ROLL CALL Council Members Present: Miles Adam, Lucius Biglow, Drew Blazey, Jim Lawrence, Katie Phelps, and Robert Rudolph, Pete Vall-Spinosa City Staff Present: Mark Weinberg, City Manager; Wayne Tanaka, City Attorney, Ogden Murphy Wallace; Jeff Chen, Chief of Police; Joe Willis, Director of Public Works; Steve Wilcox, Building Official/Acting Director of Development Services; and Rachel Baker, City Clerk APPROVAL OF AGENDA MOTION VALL-SPINOSA AND SECOND LAWRENCE TO ADD THIRD EXECUTIVE SESSION ITEM TO DISCUSS THE PERFORMANCE OF A PUBLIC EMPLOYEE, PURSUANT TO RCW 42.30.110(1)(G). MOTION CARRIED 6-0-1 (RUDOLPH ABSTAINED) AT 7:08 PM. MOTION VALL-SPINOSA AND SECOND BIGLOW TO MOVE ITEM CI-1 (2008 CITY MANAGER COMPENSATION REVIEW) TO FOLLOW EXECUTIVE SESSION. MOTION CARRIED 6-0-1 RUDOLPH ABSTAINED AT 7:09 PM. Agenda was approved as amended. AWARDS AND PRESENTATIONS Mayor recognized and thanked outgoing Council Members Phelps and Vall-Spinosa for their four years of service to the City of Medina and to its citizens. Mayor Adam presented both Phelps and Vail-Spinosa plaques in honor of their service. Weinberg presented outgoing Mayor Adam two plaques in honor of his service as both Council Member and Mayor and summarized the highlights of Adam's tenure. PUBLIC COMMENT Mayor opened floor to public comment at 7:24 pm. DRAFT Resident Wilma Edmonds stated the hearing examiner could have granted what the City Council granted for the St. Thomas variances and expressed that a misunderstanding exists that such cases are better off with the City Council rather than with the hearing examiner. Mrs. Edmonds inquired if the concern raised at the November 13t" meeting regarding a $260,000 discrepancy in the budget had been resolved. Resident Henry Paulman stated that in July he filed a complaint against the Police Chief regarding the Clearwire cell tower and in September followed up with an amendment which established the antenna as commercial. He said in October Clearwire sent a letter to the City which was followed up by the City Manager in his report. Mr. Paulman iterated that in November the State Department of Ecology emailed the City asking it to review the situation and to permit it. He then said that an electrical inspection was never performed and the tower draws electricity from City Hall. He requested these matters and other open matters concerning the Chief be resolved. Resident Heija Nunn referred to the State Auditor as mentioned in the City Manager's report and said she was struck by the coincidence of running into Henry Paulman and another citizen at the State Auditor's Office,. She thanked City Council Members for their many years of service, endless amounts of time, and the slings and arrows suffered. She ended saying she was happy so many people volunteer in the City. Mayor closed participation period at 7:30 pm. REMARKS AND ANNOUNCMENTS Phelps pointed out the annual giving tree was erected in City Hall and this year under- privileged teenagers within the Bellevue School District would benefit from donations. City Manager City Council Minutes December 10, 2007 Page 2 a A Council discussed pre -disaster mitigation FEMA grant fund availability and a council majority recommended City Manager complete grant application and bring a bid packet back to Council in order to be poised to move on contract while awaiting notification from FEMA. Weinberg summarized remainder of report and along with Tanaka answered inquiries regarding Clearwire cell tower. Chen answered Council inquiries pertaining to report and patrolling traffic at Hunt's Point entrance to SR-520. Reports were received and filed. Agenda Calendar (8:11 pm) Council direction was to include teleconferencing discussion and to carry over December's Executive Session items to the January 14t" agenda. Mayor recessed for a break at 8:16 pm and the meeting was called back to order at 8:21 pm. EXECUTIVE SESSION Council recessed into Executive Session at 8:21 pm to: 1. Executive Session adjourned and the Regular Meeting was called back into session at 9:32 pm. COUNCIL INITIATIVES 2008 City Manager Compensation Review (9:32 pm) MOTION LAWRENCE AND SECOND ADAM TO SET CITY MANAGER SALARY FOR 2008 AT $115,500 ANNUALLY, AN INCREASE OF $7,500 PER YEAR FROM 2007 SALARY. MOTION CARRIED 7-0 AT 9:33 PM. OTHER BUSINESS Proposed Amendment to Police Contract Services with the Town of Hunts Point (9:33 pm) MOTION LAWRENCE AND SECOND ADAM TO AUTHORIZE CITY MANAGER TO EXECUTE THE AMENDMENT TO THE CONTRACT WITH HUNT'S POINT. POLICY IMPLICATION Present practice on the Council has been to accommodate Council Members who wish to participate in meetings via teleconferencing. BACKGROUND Chapter 2.04 of the MMC specifies the time, place, rules of order and other provisions which apply to City Council meetings. City Council Members serve as board members of a public corporation, set public policy, and play an integral role in the governance of their community. They are expected to be active, accessible participants in this process. Neither the MMC nor the City Council Guidelines (April 12, 2004) say much about Member attendance, or participation when physical attendance in not possible. Section 2.04 of the Guidelines only states "If the Mayor or other Council Members are absent from the City for more than 15 days, they shall notify the other Council Members and the City Manager of such absence': In researching the RCW and the WAC, using keywords such as teleconferencing, council attendance, and remote attendance the only reference found was a provision in the WAC which permits, but does not compel, teleconferencing for certain hearings (WAC 242-02- 150). In recent years, Medina Council Members have participated via telephone in Council meetings a handful of times annually. DISCUSSION Technological advances in recent years have vastly expanded communication options for individuals and organizations, and changed the way the world does business. Still, the notion of government representatives performing their deliberative process electronically as a substitute for physical