The February 11, 2008 Regular Meeting of the Medina City Council was called to order by
Mayor Nelson at 6:30 pm.
ROLL CALL
Council Members Present: Lucius Biglow, Drew Blazey, Bret Jordan, Jim Lawrence,
Mark Nelson, Robert Rudolph, and Shawn Whitney
City Staff Present: Mark Weinberg, City Manager; Wayne Tanaka, City
Attorney, Ogden Murphy Wallace; Jeff Chen, Chief of Police;
Joe Willis, Director of Public Works; and Rachel Baker, City
Clerk
EXECUTIVE SESSION
Council recessed into Executive Session at 6:30 pm to discuss two items of pending
litigation and potential litigation, including but not limited to discussion of legal risks of a
proposed action, pursuant to RCW 42.30.110(1)(i).
Council Members Biglow, Blazey, Jordan, Lawrence, Nelson, Rudolph, and Whitney;
City Manager; City Attorney; and City Clerk were present. Executive Session adjourned
at 7:11 pm. No action was taken.
Following a break, the Regular Meeting was called back to order at 7:15 pm.
APPROVAL OF AGENDA
City Manager requested to pull item CA-7, Resolution Authorizing Donation of a
Flagpole and Communication Services, and informed the Council Sergeant Keith
McDonough of the Mercer Island Marine Patrol would not be present; however the
Marine Patrol presentation was included in the agenda packet.
The agenda was unanimously approved as amended by the Council following a motion
by Jordan and a second by Whitney.
PRESENTATION
City Manager introduced Jane Hague, King County Council Member from Council
District Six. Council Member Hague spoke of her involvement with the Budget
Leadership Team and Transportation Committee and added she is Chair of the Utilities
and Parks Committee and Vice Chair of the Growth Management and Natural

Resources Committee. She welcomed contact from constituents regarding needs at the
regional level and spoke of regional transportation issues including the importance of
speaking as one voice regarding the State Route 520 corridor and tolling.
Mayor Nelson announced he would begin opening Council meetings with a flag salute
and then led the Council, staff and audience members in the Pledge of Allegiance.
PUBLIC COMMENT
Mayor opened floor to public comment at 7:24 pm.
Resident Vance Mylroie addressed article published in the Seattle Post Intelligencer.
Resident spoke of personal safety for individuals and loved ones. Mr. Mylroie expressed
Medina is more protected now than in the past, thanked Chief Chen for his constant and
extraordinary service and that he and his department should be given all technological
advantages needed to protect the City. Resident expressed his delight in the flagpole
and his opinion that the communication technologies within would someday save lives in
Medina. He concluded saying the bickering regarding the installation has been a waste
of time.
Resident Henry Paulman asserted he did contribute to the PI article and inquired if
Council had any questions regarding the report he submitted to the City. He conveyed
that final action has not yet been taken in response to complaints filed against Chief
Chen during 2007.
Resident Kathleen Higgins spoke of traffic that speeds and cuts through to and from
State Route 520 on NE 121h and 84th Avenue NE and stressed it has increased to an
intolerable and unsafe level. Resident requested Council implement traffic calming
measures on NE12th Street and 84th Avenue NE, stop signs on 861h Avenue NE, a stop
sign on 12th Avenue NE and 841h Avenue NE, an alteration of the curved lane to 84th
Avenue NE to accommodate buses only, a reduction in the speed limit on 84th Avenue
NE to 30 miles per hour, a crosswalk on 84th Avenue NE and 201h Avenue NE, and to
coordinate policing with Clyde Hill. Resident expressed issue must be addressed to
protect school children and community character. Ms. Higgins said she has noticed an
increase in litter due to the cut through traffic.
Resident Mary Odermat proclaimed support for Chief Chen and Mark Weinberg and
supported their professionalism and willingness to serve the City of Medina. She
addressed Mayor Nelson saying she would hope he would stand firm and be
independent and not be drawn into the "good old boys' club". She stated her hope the
Council will be one where individuals would be acknowledged for the value each brings
to the group. She said she has known Mayor Nelson to be a gentleman with great ethics
and that he has always been interested in the best interests of the City. Mrs. Odermat
voiced that she looks forward to the next two years watching the Mayor build bridges
and thanked him for serving in the position.
Resident Dave Hedequist said the issue in the PI article was embarrassing, particularly
reader replies. Mr. Hedequist suggested the City investigate Mr. Paulman to determine
why so much trouble has been caused and to look into why audits were done. He

asserted Chief Chen and the police department are superior and he is proud to have
worked with them on committees during the past three years. He expressed he is glad
to see a new group of council members and urged the mayor and council members to
stand up to the older group of council members, to not be puppets and to get beyond
personal agendas.
Mayor Nelson announced that his personal goal is to build bridges with the Council and
to keep Medina as a top rated City and one all will continue to enjoy and to live in.
Resident Pat Boyd said he is in favor of what the police department needs to protect the
City and urged everyone to move on.
Resident Heija Nunn conveyed she would hope the Council would review the donation
policy and increase the current limit in an effort to not turn down what may be offered for
the public good. She inquired if a dedicated school resource officer would be funded in
the near future.
Mayor closed participation period at 7:39 pm.
REMARKS AND ANNOUNCEMENTS
Mayor summarized meetings attended and issues discussed. Council Member Whitney
remarked about shooting in Kirkland, Missouri and recommended people pause and be
cautious and consider unintended consequences.
CONSENT AGENDA
Council Member Rudolph requested and Council support was received to pull item
CA-90, Remote Teleconference, from the consent agenda in order to allow for Council
discussion.

