
efforts, explaining support would not be limited to monetary contributions, but could instead
be provided by other means. Mr. Henningsgaard answered questions from council
members and Mayor Jordan placed matter on October 24 study session agenda for
discussion to determine level of city council support.

PUBLIC COMMENT
Mayor read guidelines concerning public comment period and opened floor to public
comment at 6:49 pm.
Medina resident Wilma Edmonds complimented city manager and council members for
hiring Dave Clark to oversee the City Hall Expansion and Renovation Project.
Medina resident Consuelo Corbett pointed out that under the current tree code a neighbor
window-paned a tree on City right of way property to create a view that previously did not
exist. Mrs. Corbett said another 25% of the tree’s canopy could be removed in the near
future and asked council members to consider adding a tree code amendment to the
planning commission work plan.
Medina resident Gary Blackbourn recounted instances when the matter raised by Mrs.
Corbett was addressed to the city council previously and requested council review and
consider an amendment to the tree code.
Medina resident Heija Nunn commented she has not received better cell phone reception
even though the new DAS was activated. She expressed appreciation for the open house
planned for October 17 regarding the 84 Avenue Northeast corridor project and hoped
there will be additional opportunities for public comment. Ms. Nunn criticized the public
comment sign in sheet and asked council to follow its guidelines and allow more generous
public comment opportunities.
Medina resident Miles Adam stated he recently learned the police department is no longer
an accredited agency and communicated his disappointment the public was not notified of
this fact. He critiqued the City for its deficient efforts at open and honest communication
with its citizens.
Mayor closed public comment period at 6:59 pm.
REPORTS AND ANNOUNCEMENTS
Council member Dicharry reported amateur radio equipment has been installed at City Hall
and during an emergency, communication will be operable with Bellevue and King County
emergency coordination center.
City manager noted the state auditor completed its work at the City last week and council
members will be notified when the exit conference is scheduled.
Public works director provided a status report on projected functionality of proposed State
Route 520/84 Avenue Northeast traffic circle. Willis said the State provided the City a letter
memorializing its obligations to future metering and operations.
Willis provided an update on Northeast 12 Street gateway improvement project, noting
striping, crosswalk, and lighting will be installed once weather cooperates. He stated
lighting installation and equipment control box relocation will be completed by Puget
Sound Energy.

Grumbach confirmed the DAS system improved only AT & T and he would inquire if citizen
comment requesting additional carriers could be accepted by ATC. In response to request
for tree code amendments, he said the planning commission work plan is currently full,
however item could be added if it was the desire of the city council. Mayor Jordan
requested the 2012 planning commission work plan be on the December meeting agenda
and council member Nelson requested tree consultant Tom Early’s attendance to answer
questions related to the tree code.
Grumbach defined limits of abandoned properties ordinance, challenges related to
application of ordinance, and actions available for neighboring property owners to assume.

no cancelled AP checks or voided payroll checks.)

PUBLIC HEARING
2012 Preliminary Annual Budget (7:33 pm)
Finance director summarized process which formed the current proposal.
Mayor opened public hearing at 7:38 pm. No comments were presented and the hearing
was subsequently closed at 7:39 pm.
OTHER BUSINESS
2012 Preliminary Annual Budget (7:39 pm)
Staff responded to general annual budget inquiries posed by council members.
In response to mayor, city manager confirmed tolling pass use and expenditure policies
will be developed and affirmed the police department would continue to explore grant
opportunities into 2012.
Mayor noted an ordinance adopting a 2011 budget amendment will be added to
November 14 consent agenda and noted ordinances for adopting 2012 franchise fees and
utility taxes will also be moved to the November 14 agenda.

City Council Agenda Calendar (8:16 pm)
Discussions related to City’s participation level with Eastside Pathways and 84 Avenue
Northeast corridor project planned for October 24 study session.
A community meet and greet for incoming police chief scheduled to begin at 5:30 pm,
prior to November 14 regular meeting, and ordinances related to 2011 budget
amendment, adoption of 2012 annual budget and salary schedule, 2012 property tax levy,
and 2012 franchise fees and 2012 utility tax collections are scheduled for November 14
regular meeting.
Planning commission 2012 work plan discussion planned for December 12 regular
meeting.
PUBLIC COMMENT
Mayor opened public comment period at 8:28 pm.
Wilma Edmonds recounted experience she had in another city with an abandoned
property and explained the county health department resolved matter.
Comment period expired at 8:29 pm since no additional comments were presented.
EXECUTIVE SESSION
At 8:30 pm, mayor announced the city council would enter into executive session pursuant
to RCW 42.30.110 (1)(i) to discuss with legal counsel representing the agency matters
relating to agency enforcement actions, or to discuss with legal counsel representing the
agency litigation or potential litigation to which the agency, the governing body, or a
member acting in an official capacity is, or is likely to become, a party, when public
knowledge regarding the discussion is likely to result in an adverse legal or financial
consequence to the agency; and RCW 42.30.110 (1)(g) to review the performance of a
public employee.
City attorney declared item related to RCW 42.30.110(1)(i) could be discussed in open
session due to status of matters. Disend reported the Skinner versus City of Medina
lawsuit concluded and the City prevailed following Supreme Court denial to hear Skinner’s
petition to appeal decision. Disend conveyed staff will bring to council in November a
proposed interlocal agreement related to fee structure for fire flow upgrades proposed by
the City of Bellevue.
Mayor announced the city council would enter into an executive session at 8:35 pm for
purposes of RCW 42.30.110 (1)(g) to review the performance of a public employee, for an
estimated time of ten minutes. City council members Jordan, Boyd, Dicharry, Lee, Nelson,
and Phelps were present, as was city attorney Bruce Disend.
Executive session concluded at 8:45 pm and no action transpired.

ADJOURNMENT

2011 REGULAR MEETING OF THE MEDINA CITY COUNCIL. MOTION CARRIED 6-0
(WHITNEY ABSENT) AT 8:45 PM.
The October 10, 2011, Regular Meeting of the Medina City Council adjourned at 8:45 pm.
The Medina City Council will hold its next Regular Meeting on Monday November 14,
2011, at 6:30 pm in the Council Chambers at Medina City Hall, 501 Evergreen Point Road,
Medina.