attendance at legislative meetings is slow to take hold, and not without measurable controversy. Critics of the practice, such as Snohomish County Executive Aaron Reardon (see attached) believe that physical attendance at public meetings is "fundamental" to the U.S. form of government and point out such a requirement is still in force in Congress and most state ITEM OB-1 legislatures. They claim the practice does not exemplify open and transparent government, is often fraught with technical problems, and hinders the deliberative and decision making process. Advocates of teleconferencing tout its practical value, which permits more members to be heard on more key policy issues. They argue that is the essence of a representative democracy, taking advantage of modern technologies that are becoming ubiquitous. As the Council considers policy in this area it may be helpful to know that a small number of other local governments now permit teleconferencing, often placing conditions on the frequency, and purposes, and imposing strict procedures. In some cases, the practice is permitted no more than 1 or 2 times per year per member. In other instances, telephone representation is only allowed for votes deemed to be "critical or time sensitive". Yet other rules dictate that a single item can be discussed or acted on electronically, but then the remote attendance.is terminated. In virtually all instances, teleconferencing policy requires the absent member listen to all public testimony on the item and to be able to examine all staff work, documents and pertinent exhibits. Neither was any policy found which permitted a remote attendee when a Council quorum was not already physically present.. Aside from policy issues, there are some attendant logistical and cost issues that, while not surmountable, should be recognized. The cost of top quality teleconferencing and/or video- conferencing equipment can be substantial. Some equipment does not work, or underperforms, without acoustical accommodations to the meeting room. The cost of long-distance phone calls, borne by the City, is not prohibitive, but worth noting. Connection to the Hawaii for Council meeting of typical length is about $38, while the same call to the east coast is about $9. Upon agreement of a policy on this issue, it should be codified and incorporated into the City's City Council Guidelines. "I think it's important that the legislative branch face the public when they cast their votes," Reardon said. "It's what they're paid to do." While the Snohomish County Council apparently is the first county body to adopt a teleconference policy, several Washington cities — including Bothell, Spokane, Port Townsend and Battle Ground — allow similar votes, said Marcia Isenberg, council chief of staff. Snoqualmie allows its City Council to hold emergency meetings in cyberspace, with "e-meetings" conducted in an Internet chat room. The new Snohomish County rules allow each council member to cast long-distance votes twice per year. An absent member would be required to participate — via speakerphone — in the entire mvidiscussion, including lJniigLm11 Lesiliy. ll A council quorum must be physically present for any vote, under the new county policy. "It will be a public session. It doesn't really change that," said Councilman Dave Somers during the council's brief deliberations on the veto override. "Everybody will be accessible to the public." Later in the week, Somers noted that the new voting provision could be valuable in the case of a disaster — such as flooding or a pandemic — which interfered with a member's ability to travel. Councilman Kirke Sievers said he found it ironic that Reardon was chastising the council for a lack of "transparency" in its actions, pointing out that Reardon didn't try to talk to the council about his veto. State law doesn't directly address the concepts of teleconferences or videoconferences by elected bodies, he said. The main points of legal concern, he said, would be requirements that the public be given adequate notice of meetings and a way to participate. "With technology [advancing], more and more of these questions are going to pop up," Ford said. "I don't think the Open Meetings Act precludes votes by telephone. But if you think about it a little bit, one of the reasons the public wants to attend meetings is because the public wants to see and not just hear what their members are doing, and you can ascertain much of what a person is feeling by looking at their body language." The Snoqualmie City Council has twice allowed individual members to vote by speakerphone, and in 2006 held its first e-meeting, said City Clerk Jodi Warren. The council consulted with the Attorney . General's Office before crafting its policy, which is intended for emergency meetings to deal with "time critical" situations, she said. "It's kind of like a chat room," Warren said. "It's [public] noticed 24 hours in advance, and people can actually get onto our Web site and view it." People who lack access to the Internet are invited to the City Council chambers, where the e-meeting is projected on a screen for public viewing, she said. Last year, the council held its first — and only — e-meeting, regarding a home outside the city limits with a failed sewer line. Its owner needed City Council permission to get hooked into the city's water system. "It was really awesome," Warren said. "And I can tell you, minutes were pretty easy to take. And figuring from the number of hits — we had almost 300 — we had probably better attendance at that council meeting than any council meetings we've ever held." BACKGROUND State law requires the Medina City Council to meet at least once monthly. Section 2.04.010 of the MMC sets regular meetings of the City Council for the second Monday of each Month. As recently as 2006 the Council was supplementing their monthly meetings with regularly scheduled study sessions which took place on the fourth Monday of each month. The intent of the study sessions, limited to two hours, was to informally discuss items expected to be