COMMITTEE FOR PLANNING COMMISSION AND PARK BOARD APPOINTMENTS
TO BE COMPOSED OF THREE PERSONS, INCLUDING THE MAYOR, TO
INTERVIEW CANDIDATES THEN MAKE A PROPOSAL FOR ONE CANDIDATE TO
BE CONFIRMED BY THE COUNCIL. IF THE APPLICANT IS NOT CONFIRMED THE

The February 25, 2008 Special Meeting of the Medina City Council was called to order by
Mayor. Nelson at 6:33 pm.
ROLL CALL
Council Members Present: Lucius Biglow (via telephone), Drew Blazey, Bret Jordan,
Jim Lawrence, Mark Nelson, and Shawn Whitney
Council Members Absent: Bob Rudolph (excused)
City Staff Present: Mark Weinberg, City Manager; Wayne Tanaka, City
Attorney, Ogden Murphy Wallace; Joe Willis, Director of
Public Works; and Rachel Baker, City Clerk
Mayor Nelson led those in attendance in a flag salute.
PUBLIC COMMENT
Mayor Nelson opened the floor to public participation at 6:34 pm. No comment was
presented and the comment period was subsequently closed.
PRESENTATION
Nelson introduced Dick Cushing from Waldron and Company. Mr. Cushing described
Waldron's city manager recruitment process and the relationship the company would
have with the Council during the process. He explained Waldron's interim city manager
service and the contract process for interim services.
Mr. Cushing proposed that the fee for basic recruitment services would be reduced to
half the amount assessed during the last city manager recruitment and fees for
expanded consulting services at the beginning of the process, including teambuilding
work, would be billed at a rate of $200 per hour, not to exceed $7,500.
Interim City Manager applicant Michael Caldwell introduced himself to the Council and
audience members. Mr. Caldwell described his professional and educational
background.

to:
1. Evaluate the qualifications of an applicant for public employment pursuant to
RCW 42.30.110(1)(g) and regarding professional negotiations pursuant to RCW
42.30.140(4).
2. To discuss with legal counsel pending litigation pursuant to RCW 42.30.110(1)(i).
3. To review negotiations on the performance of publicly bid contracts, pursuant to
RCW 42.30.110(1)(d).
Council Members Biglow (via telephone), Blazey, Jordan, Lawrence, Nelson, and
Whitney; City Manager; City Attorney; and City Clerk were present. Stephanie Croll,
attorney with Keating Bucklin & McCormack, was also in attendance. Executive Session
adjourned and the Special Meeting was called back to order at 8:39 pm.
Council Member Biglow exited the meeting immediately following Executive Session.
OTHER BUSINESS
Temporary City Hall Facilities (8:39 pm)
City Manager summarized need and estimated costs for temporary facilities due to the
impending City Hall building repairs and outlined three recommended options.
Public Works Director described staff needs and projected costs for temporary space
and answered Council inquiries.
MOTION JORDAN AND SECOND WHITNEY TO AUTHORIZE CITY MANAGER TO
ENTER INTO NEGOTIATIONS TO EXECUTE A LEASE FOR TEMPORARY
PREMISES WITH RECOMMENDATION FOR COMMERCIAL LEASE SPACE TO BE
FIRST ON PRIORITY LIST AND NOT TO EXCEED $60,000. MOTION CARRIED
UNANIMOUSLY AT 8:52 PM.

RESOLUTION NO.
AMENDING THE CITY OF MEDINA CITY COUNCIL GUIDELINES TO CREATE
A PERSONNEL COMMITTEE OF THE CITY COUNCIL TO REVIEW
APPOINTMENTS TO THE PLANNING COMMISSION AND PARK BOARD AND
AMENDING SECTION 2.08(D).
WHEREAS, currently the Mayor is charged with the authority to make appointments to
the Planning Commission and Park Board, subject to confirmation by the City Council;
and
WHEREAS, the Council wishes to create a three -member personnel committee to
conduct interviews and make recommendations to the full Council; now, therefore
THE CITY COUNCIL OF THE CITY OF MEDINA HEREBY RESOLVES AS
FOLLOWS:
Section 1. Section 2.08(D) of the City of Medina City Council Guidelines is
hereby amended to read as follows:
Section 2.08 Appointment Process.
D. Mayor and Council action.
1. Council Personnel Committee. The Mayor,
together with two other Council Members designated by
the Mayor, shall constitute a personnel committee to
perforin the interviews and recommendations for
appointments to the Planning Commission and. Park Board.
The personnel committee shall interview the applicants,
although the committee reserves the right to make
recommendations after reviewing applications and without
conducting interviews. Subsequent to the personnel
committee's review, the personnel committee shall make a
recommendation of appointment to the Council.
2. After the personnel committee has forwarded is
recommendation for appointment to the Council, the City
Council will be given copies of all applications. The City
Council will be given at least ten days to review the
applicants' and the committee's recommendation prior to
the meeting at which the Council will be asked to confirm
the appointment.

SUBJECT: CITY HALL RENOVATION
RECOMMENDATION
It is recommended that the City Council award the renovation of the Medina City
Hall to Smith Construction Services, Inc., and authorize the Director of Public Works to
sign the contract and administer the project.
POLICY IMPLICATION
This action is consistent with the adopted City Capital Improvement Program for
2008-2013 and the adopted City Budget for 2008.
The City consultant, Johnston Architects, advertised the project for bid on
February 121h and 19th. Bids were opened by the City Clerk on March 4th. The attached
bid summary is provided for your consideration.
The Base Bid work detailed within the contract documents includes those items
identified in the City Hall Building Survey Report of December 2006 that primarily
address life and safety deficiencies. The work briefly described includes: the
replacement of the outside deck surface, siding replacement on the south wall of City
Hall, new exterior doors on the south and west sides of the main floor of the building,
two new interior support beams, interior shear wall and seismic connections to the
foundation and between the walls and the roof rafters, new roof, replacement of the
basement outside restroom fixtures and heaters, new heating and ventilation system,
electrical wiring upgrades, painting and carpeting of the entire building following the
repairs to the building envelope and interior walls.
Bid Alternate A work is the replacement of the building lighting fixtures. This work
may be awarded or may be deleted from the project as the Council deems appropriate.
The estimated project cost was $ 730,000 which included a 10% construction
contingency. The project budget is $ 760,000.