introduced at future Council Meetings; however, the Council was not precluded from conducting business at a study session. Study sessions could be cancelled by a majority vote of the Council, or by the Mayor, if deemed appropriate. In 2007 the City Council eliminated monthly study sessions in favor of scheduling regular meetings on the 2"d Monday of each odd numbered month. I11*1* 1►_ How often City Councils meet is the body's first policy decision, and should be reconsidered periodically to accommodate a dynamic governing environment. It is largely a function of the agenda size and complexity, but also reflects the personal preferences of the Mayor and Council Members. As expected, larger cities typically meet more often than do smaller cities. Our neighboring Points Communities, Clyde Hill, Hunts Point and Yarrow Point meet only once monthly and conduct study sessions or call special meetings only when needed. From the City Manager's and staffs perspective, it is believed that the Medina City Council can responsibly and effectively conduct the People's business by meeting once monthly, and calling study or special meetings only when needed. This will, of course, require that agendas be well planned, completed staff work furnished, and that the meeting be efficiently run. Meeting once monthly allows staff to reallocate time spent on agenda and meeting preparation to other tasks. For a portion of 2008, an important consideration relative to the frequency of City Council Meetings includes the fact that meetings for a 3-4 month period will have to be moved offsite while planned life -safety repairs at City Hall proceed. POLICY IMPLICATION The City of Medina operates a full -service municipal Police Department. The City's policy has been to furnish the department, and its personnel, with the necessary tools to provide first-class public safety services, while also placing preeminent emphasis on Officer safety. BACKGROUND Contemporary police services rely heavily on voice and data transmissions. In fact, no other element of law enforcement has benefited more from advances in technology, nor had as profound a positive impact on public and Officer safety as communications. The ability to transmit a full range of criminal justice information, suspect photos, fingerprints, and even voice files in a reliable, secure and expeditious manner is now an essential police function for effective law enforcement services. To accommodate the burgeoning volume of data transmitted, access the internet, and establish and maintain inter- and intra-agency communications networks, such transmissions must take advantage of high speed wireless technologies. In addition to traditional portable radios, Medina Police Officers have used wireless fixed mobile data computers since 2002.. While viable, this equipment is less reliable, less secure, has less bandwidth, and is substantially slower than Wi-Fi coverage. DISCUSSION Clearwire (Kirkland, WA) was founded in October 2003 by Medina resident and telecom pioneer Craig O. McCaw. The company provides simple, fast, portable and reliable non -line -of - sight wireless high-speed Internet service in 16 states across the U.S. as well as in Europe and Mexico. Clearwire customers connect to the Internet using licensed spectrum, thus eliminating the confines of traditional cable or phone lines. Radio signals are transmitted from a tower to a small, wireless modem or pc card, which easily connects a user's computer to the Internet. Clearwire connections are at broadband speeds of up to 2.OMbps, or up to 25 times faster than typical dial -up. Clearwire connection is very secure. Clearwire wireless technology uses OFDM transmission protocol, featuring a design standard that includes secure wireless data transmission. Wi-Fi which operates on unlicensed 2.4GHz frequencies, is vulnerable to scanning and packet interception. Clearwire operates at licensed 2.5GHz frequencies. Licensed frequencies and OFDM make for a very secure connection. For all these reasons, Clearwire ITEM CM-1 technology is particularly well suited to law enforcement applications and operating environment. In Spring 2005 the City began discussions with Clearwire. The impetus for these talks was the Council's stated desire to implement camera surveillance equipment at entry points to the City, which eventually came to include the sophisticated automated license plate recognition (ALPR) feature. Given the prohibitive cost of trenching miles of Medina streets to install a hardwired system, the Clearwire technology represented a solution which provided sufficient bandwidth to wirelessly transmit all surveillance video and criminal justice data to any fixed or mobile point equipped with signal receivers. Clearwire founder Craig O. McCaw's interest in the community safety -enhancing camera surveillance system prompted him to generously offer to donate all necessary communication equipment and housing, as well as ongoing subscriber services, without charge to the City or its taxpayers. With the full knowledge and approval of Interim City Manager Roger Crum, the installation of a new (replacement) flag pole on Medina Beach Park, adjacent to City Hall, began in mid -December 2006 and was completed just after New Years. The new flag pole housing the necessary public safety communications equipment replaced an earlier pole and its dual purpose is virtually undetectable. As such, aside from numerous positive remarks about its majestic appearance, the installation has become a target of interest and a source of angst for only one resident, and a non-resident. Both parties have posed many questions about the flag pole, including who authorized it and by what development process it was approved and installed. Members of the Council are now similarly interested in learning the responses to these inquiries. Employing a FAQs format, this report is designed to provide answers, to the extent possible, bearing in mind that the wireless communications tower was installed prior to the current City Manager's arrival and that since its placement the Development Services Director has left the City. Is there an agreement in place between the City and Clearwire for the tower? Yes. An Agreement for Use of Public Property and Provision of Wireless Internet Services (Agreement) between the City of Medina and Clearwire was executed on March 2, 2007. Police Chief Jeff Chen, serving as Acting City Manager, was duly authorized to sign the Agreement, which was reviewed and approved as to form by City Attorney Wayne Tanaka. What is the term of the Agreement? In perpetuity, or until terminated by either party in accordance with the Agreement. As is the case in the Town of Hunts Point, does the City receive any rent from Clearwire for hosting the communications equipment? No. While Clearwire currently pays Hunts Point $1,856 monthly to host transmission equipment, that application is for commercial purposes which directly provides Clearwire with additional customer service capability and resulting subscriber income. Is the Medina communication tower being used for commercial purposes by Clearwire? No. Item 4 of the Agreement specifies that the communications equipment on the flagpole is to be used for the Medina Police Department's public safety operations and are not intended to be marketed to the general public, without obtaining the proper permits from the City. Has clarification been sought from Clearwire to insure the tower is not being used for commercial purposes? Yes. Both written correspondence in October 2007 between the City Manager and Clearwire's Vice President of Network Development, and subsequent discussions between the respective parties' legal counsels have confirmed that Clearwire does not utilize Medina's tower to qualify 2 ITEM CM-1 new customers for subscriber services, who are not otherwise capable of being served by other network equipment. Simply stated, this means that the Medina tower cannot be used to expand Clearwire's service area or client base, nor to generate new or enhanced revenues to the company. Who was involved in the construction of the tower? Clearwire contracted to have the work completed. Krazan & Associates Inc. of Woodinville performed the construction testing and inspection. Eagle Communications Services of Gig Harbor undertook the construction. No City staff, or contractors to the City, were involved. Did the City pay for any of the costs associated with the tower's installation? No. Additionally, following installation, and in the event the Agreement is cancelled, Clearwire agrees to restore the landscaping and surrounding area to "original or better' condition. What maintenance and operational costs are the City responsible for? The City pays modest energy costs for powering the equipment, and illuminating the pole during hours of darkness. Clearwire has agreed to pay all costs associated with maintaining, repairing and insuring the tower. Who owns the flagpole and the communications equipment? As per the Agreement, Clearwire makes all equipment in connection with the donated network services available to the City on loan, retaining ownership and the right to have such equipment returned upon the termination of the Agreement. Though not explicitly stated in the Agreement, implied is that the City owns and would retain the flag pole. Were other locations and installation options for the tower considered? Yes. Other public and private property locations and installation configurations were considered, but ultimately were eliminated due to less effective performance, equipment vulnerability, and other factors. How does the current flag pole/communications tower compare to the original City Hall flag pole in terms of size and location? The communications tower sits in the same location as the original; however it has a larger diameter, and is approximately 7' to 10' taller. What is the value of the donated flag pole, communications equipment, installation, annual maintenance and repair fees, and subscriptions communications services? The City has never requested, nor received, an assessment of the value of any of the above items. Was the City Council made aware of the tower installation and provided with much of the information contained in this report? No record of a formal report to the Council about the tower, prior to its installation, can be found. It is believed that the Mayor and perhaps other Council Members may have observed the tower installation work in progress and commented to staff about it. However, it is unclear what, if any, communication about the tower from staff to Council Members may have occurred. Approximately one full page of the current City Manager's October 2007 monthly management report was dedicated to informing the Council about the tower. Was it improper for the communications tower installation to proceed without notice to, or approvals from, the City Council? Even given the Interim and Acting City Managers' authority to proceed and to contract in this instance, City Administrative Guideline #37, approved on December 11, 2006, required the 3 ITEM CM-1 Council to formally accept offers of donations with values over $5,000, following a report from the City Manager. That was not done in this case. However, of note, it is the sole responsibility of the donor to determine the value of the donation, and that was not done. Complicating matters further, the equipment was not donated, but is on loan; the status of the flagpole housing was not made clear in the Agreement, and the annual cost of subscription services is "approximately $5,000" by staff estimates only. Finally, prior to July 9, 2007 the City's Administrative Guideline was not validated by the state's requirement that an underlying ordinance be approved by the City Council providing statutory authority to accept donations. Was it necessary for the installation of the tower to comply with 17.90 MMC relating to Wireless Communications Facilities? No. The provisions of 17.90 MMC apply only to commercial wireless communications facilities. Upon review, both the former Development Services Director and the City Attorney agreed