The proposed City Hall construction project schedule is as follows:

• Opened Bids (March 4th)

DISCUSSION
An alternative City Hall location is being pursued at this time to reduce
interference with the work, reduce the contractor's risk, limit the liability exposure, and to
provide adequate facilities, rather than occupy the building during the work. It is
estimated to cost approximately $49,000 for the temporary facility.
FISCAL CONSIDERATIONS AND IMPACT
Funds for the award of the bid are available in the Council -approved 2008 FY
budget. Funding for the alternate lighting and temporary City Hall exceed the present
budget of $ 760,000 (the additional funds may either be appropriated from the cash
reserves or from other line items within the adopted 2008 budget).

Dear Ms. Baker,
Johnston Architects is prepared to recommend Smith Construction Services,
Incorporated be awarded the Medina City Hall renovation project based on their
submission of the lowest base bid price, familiarity with this project type and references.
Three bidders presented sealed bids at the opening March 4, 2008, Advanced
Construction, Inc; Smith Construction Services, Inc; and Artus Construction Company.
Artus' bid was not considered due to their considerably higher bid price. Smith
Construction came in with the lowest base bid, $704,169.
Johnston Architects used the base bid price, as it is not known whether Alternate 1 will
be added to the renovation scope of work when project funding is reviewed by the
Medina City Council.
Johnston Architects rejects the Alternate I bid price from Smith Construction and
requests this price be re -negotiated if Alternate 1 is chosen by the City of Medina.

RE: AMENDMENT TO HUNTS POINT POLICE SERVICES CONTRACT
RECOMMENDATION
It is recommended that the Mayor and Council Members approve the attached
amendment to the Agreement between City of Medina and Town of Hunts Point for Police
services dated January 30, 2006.
BACKGROUND
The City has provided police services via contract to neighboring Hunts Point for over 20
years. The terms of current service are outlined in the attached Agreement Between City of
Medina and Town of Hunts Point dated January 30, 2006, as amended.
In September 2007, as required by Agreement, the Medina City Manager submitted a
cost estimate for Police Services to be provided to Hunts Point during the 2008 Fiscal Year. The
estimate was in accordance with contractual formula but nevertheless included a significant cost
increase. Hunts Point was taken aback by the increase and asked the City to amend the current
agreement to provide greater latitude in terminating the pact (which was done), while it
investigated other options. At the same time, the City's respective Managers continued to
explore strategies to make the current Agreement more palatable.
DISCUSSION
Following discussions, staff has identified to areas of change that are believed to
improve the current Police Services Agreement.
The first point is to convert the cost of annual police services from a percentage of
budgeted costs to a percentage of actual costs. This benefits both parties in that actual costs
reflect true costs, and also allow midyear -adjustments (i.e. budget amendments, labor
negotiation agreements etc.) to be incorporated into final billings. In most cases, actual costs
billed will represent a savings for Hunts Point, but in some cases it will help Medina recover cost
increases experienced after the annual budgeted amounts were established.
The second point is to amortize the cost of significant capital improvement purchases
and projects over the useful life of the equipment, or improvement. This is a fair and equitable
method of billing service recipients, who may terminate services well before the value of the
capital equipment or improvement has expired, or been fully recovered.
In accordance with the above, the following amendment is recommended:
Delete Section 5.A and replace with the following language:
Hunts Point shall pay Medina an annual contract estimated amount calculated based upon
Hunts Point's pro rata share of the Medina Police Department's approved annual
operating budget for that year, subject to charges or credits against the actual operating

costs of the Police Department for the immediate prior year. For Instance, in 2008 Hunts
Point shall pay the City of Medina the sum of $249,926, predicated on their pro rata share
of the Medina Police Department's approved 2008 Police Department budget. In 2009,
Hunt's Point's first quarterly payment to Medina based on their pro rata share of the
approved 2009 budget will be adjusted with additional charges or credits against the
actual 2008 Medina Police expenditures. In any given year, Hunts Point's pro rata share
will be based on population, less costs associated with Marine Patrol, prisoner transport,
law enforcement proceeds, proceeds from the sale of equipment and vehicles, criminal
justice tax revenues and prisoner jail costs. The Medina Police Department's share of
Medina's budgeted expenditures for automobile and liability insurance, building
maintenance and equipment repairs, and equipment replacement (capital outlay) shall be
added to the Police Department budget prior to the calculation of Hunt's Point's annual
contract fee. Where individual capital outlay items (CIP) are included which exceed
$25,000 and have a useful life of more than three years, Hunt's Point may exercise the
right to amortize the CIP costs over the useful life of the item(s) if the Medina City
Manager is notified of the intent in writing. Payment shall be made by Hunts Point on a
quarterly basis.
Though approval of this amendment does not guarantee that Hunts Point will continue to
contract with the City of Medina for Police Services for any particular length of time, it does
appear to be a satisfactory resolution to the immediate contract amount dispute.
FISCAL IMPACT
The fiscal impact of this amendment is expected to be neutral in terms of recovering
actual costs of providing services. The burden of financing Capital purchases and improvements
over $25,000 each, with a useful life of greater than 3 years will shift to Medina as service
provider, however proportionate cost recovery is guaranteed as long as the purchase or
improvements are used in providing service to the Town of Hunts Point.

RECOMMENDATION:
The interim Planning Director and the City Planning Commission both recommend to
Council that the MMC sections 17.40.020 and .023 be amended to allow vehicular private
lanes, vehicular rights -of -way and vehicular access easements to be included in the
calculation of lot area: within all zoning districts.
POLICY IMPLICATION:
Lots using private lanes for access will be able to include said square footage in their square
footage calculations for determining structural coverage's. This should provide to property
owners using private lanes equity to similar properties with in all zoning districts. Including
private lanes, easements and rights -of -way in calculating lot size is consistent with most
contemporary planning practices in the State of Washington. In fact, the City of Median at
one time did allow this calculation method in its code.
The existing lot development standard in the MMC section 17.40.020 requires the following:
"In all districts the maximum allowable lot coverage shall be calculated exclusive of the area
of any vehicular private lane, vehicular right-of-way or vehicular access easement". This
development standard applies to all zoning districts. Attached for your information is Chapter
17.40 Lot Development Standards sections 17.40.020 and 023 of the MMC. The side
setback issue was identified as a part of the Planning Commissions 2007 work program
which was approved by the Council on March 12, 2007. It was determined at that time to
examine the issues because of perceived inequality in calculating lot sizes. In particular,
some property owners who live on public streets are allowed to have more square footage
for calculating building coverage because they do not have to exclude the access area
square footage. In addition, persons developing residential property have complained about
the inequity issue to Council members, Planning Commission and Staff. The Council asked
the Planning Commission to study the issue and make a recommendation for their
consideration.
The Planning Commission at its November 271' meeting asked the staff to prepare a series
of graphic illustrations for each of the zoning districts that would depict what the lot
coverage's would look, if in fact, the private lane area, easements, and rights -of way were