that the tower installation could proceed on the basis of its public safety applications. The City Council may wish to amend Chapter 17.90 to explicitly incorporate a public safety exemption. Were plans submitted and building permits issued by the City for the tower? No. The former Development Services Director opined that the flag pole was a modular, prefabricated installation and, as such, was exempt from the building permit process. However, the City's current Development Services Director reviewed several different sources and found that the monopole structure itself (excludes electronics) is in fact regulated solely by the International Building Code. Furthermore, plans, permits and inspections should have been required for the pedestal base, and power supply (though it should be noted power was present at the former pole, no electrical panel modifications were needed, and the extent of electrical connection work at the tower is thought to be minimal). The City Manager has directed that all such plans, permits and inspections now take place. Was a shoreline permit required and was it obtained? Joe Burcar, Shoreline Planner with the Department of Ecology, responded to a citizen complaint and reviewed the City's Shoreline Management Plan. Based on his initial review, Mr. Burcar emailed the City's Interim Development Services Director on December 10, 2007, "...it appears that a shoreline permit should have been acquired for the project". The Medina Police Department may be the only Police Department in Washington that sits within 200' of a shoreline. Once again, it seems as though neither the City nor State contemplated the need for critical wireless communications installations in such close proximity to the water. Cities serve as an administrative agent for the Department of Ecology but still have a good deal of local control over shorelines within their jurisdiction. In fact, it is the City that issues the SMP permit for minor shoreline development such as the pole, not the State. In this instance Mr. Burcar says, "The DOE is concerned with process more than impact" and is only interested in making sure the City reviews and permits the pole in accordance with its own SMP. If staff determines that a permit is needed under current law, then one should be applied. Are there any security issues with the wireless communications tower? Yes. It is unclear if Federal Homeland Security protections apply to state and local government. However, the City Manager and the Police Chief have expressed great concern that the location of the City's public safety communications infrastructure is now a matter of public record. Most cities secure sensitive public safety equipment in fortress -like enclosures to guard against the intentional disruption of critical services. The City Manager now believes a security consultant should be called in to evaluate what measures can be taken to safeguard the equipment. The cost of the consultant, and recommended modifications, may be substantial. Are there health hazards associated with living, working or recreating in close proximity to such wireless communications facilities? M ITEM CM-1 There are consumer and special interest groups that have voiced health concerns about cell towers; however studies by the federal government have yet to prove these claims valid. Existing science indicates that the RF signal levels from even a very close cell site are well below the levels considered unhealthy. In fact, federal law now prohibits municipalities from rejecting zoning for a cell phone tower solely on the grounds that it may pose health risks. The towers are now ubiquitous, present in residential neighborhoods, on church and school property, and at many government facilities. It is important to note that the Clearwire WiFi technology is not the same as cell technology, - both the power consumption and signals emanating from Medina's communication tower are less potent that cel/ signals: Still, as a worst -case scenario in terms of exposure to RF radiation, consider a cell tower located only 100 feet away, and transmitting a total of 500W effective radiated power (ERP). Of course, if one is only 100 feet from the transmitting antennas, he or she is also are likely well below their horizontal beam centers even if severe down tilt is used. But for the sake of a worst -case analysis, let's assume that the full 500W is aimed right at a person. In that case, the RF power density where the person is standing would be 4.4 microwatts per square centimeter. For comparison, the FCC's mandated power density limits for continuous uncontrolled RF exposure by the general public are 600 and 1,000 microwatts per square centimeter for 900 and 1900 MHz signals, respectively. Even in this highly unlikely worst -case scenario, RF exposure levels would be well under 1 percent of the maximum deemed safe by the FCC. Analysis based upon government regulations will not satisfy everyone, so here is another way to look at it. VHF TV broadcasts often transmit at power levels exceeding one megawatt ERP from antenna towers well within 1 kilometer of residential areas. At a distance of 1 kilometer, a 1- megawatt ERP transmission would result in a power density of fewer than 8 microwatts per square centimeter, still nearly twice the above worst case value from a nearby cell tower. Based on your inquiry, as City Manager, was the tower installation handled improperly and do you plan to discipline any City staff? The tower installation could have been handled better, and valuable lessons have been learned. There is no evidence of attempts to circumvent or deceive policymakers or the public, nor has anyone acted intentionally to disregard applicable development requirements and regulations. Judgments were made, and good faith opinions were rendered where code provisions neither anticipated nor addressed police communications needs. Missteps in process, if they occurred, were not egregious, caused no irreparable harm, and are easily remedied. Importantly, in every instance staff acted in the best interests