included in the area calculations for coverage. Please see the attached graphic illustrations.
For each of the illustrations all other zoning standards for minimum lot area, minimum
setbacks, structural coverage, height of building, and minimum frontage were applied.
The Commissioners during their discussions on November 27th and December 20th
indicated that they felt it was important to maintain the following considerations in shaping
their recommendation on this matter to the City Council:
"That there was a need to provide equity to property owners accessed by private lanes
because it creates a smaller footprint to build on compared to other properties located on
public streets. But, the Planning Commission decided it was important to maintain the
existing set backs of the code, if in fact, the private lanes are included in the calculation of
area coverage's. "

Medina Municipal Code 17.40.023
17.38.040 Stringline setback areas.
The minimum setback from the Lake Washing-
ton shoreline for all structures located within the
stringline setback areas designated on the official
land use and circulation map shall be established
by use of the stringline setback defined in this
chapter. In the event that one or both of the adja-
cent zoning lots do not contain a dwelling so that a
stringline may not be established, the minimum
setback from Lake Washington shoreline shall be
25 percent of the depth of the lot measured from the
shoreline to the farthest boundary line of the build-
ing site but in no event less than 70 feet. Where the
stringline setback established by this chapter is
closer than 70 feet to the Lake Washington shore-
line, the minimum setback from the Lake Wash-
ington shoreline shall be 70 feet. Where the
stringline setback established by this chapter is
greater than 125 feet from the Lake Washington
shoreline, the maximum setback required shall be
125 feet. (Ord. 479 § 4, 1989)
17.38.060 Thirty-foot setback areas.
The minimum setback from the Lake Washing-
ton shoreline for all structures located within the
30-foot setback areas designated in the official land
use and circulation map shall be 30 feet. (Ord. 479

WHEREAS, this matter has been reviewed by the Planning Commission on November

WHEREAS, pursuant to RCW 36.70A.106, the City has notified the Department of
Community Trade and Economic Development of its intent to adopt these amendments at least
sixty days prior to final adoption;

SECTION 4. Effective Date. This ordinance shall take effect five (5) days after its
publication or the publication of a summary of its intent and contents.

SUBJECT: LOT COVERAGE FOR UNDERSIZED LOTS
RECOMMENDATION:
The Planning Commission requests policy direction from Council after reviewing the
attached documentation with recommendation for dealing with the lot coverages for
undersized lots within the R-16, R-20 and R-30 zoning classifications.
POLICY IMPLICATION:
Undersized lots within the R-16, R-20 and R-30 zoning classification will be allotted more lot
coverage for building structures while preserving proportionality and parity in lots value. The
property owners through the sliding scale concept would have a more refined way of
determining what they are able to build on their lots when combined with all other standards
of the zones classification.
BACKGROUN
On November 13, 2007 the City Council at its regular meeting received from the Mayor a
memorandum requesting a discussion on lot coverage's for undersized lots. The Mayor
requested the Council to discuss said memorandum, and to give direction to the City
Manager as to how they wished to proceed. Please see attached the November 13, 2007
memorandum from Mayor Adam to Council. After considerable discussion the Council
directed that the Medina Planning commission study the matter, and report back to Council
with their findings and recommendations The Planning Commission received the lot
coverage issue at its November 27th meeting, and approved a recommendation to Council
on December 20, 2007.
DISCUSSION:
The Planning Commission at its November 27th, 2007 meeting began their review of the
Council's request for discussion on lot coverage's for undersized lots. As was suggested by
Council the Planning Commission's initial discussion was with the undersized lots within the
R-16 zone. As a way to further their discussions within the R-16 zone a sliding scale
concept was introduced which awarded a given additional bonus of coverage depending
upon the size of the lot as noted on the attachment to this memorandum. The attachment is
entitled "Bonus Chart — R16 Zoning Classification". While discussing the matter the
Commission discovered an anomaly in the R 20 & R30 zones at 16,000 square foot lot. As a
result the Commission decided to broaden their review of lot coverage's for undersize lots
within the R-20 and R-30 zones for lots currently 16,000 square or smaller. The Planning

Commission's decided to prepare a white paper visioning statement for the City Council to
review. The statement outlines the process utilized by the Planning Commission, and makes
a recommendation to Council on how they should proceed with the lot coverage for
undersized lots. At its December 20, 2007 meeting the Planning approved the white paper.

Re: Lot Coverage for Undersized Lots
At the November 13, 2007 City Council Meeting the Planning Commission was requested to discuss lot
coverages for undersized lots within existing zoning districts, and return with a recommendation.
Outlined below is the Planning Commission's recommendation.
Larry Frazier, Interim Planning Director presented to the Commission in the attached November 27, 2007
memo an overview of the council's direction, and three potential alternatives as discussion points. After a
lengthy discussion of the topic and the evaluation of the staff alternatives the Planning Commission came
to a consensus on the following recommendation.
The Planning Commission recommends City Council adopt a change to the zoning code that addresses lot
coverage in the R-16 zone. The lot coverage in R-16 is and shall remain 25% for lots 16,000 square feet
and above. for all lots under 16,000 square feet, there shall be a proportionate lot coverage bonus
calculated as zero at 16,000 square feet and increasing to a maximum of 5% for lots 10,000 square feet
and less.
This sliding scale provides for greater lot coverage on the smaller lots in R-16. The additional percentage
increase in lot coverage is not believed to create larger houses than conforming lots as the increased
percentage on the smaller lot still provides for a smaller footprint overall. The rationale behind the sliding
scale was to preserve proportionality and parity in lot value in the neighborhoods and eliminate what
would have been an anomaly at the break point. For example, if the bonus threshold were set at 5% on
lots 10,000 square feet and less, the owner of the 10,001 square foot lot would be allowed 5% less lot
coverage, potentially creating an anomaly in the proportionality of the neighborhood structures and
economic value of the lot.
The Planning Commission rejected as a solution the notion of the site plan review process as the Site Plan
Review Process currently on the books provides for changing the site of the structure on the lot to
minimize impacts on the neighbors. With the small lots there isn't room to move structures so this
process wouldn't create the desired outcome. The existing ordinance would have to be significantly
reconstructed to apply to these circumstances as well since it deals mostly with the concept of situation
of the structure on the lot. The Commission also rejected as a solution the notion of establishing a new
Zoning District. This seemed to create patchwork zoning throughout the city and lacked the
proportionality of structures and parity of lot value over one square foot of land area, which appeared
irrational.
As a result of this discussion the Planning Commission discovered an anomaly in the R-20 & R-30 zones at
the 16,000 square foot lot. Currently the 16,000 square foot or smaller lot owners in R-20 and R-30 have
a 25% lot coverage allowance for a 25 foot height limit where the 16,001 and larger lot owners have a
21% lot coverage allowance for a 25 foot height limit. This would produce circumstances where two
adjacent lots of very similar size would have two dissimilar structures. The Planning Commission
recommends the City Council adopt a similar change to the zoning ordinance where there shall be a
proportionate lot coverage bonus calculated at zero for lots 16,000 square feet and smaller and 4% for
lots 20,000 square feet and larger in only those circumstances where the height limit is 25 feet. This again
seeks to create proportionality of structures and parity of lot value.

BACKGROUND AND DISCUSSION
It is requested the council discuss the following proposals to determine if there is
sufficient interest to schedule a public hearing to more fully review the proposals.
In sections 17.20, 1724, and 17.28 of the MCC, where ever any reference to structural
coverage occurs, it should be modified for all lots less than 10,000 sf to a coverage of 30%,
provided the height of all buildings is limited to not more than 25 feet. no other changes in
minimum requirements, ie. setbacks, are proposed.
In section 2.78.065 of the MMC, an additional requirement is proposed to limit structural
coverage variances to a maximum of 5% of the standard for all lots that qualify for the 30%
structural coverage.
This proposal will allow the owners of very small lots in Medina more options when
planning new construction or remodeling an existing structure. These proposed changes will
affect about 15% of the lots in medina.
MOTION BLAZEY AND SECOND BILLOW TO ADOPT ORDINANCE ACCEPTING
2008 BUDGET. MOTION CARRIED 4-2 (PHELPS AND RUDOLPH OPPOSED) AT 8:09

An amendment to the motion was proposed by Phelps and seconded by Rudolph to
utilize $100,000 from the City's reserves to fund the Granicus program. The amendment
failed by a vote of 2-4.
Hearing Examiner Decisions: Lot Cove rageNariances (8:11 pm)
Adam introduced and summarized initiative. He conveyed the City Attorney advised the

Resident Heija Nunn agreed the procedure was a nice way to approach the topic and
suggested discussion on next topic to follow suit. She said the proposal was nice and
the City should encourage people to make changes within their budgets and within
neighborhood character. Ms. Nunn suggested an R-9 zone, a review of setback
requirements, and a review of variances from the past five to ten years. She stated
change should be in place to solve practical problems for homeowners that desire
simple changes and hoped the matter would go to the community for a lengthy public
discourse.
Resident Pat Boyd said initiative was a great idea and it would make the community
more approachable. He favored recommendation and added that he would like to see
the Planning Commission take a look at it. Mr. Boyd suggested it could change the
character of the neighborhood for the good.
Evergreen Point Road resident Mark Nelson favored Council's review and expressed a
preference to receiving input from the Planning Commission, as well. He said there are
several lots slightly above 10,000 square feet that should also be considered in
proposal and suggested Council consider look at a sliding scale from a 16,000 square
foot lot at 25% lot coverage to an 8,000 square foot lot.
Mayor closed floor to comment and Council discussion followed. Council requested
Planning Commission look at item without looking at reducing setbacks and without a
sliding scale, unless there would be a rationale for that.
Historical Use Permit Ordinance Revision (8:30 pm)
Lawrence introduced and summarized initiative. Mayor opened floor to public comment
at 8:44 pm.
Resident Mark Nelson favored moving the Historical Use Permit and Special Use Permit
process to the Hearing Examiner for the reasons outlined in the meeting packet. He
expressed that a Hearing Examiner may not understand a proposal's impact to the
community and may not apply additional conditions. He said he likes to have a body of
citizens, such as the Planning Commission, review a project and to receive public input
to know how a project could impact the community. He stated his concern about the