of the people of Medina. In fact, the Clearwire Communications tower project is an outstanding public -private partnership, which is already delivering rich financial rewards and measurable public safety benefits. ITEM CM-2 CITY OF MEDINA Office of the City Manager Date: January 14, 2008 TO: MAYOR AND COUNCIL MEMBERS FROM: CITY MANAGER SUBJECT: ALTERNATIVE POLICE SERVICES DELIVERY MODELS RECOMMENDATION It is recommended that the Mayor and Council Members direct the City Manager to initiate discussions with the City of Clyde Hill, and with the King County Sheriff to investigate alternative police service delivery models; and that such appropriate staff work be completed to enable the Council to evaluate the operational and fiscal impact of such alternatives. POLICY IMPLICATION The City Council is authorized to direct staff to investigate, and conduct staff work in support of, delivery models and alternatives intended to result in the most efficient, effective and economical provision of municipal services. BACKGROUND Upon incorporation, municipal governments assume jurisdictional authority and responsibility for providing local law enforcement service. The City of Medina has operated its own Police Department since its incorporation in 1955. Today, the Medina P.D. is comprised of a Police Chief, Lieutenant, Sergeant and six Patrol Officers, as well as two civilian staff who furnish records management, property control, and clerical support. Its professional status is evidenced by the fact that it is fully accredited (2002) by the Washington Association of Sheriffs and Police Chiefs (WASPC). The Department provides to its residents, as well as the community of Hunts Point via contract, a full menu of police services including patrol, investigations, traffic, parking and code enforcement, community relations, crime prevention, and animal control. Medina P.D. contracts with Mercer Island for marine patrol and with Kirkland for dispatching (transitioning to NORCOM) and jail services. The Medina P.D. plays an active role in the City's emergency preparedness efforts, and is aided by consultant program coordinator services. Medina has agreements in place with surrounding law enforcement agencies to insure mutual aid when emergencies occur, or service demands exceed available resources. The Police Department's approved operating budget for 2008 is $1,859,461. Clyde Hill operates a municipal Police Department of similar size to Medina, and, likewise, provides contract services to the Town of Yarrow Point. King County Sheriffs Department services the Town of Beaux Arts Village. In recent months, members of the Medina City Council have expressed an interest in exploring the possibility of creating a single Points Community Police Department. At the same time, King County Sheriff Susan Rahr recently approached the City to inquire if there is any interest in contracting with her department for law enforcement services. ITEM CM-2 Several years ago the cities of Medina and Clyde Hill entered into discussions aimed at merging their respective Police Departments. Apparently an independent consultant was engaged; however I have been unable to locate a copy of the subject report. Anecdotal information suggests that the parties appeared poised to execute an agreement, but that prior to executing an agreement the plan collapsed. The City of Clyde Hill has indicated that it is willing to revisit such discussions if, and when, the 2008 Medina City Council acts as a body to direct the City Manager to pursue the matter. DISCUSSION The Challenges Policing small communities poses unique challenges. It takes approximately 5 Police Officers to field one patrol car around the clock, making staffing and scheduling logistics arduous and expensive under the best of conditions. Small departments in small communities often have periods of low activity, but are easily strained when calls -for -service spike, multiple service requests are made, or emergencies occur. Directed patrol, special enforcement emphasis, and crime prevention activities, such as the School Resource Officer program, often suffer when only one Patrol Officer is on duty. Likewise, when vacancies exist in the ranks, or when Officers are in training, attending court, on vacation, ill or injured, or transporting prisoners the ability to provide basic services is immediately and profoundly impacted. Overtime payroll costs can escalate rapidly and be burdensome to carefully honed municipal budgets. Despite their charm and appeal, small Police Departments also find it more difficult to recruit and retain Officers than larger ones.. Opportunities for training, diverse experiences, special assignments, professional growth and development, and career promotion pale in comparison to even moderate sized organizations. Consequently, the personnel turnover rate and expense is generally higher in smaller Police Departments and vacancies not as easy to fill. In addition to disrupting services, the cost of Police turnover is formidable; Medina invests approximately $100,000 to recruit, test, process and train Officers from candidate phase through completion of the first year of probationary service. Public safety depends largely on well trained professionals, prompt response, and the availability of necessary resources. Notwithstanding Medina's state-of-the-art Command Van, smaller departments simply do not have the full array of technical, communications and other types of resources common to larger agencies. These include breathalyzers, polygraph machines, forensic lab equipment, K-9s, and advanced data processing and communication equipment. Smaller full service law enforcement agencies cannot take advantage of economies of scale. This is particularly true as it relates to management and supervision. Of necessity, any size police department will require a Police Chief and a support cast of supervisors. The typical "span of control" for supervisors, which has proven to be effective, is approximately five subordinates for ranking officers, and often several more for line