Subject: Lot Coverage's for Undersized Lots
At the November 13, 2007 City Council meeting Mayor Adam introduced a discussion
regarding lot coverages for undersized lots within existing zoning districts. Specifically
the Mayor requested that the Council determine if there is a need to review how the City
treats undersized lots within the residential zoning districts. Please see the Mayor's memo
as well as the minutes of the Council discussion on this matter.
The basic problem is that there are lots within the existing residential zoning districts
which are nonconforming. That is, they do not meet the minimum lot sizes in terms of
square footage, and create difficulties for property owners wanting to build homes on
their property. The Council generally expressed, during their deliberations, that there is a
need to provide more flexibility in terms of lot coverages to property owners of non-
conforming lots.
Council at its November 131h meeting referred the issue to the Planning Commission for
their review, and recommendations as to how to deal with the lot coverage for undersized
lots within the City's Zoning Districts.
As a way for the Planning Commission to begin their discussions I have outlined below
several alternatives that the Planning Commission, might want to consider in dealing with
nonconforming undersized lots as directed by the City Council.
Alternative One --- Residential Site Plan Review Process
Many of the exiting provisions of the Site Plan review process embodied in the City's
current code could be utilized to deal with small lots in terms of coverage issues. The site
plan review process may provide more flexibility in dealing with small lots, because it is
a design process as opposed to utilizing fixed development standards. The current
provisions of the zoning code inhibit small lots as it relates setbacks, height of buildings
and lot coverage. Fixed standards inhibit creative solutions to potential designs
considerations. In addition, applications for site plan reviews could be an administrative
process with an appeal of the staff's decision to the Planning Commission or the Hearing
Examiner.
Alternative Two — Overlay Zoning for Nonconforming Lots
It is possible under Washington State Planning Laws to enact a specific overlay zone
which works with the existing zoning designations. An overlay zone for lot coverage
would deal with, and put in place a set of code standards which would be unique to the
issues for lots that do not meet the minimum square footage zoning requirements of the
R-16, R-20 and R-30 districts. For example, the set back requirements within each zoning
designation could be averaged to allow the placement of structures more flexibility as to
their placement on a property. Also it would be possible to allow for administrative
adjustments to setbacks on lots up to a certain percentage.
Alternative Three — Establish a R-10 Zoning District
It is my understanding that some years back the Planning Commission worked on the
idea of establishing an R-10 Zoning District. It is also my understanding that the City
Council at the time turned down the idea of enacting an R-10 Zone. Said zoning district if
enacted would recognize the nonconforming lots and making them legal lots for building
purposes. This alternative would require that the Medina Comprehensive Plan Land Use
Element be amended. It would also require that a new zoning district be prepared
specifically to implement the 1.0,000 square foot density.
Recommendation_
That the Planning Commission develop recommendations to be forwarded to the City
Council as to how Medina should proceed to address the issue of Lot Coverages for
Undersized Lots.

On behalf of the City Council, Mayor Miles Adam thanked commissioners for
volunteering their time to the city.
OTHER BUSINESS
Lot Coverage for Undersized Lots (7:11 pm)
Commissioners reviewed Lot Coverage for Undersized Lots chart that former
Planning Commissioner, Mark Nelson and Mayor Miles Adam created in 2001.
Jordan indicated that as of 2001, there were 463 lots that were less than 16,000
square feet, which were considered to be substandard lots. Of those; 336 lots
were in R-16 zone and 127 were in R-20 and R30 zones.
Jordan explained that homeowners who have a 16,001 square foot lot in the R-
20 zone are entitled to 21 percent lot coverage, while 15,999 square feet
qualifies for 25 percent lot coverage. Jordan pointed out that this is an inequity in
the code that needs to be addressed. Jordan affirmed that the original intent was
to provide relief to lot owners in the R-20 and R-30 zones whose lots were less
than 16,000 square feet. He said it was also meant to give these property owners
more lot coverage so they could have similar size structure as owners of lots
greater than 16,000 square feet.
Mayor Adam confirmed for Sparks that approximately 160 Medina lots were
10,000 square feet or less, and twelve lots were 8,000 square feet or less.
Residential Site Plan Review Process (7:18 pm)
Commissioners spoke about Variances, Hearing Examiner and Board of
Adjustment.
Jordan explained that the chart was proposing a sliding scale. He reported that
according to the chart, on an 8,000 square foot lot at 30 percent lot coverage
there was a 2,400 square foot footprint, and at 25 percent there was a 2,000
square foot footprint. He said it was proposing a sliding scale where an 8,000
square foot lot got a 5 percent coverage bonus, 12,000 square foot lot got less
and a 16,000 square foot lot got only a .85 percent bonus. He stated the
numbers were not vastly different than what is currently permitted.
Jordan affirmed that presently the Site Plan Review Process includes a public
hearing similar to Construction Mitigation. Jordan also reiterated that it does not
offer a lot of predictability, and that currently it is only required for lots over
40,000 square feet.
Jordan explained difference between Variances and Site Plan Review Process.
Sparks and Jordan discussed costs of Variances and Site Plan Reviews. Sparks
spoke about another jurisdiction that had a flexible design standard. Jordan
explained concept of minor deviations.
Jordan confirmed for Sparks that the only time neighbors are allowed to
comment publicly is during Site Plan Review, Variances and Construction
Mitigation.
Goudy and Jordan spoke about the City Council's rationale and possible concern
behind sliding scale idea. Jordan explained that there was difficulty in creating
sliding scale that covered all eventualities without creating a lot of unintended
consequences.

R-10 Zoning District (7:36 pm)
Jordan explained that creating an R-10 Zoning District was previously discussed
in 1999-2001, but the City Council asked the Planning Commission to stop
working on it.
Frazier indicated that establishing an R-10 zone would require changing all
zoning in that area, as well as Medina's Comprehensive Plan.
After further discussion, Commissioners decided not to recommend creating an
R-10 Zoning District.
Overlay Zoning for Nonconforming Lots (7:39 pm)
Jordan indicated that sliding scale and overlay zone accomplish essentially the
same thing. Jordan discussed approaching the issue from an overlay standpoint
and figure out what size would trigger an overlay. He also mentioned the need to
determine what special considerations need to be made to affected homeowners
and how to handle the bump that would get created.
Price spoke about designing a sliding scale formula where residents with lots
16,000 square feet and under could apply for up to five percent bonus lot
coverage through a Site Plan Review. He stressed that this would be a
predictable solution.
Commissioners discussed in detail the Overlay Zoning alternative for lot
coverage on small lots, which included the number of small lots in Medina, bulk,
building height, neighbors, and site plan requirements for Site Plan Review.
Jordan suggested applying Site Plan Review as a two prong process where
homeowners could either build to existing code, or pursue a Site Plan Review
where they could apply for up to 5 percent greater lot coverage.
Sparks spoke about providing some certainty for property owners.
Jordan and Price discussed details regarding mathematical calculations, sliding
scale, Site Plan Review and Variances.
Jordan indicated that he wanted to break recommendation down into two parts;
one for each R-16 and R-20.
Jordan concluded commissioners were recommending that lots 16,000 square
feet and less could apply for a lot coverage bonus of a sliding scale, which would
be determined to be 0 percent at 16,000 square feet and 5 percent at 10,000
square feet and under, through Site Plan Review process in an R-16 zone.

Jordan commented that in the R-20 and R-30 zones there needed to be a scale
for both 16,000 square feet lots and under and one for lots 16,000 to 30,000
square feet.
Jordan and Price spoke about the R-20 and R-30 having two height limits.
Jordan explained that commissioners were focusing on 25 foot height limit since
it was the only place lot coverage amount varied. He said with higher height limits
lot coverage goes way down.
Price and Jordan discussed proposing giving property owners at 25 foot height
level in R-20 and R-30 zones the same as what they did in R-16 zone.
Commissioners agreed that a Site Plan Review asks for public input regarding
siting and bulk; provides predictability; and protection for surrounding home
owners.
Jordan requested Frazier provide a staff analysis of how site plan review
ordinance may need to be altered in order to be useful for proposed application.
He explained that there may be some language in the Municipal Code that might
need to be updated to accommodate recommendation.
After detailed conversation, Commissioners decided to provide same R-16
recommendation for R-20 zone with 16,000 to 20,000 square foot lots. After
discussing it further, they decided not to make a recommendation regarding R-30
lot coverage bonus.
Jordan stated he would complete a draft memo and Excel spread sheet for
review at next Planning Commission meeting.
Calculation of Side Setbacks for R-20 and R-30 Lots without Penalty for Private
Lane Width (8:31 pm)
Jordan explained there is a perceived inequity in the code in that in R-20 and R-
30 zones the side setback requirement is based on overall width of the lot. He
stated this is unfair to lot owners with the private lane easement since this area
counts as part of the lot width but not part of the lot calculation.
Jordan noted that in R-20 district the minimum setback from any part of the
building shall be ten feet or 15 percent of site width which ever is greater.
Jordan indicated that commissioners could recommend either changing how side
yard setback is calculated, which he said has the implication of drawing
structures closer to private lanes. He commented that this forms the question of
"Do we want to create more of a mix between structures and vehicles?" Jordan
affirmed the other way to address issue is to include private lane when
calculating lot coverage, which he explained would allow a greater use of the
area that is in current setback.

Commissioners discussed easements, surveys, setbacks, and lane width
construction.
Jordan stated commissioners could leave setback alone and address the
buildable area. He noted that extending the buildable area inside the footprint
would solve the problem. Jordan explained that the unfairness of the setback
creates in essence a smaller footprint because property owners have a greater
setback from their property line to the building than their neighbor does.
Jordan indicated that commissioners did not want buildings to be closer to drive
aisles. However, he said they did want to provide relief for owners who can not
build the same size house as neighbors even though they have the same size
lot. He pointed out that commissioners could increase the lot coverage by
including the private lane in lot coverage calculation.
Commissioners discussed lanes that bisect property, and differences between
driveways and private lanes.
Commissioners agreed to recommend that private lanes be considered part of lot
for purposes of calculating lot coverage, but they would leave setbacks alone.
Jordan asked Frazier to report back with example of application in three or four of
the circumstances.

Frazier pointed out that 20 years ago the ordinance was same as
Commissioner's current proposal.
Jordan provided Frank with background information as to reason topic was being
discussed. Frank discussed his experiences with obtaining variances.
Frazier stated that the Public Work's director indicated that 15 feet was the
average size for private lanes that now exist within the city. Therefore, 15 feet
was used in his illustrations.
Frazier stated he would include a draft a memo with drawings for Commissioners
review.
Frazier explained definition of easements.
Frank discussed hammerhead turnarounds for use by fire department.
Price requested that staff research the reason ordinance was modified 20 years
ago.

Public Safety Enhancement (Camera Enforcement) Project Update:

2006 Financial Audit;
On January 30, 2008 the City Manager received a draft copy of the 2006 Fiscal Year Financial
Audit from the State Auditor. An exit audit was conducted on March 5, 2008 between
representatives of the Auditor's office, three Council Members, and staff. A number of issues
were discussed and the staff pledged to have additional information to the Auditor, as well as
the City's formal written response, by the first week of April. It is anticipated that the Auditor's
final report could be presented to City Council for review and acceptance as early as the April
14th City Council Meeting.
Public Record Requests:
The unrelenting barrage of public records requests continues, with over 106 requests received
through March 5th. At this rate, the City can expect to receive approximately 600 such requests
in 2008 compared to approximately 425 in 2007 and 50 in 2006. These requests, originating
largely from a couple of people, including one non-resident, divert thousands of hours of staff
time which could be spent addressing other public service needs. The requests also add
thousands of dollars of legal expense fees to the City budget, as the City's attorney frequently
must review requests to determine if they meet the Public Record Act (PRA) requirements. The
productivity of City staff, in particular the City Clerk and Police Records Manager, has been
adversely impacted; it is recommended that the incoming City Manager submit a budget
amendment to the City Council to add part-time administrative assistant hours to the City's
budget and staffing authority at an estimated cost of $50,000 annually. In the absence of such
action, it is inevitable that essential services will be deferred, productivity will continue to
decline, and staff burn -out will result in key staff departures.

At approximately 2:50 am on February 8, 2008, a Medina officer was attempting to take
a subject into custody on an outstanding warrant when a passing vehicle nearly struck the
officer as he stood on the side of the roadway. Thankfully the heads up Officer was able
to side step out of the path of the recklessly driven vehicle and made a quick records
check of the plate. Information returned showing the vehicle to be a reported stolen on
February 6, 2008 out of King County. The officer disengaged from the primary
stop/warrant subject and attempted to catch up to the stolen vehicle in his patrol car. The
stolen vehicle attempted to evade the officer and after a short pursuit the driver of the
stolen vehicle abandoned the vehicle in the 12300 block of Old Bellevue - Redmond
Road. The suspect then fled on foot. A Bellevue K-9 unit was summoned but their track
failed to locate the suspect. The canine unit did locate the suspect's jacket which he shed
while running away which contained his identification card. The stolen vehicle was full
of tools and copper wiring soiled in fresh mud. Our Medina Officer processed the crime
scene for evidence. Approximately 2 % hours after initially having contact with the stolen
vehicle, the same heady Medina Officer located the sweaty suspect at a nearby restaurant
in Bellevue. The suspect was positively identified by the officer by the identification
card he left behind while running away. The suspect was taken into custody without
incident. The suspect is a convicted felon for a myriad of crimes who is on active
supervision with the State Department of Corrections. He was booked into the King
County Jail for investigation of possession of a stolen vehicle and felony eluding an
officer. Further investigation later revealed the found property inside the stolen vehicle
had been taken from the construction site of the new Saint Thomas School at 8300 NE
12th Street. The suspect appears to have breached the security fence and removed
miscellaneous power and construction tools estimated at $3000. During his crime spree
at the construction site, the suspect appears to be responsible for an estimated $40,000
worth of property damage when he removed copper wiring that had just been installed the
previous day. Additional charges of commercial burglary, malicious mischief in the 1st
degree and theft in the first degree will be filed as well. The Medina Police Department
will be coordinating investigations with the King County Sheriff's Office who are
investigating a similar crime.