personnel. However, presently, with respect to sworn personnel, Medina's Police Chief has only 1 Lieutenant who reports to him, and the Lieutenant, in turn has only 1 Sergeant direct report. It is common for public safety (police and fire) costs to represent as much as 40% to 65% of municipal general fund budgets, and personnel costs typically make up 80% of police budgets. For 2008, Medina's public safety budget is $2,476,821 (51 % of General Fund), of which $1,859,461 is for police services. Personnel costs for Medina make up 72% of the department's operating budget and total annual per capita cost for Police services in Medina is now $530. By comparison, Police services 2008 cost per capita in neighboring Bellevue, ITEM CM-2 Kirkland and Clyde Hill are $339, $297 and $363 respectively. In 2007, the Sheriff Department's per capita cost for their 12 incorporated contract cities ranged from $70 in Beaux Arts to $289 in SeaTac and averaged $133 across the board. Possible Improvements Through Alternate Service Delivery Models City law enforcement service delivery models are limited. Most popular is the operation of a municipal police department, or contracting with another City, or the County. However, the opportunity also exists to create a joint powers authority via an inter -local agreement. Arguably, each model has its own advantages and drawbacks affecting economics, management and control, and operations. For discussion and "next step" purposes, the City Manager does not recommend Medina consider contracting with another City for (i.e. Kirkland or Bellevue) police services. However, contracting with the Sheriff, or creating a new Points Community Police Department as a result of merging the Medina and Clyde Hill Police Departments may both be viable options. The City Manager recommends in studying these alternatives, and when reporting results back to the City Council, emphasis should be placed on the following objectives (listed in no particular order): • Scope and quality of services shall be enhanced, or maintained. • Through an acceptable governance model, or contract provisions, the City shall preserve control over personnel selection or assignment, as well as other critical policing policies. • Cost of service delivery shall be lowered, directly or indirectly. • Medina Police Department employee wage, benefits, and working conditions shall be preserved or enhanced. • Police customer -service culture, including local agency branding/identity, shall be enhanced, or maintained. • Police personnel environment shall be improved (recruitment, retention, staffing, training, assignment rotation, promotional opportunities etc.) • Police management, supervision and operational standards shall be maintained or improved. • Law enforcement resources and emergency response capability shall improve. Should the City Council direct the City Manager to proceed with further examining alternative Police service models, it is estimated that the inquiry could take from 90 to 120 days to report back to the Council. Transitioning to an alternate delivery model, depending on the model selected, could take from 6 to 12 months or more. Sealed bids for this project must be received no later than January 25, 2008. It is anticipated that a contract award will be presented to the City Council in either February or March and that mobile ALPR capability could be in place by late Spring. Fixed camera capability should follow by mid -summer. State of Medina Elementary School Frontage: As a result of staff observations and resident complaint, the City Manager forwarded a written request to BSD Superintendent Dr. Mike Riley (January 4, 2008) appealing to the District to repair school frontage right-of-way. The present condition includes deep muddy ruts which are unsightly and could pose danger to pedestrians. Dr. Riley was reminded that the School's Special Use Permit (SUP) required a landscaping plan the included plantings which would prevent the degradation of the frontage strip on NE 81" Street. Implicit in the approval granted by the City is that the District would maintain the right-of-way frontage. Public Records Act Requests: In 2007 the City Clerk received 475 Public Records Requests (PRA) compared to 154 in 2006 for a 208% increase. The overwhelming majority of this increase is due to the inquiries of a single non-resident. In spite of the City's strong support of open and transparent government, the avalanche of additional requests have, placed a real strain on the City Clerk and all City personnel who must research and respond to the requests. Wilcox, Building Official/Acting Development Services Director RE: Monthly Development Services Department Report Planning Commission Meeting Recap - The December 20, 2007 meeting of the Medina Planning Commission had two items on their agenda. Lot Coverage for Undersized Lots — The Medina Planning Commission continued their discussions on how best to deal the issue of lot coverage for undersized lots. At their November 27, 2007 meeting it was decided to prepare a statement outlining for the City Council their recommendations dealing with lot coverage for undersized lots. After considerable discussion the Planning Commission approved a written statement which outlines the issues and methods for dealing with lot coverage for undersized lots, within residential zoning districts. The written statement will be presented to the City Council by the Chairman of the Planning Commission for their consideration in the near future. Council had requested that this issue come back to them for their review prior to preparing an implementing ordinance. Consideration of Private Lanes, Easements and Rights -of -way in Calculating Lot Size - The Medina Planning Commission continued their discussions on inclusion of private lanes, easements and rights -of -way as a part of the square footage calculations for determining lot coverage's. The existing City Code requires that lots within all zoning districts exclude access lanes from the determination of lots area coverage. As requested, by the Planning Commission at its November 26, 2007 meeting the staff prepared for their review three examples of lot coverage's, which included private lane areas as apart of the square footage calculations for lot area. The examples illustrate existing and proposed lot coverage's within each of the zoning districts utilizing the exiting code setbacks and building height standards. After reviewing and discussing the lot coverage examples, the Medina Planning Commission is recommending to the City Council that private lanes, easements and rights -of -way be included in the square footage calculations for determining lot coverage's within all residential zoning districts. The City is now notifying the Washington State Department of Community Trade and Economic Development, as required by RCW 3670A.106, its intent to adopt ITEM CM-3C amendments to the code. This is a 60 day notice period therefore the proposed ordinance amending 17.40.020 and 17.40.023 the MMC should be before the City Council for a public hearing in March 2008. All staff work is complete on this matter. Building Permit Appeal — The appeal of an issued building permit was presented at a 3 '/2 hour Hearing on December 181n. The issue of the appeal is related to the method of calculating Original Grade. The December storms did not result in widespread flooding problems but did cause damage in two areas. The home at 8411 Midland Road had the basement flooded as a result of catch basin filters placed under their grates by neighboring construction contractors as a part of their erosion control practices that restricted the ability of the grates to capture the rainfall runoff which bypassed the basins and ran down the resident's driveway. Owner of 8040 NE 8th Street reported high water in their back yard threatening their basement and also reported a sanitary sewer overflow into Medina Park natural area behind the homes along NE 8th. The Public Works crew removed the basin filters on Midland Road so the runoff flow would be captured by the street catch basins (eliminating the bypass flow), reported the sewer overflow, and set a pump in the Medina Park stream near the culvert under NE 8th to alleviate the water backup behind the homes along N E 8tn The drainage problem associated with the back yard of 8040 NE 8th has been an ongoing issue since before 1986. In the fall of 1986, the City contracted to improve the drainage culvert under NE 8th that serves as the conveyance system for the Medina Park drainage area outlet. In 1999 the overflow weir system to control the lower Medina Park pond level was installed. According to Mrs. Maxwell (owner of 8040 NE 8th) the flooding problem was exacerbated when neighboring property was filled to construct a new home. Mrs. Maxwell has attended several recent Park Board meetings complaining about this issue. The Public Works Director has talked with Mrs. Maxwell and is currently studying the flooding issue related to the lower Medina Park pond outlet stream and 8040 NE 8th back yard area for possible solutions to alleviate the flooding potential. 2. The Medina Beach Park Shoreline Improvement project is substantially complete. A final punch list of identified items of work to be addressed has been forwarded to the contractor and discussions are underway to determine a schedule for completion of the remaining work and final site restoration. ITEM CM-3D 3. The new emergency generator for City Hall is ready for installation as soon as the utility agencies install the new utility services. The generator is a dual fuel engine (natural gas and propane). The new natural gas service will be installed from the existing gas main on the east side of Evergreen Point Road to the new generator location behind the south end of the hedge next to the parking area and run from there to the City Hall building basement mechanical room. A fenced 500 gallon propane tank will be placed next to the generator. The electrical switching gear for the generator has already been installed in City Hall. I expect the generator to be ready for service next month. 4. The Architect for the City Hall renovation project (Johnston Architects) has submitted 90% design documents for design review by staff and any interested individuals. A set of drawings is available for viewing at the public counter. The documents include the replacement of the outside deck surface, siding replacement on the south wall of City Hall, interior shear wall and seismic connections, replacement of the outside restroom fixtures and heaters, heating and ventilation system improvements, painting and carpeting of the entire building. An alternate bid item for new lighting fixtures will be included in the documents for consideration should sufficient funds be available to improve the building lighting. An alternative City Hall location is being evaluated at this time to reduce interference with the work, reduce the contractors risk and limit the liability exposure while providing adequate facilities if the building were to remain in use during the work. Preliminary discussions with the 1st Church of Christian Science indicated that their site would accommodate two stand alone portable trailers in their south parking lot. Negotiations are in progress. Should it prove to be mutually advantages, City Hall would be temporarily relocated for approximately four to five months. The proposed City Hall construction project schedule is as follows: 90% contract documents review and revision (December 2007) Request Council authorization to "Call for Bids" (January 28) Advertise for Bids (January 31 st and February 7th) Open Bids (February 22nd) Award the Contract (March 10th) Construction (April through July) 5. Phase II of the 841h Avenue NE poplar tree replacement contract has begun. This final phase involves the removal of the remaining identified hazardous poplar trees and the planting of 17 new Bowhall maple trees. Seattle Tree Preservation is completing the work at a cost of $114,000 with the Overlake Golf and Country Club contributing $35,000 as their portion of that cost. Q .