The victim was notified by a bank that person(s) unknown attempted to open an account
using her social security number and birth date, and an address was from New York. No
monetary loss. Investigation is pending.
Fraud (ID Theft) 2008-0000482 02/11/08
1400 block of Evergreen Point Rd
On 02/05/08 or 02/06/08 the victim received a call from his bank asking about an account
that was opened at another bank using his name, which he denied. The victim went to his
bank and was informed his account had been flagged as fraudulent by the other bank.
The victim was instructed by Medina police to file a report with the Federal Trade
Commission. Investigation is pending.
Vehicle Prowl (Theft) 2008-000550 02/15/08
2800 block of Evergreen Point Rd (Metro Park & Ride)
Medina officer responded to a report of vehicle prowl that occurred on 02/15/08 between
7:30 am and 7:45 pm. The victim locked his vehicle and when he returned he saw the
passenger side rear window broken out and the CD player was stolen from the dash of the
vehicle. Total loss: $300
Vehicle Prowl (Theft) 2008-0000654 02/22/08
7500 block of NE 28th PI
Between 8:00 pm on 02/21/08 to 7:30 am on 02/22/08 unknown person(s) entered two
vehicles that were unlocked and parked in the driveway. The CD changer was taken
from the dash of the first vehicle, but nothing was taken from the second vehicle. Total
loss: $300
Burglary 2008-0000655 02/22/08
7600 block of 10' St
Victim reported both of his vehicles were parked in the garage and unlocked. When he
got into one of the vehicles to leave for the day he noticed several sets of keys and $10 in
quarters were taken from the vehicle. He then noticed the second vehicle had been
opened, but nothing was taken. The side door of the garage was unlocked, which the
unknown person(s) gained access. There was no entry into the main residence. Total
loss: $10

3200 block of Evergreen Point Rd

On February 19t' at approximately 6:40 PM, a Medina officer responded to the 3200
block of Evergreen Point Road to investigate a burglary that had occurred between
3:OOPM and 6:30PM while the homeowners were away. The subject(s) gained entry by
throwing a rock through the back door and reaching through the hole to unlock the door.

Once inside, the subject(s) entered an upstairs bedroom and removed an unknown
amount of cash. A potential person of interest has been developed as a result of
information provided by the homeowners. Medina detectives are pursuing all possible

Fraud (ID Theft) 2008-0000506 02/13/08
2500 block of 82nd Ave NE
The victim reported he was contacted by phone about a credit card application using his
name. Upon checking his credit report and contacting different financial institutions, he
found nine more fraudulent applications all dated February 2008. The victim contacted
the companies and stopped the applications. There is no monetary loss.
Burglary 2008-0000695 02/25/08
1100 block of Evergreen Point Rd
Medina officer responded to a report of person(s) unknown entering an attached garage
and removed items from his unlocked vehicle parked inside the garage. The victim
reported between 6:30 pm on 02/15/08 and 10:00 pm on 02/23/08, person(s) unknown
took a set of keys belonging to the car, a float for his boat, a tire pressure gauge, and a
BMW hand held cellular phone. The victim reported the side door to the garage was
unlocked and the alarm was not activated. No entry had been made to the main
residence. Total loss: $1,222
Fraud (ID Theft) 2008-000696 02/25/08
8400 block of NE 71h St
Medina officer responded to a report of identity theft via email by the victim. She
reported she received a collection letter from AT&T that an account using her name and
social security number had been set up with a Florida address. The victim placed fraud
alerts with the credit reporting bureaus. No monetary loss. Investigation is pending.

The victim received a call from a credit union in Lacey that unknown person(s) had
written two checks using his name, address and driver's license number. The victim
stated he does not have an account at the credit union or that he lost his driver's license.

Victim reported their battery powered leaf blower and a six pack of paper yard waste
bags were missing from the storage locker attached to the carport. The storage locker

1400 block of Evergreen Point Road

At approximately 7:50 PM on Wednesday February 131h, a Medina officer was
dispatched to a report of a theft that had just occurred in the 1400 block of Evergreen
Point Road. The victim reported that from his front window he saw the subject reach up
onto the front porch and help himself to the roses which were sitting on the railing.
When the victim confronted the man, the subject grabbed all three dozen long stem roses
and ran off. The Medina officer responding to the call located a subject matching the
description, and upon questioning the subject admitted to the theft, explaining that, "I was
only going to take one ... It's Valentine's Day tomorrow!" Investigation revealed the
subject was a solicitor who had been selling magazines in the area throughout the
afternoon. In fact, the subject had unsuccessfully tried to sell the magazines to the victim
shortly before the theft. The subject was booked into Kirkland Jail for Theft in the Third
Degree. Total estimated loss: $42

Medina police responded to a report of a vehicle prowl which occurred between 11:30
pm on 02/21/2008 and 9:00 am on 02/22/08. The vehicle was locked but the alarm
system was not activated. The victim noticed the passenger window had been broken
out. He stated a laptop, tools, a bag, and approximately $30 in cash were left in the

Medina officer responded a report of harassing phone calls. Victim stated she had been
in a dating relationship ten years ago and over the course of time she had been receiving
several hang up phone calls. Medina officer contacted the caller who denied making any
hang up phone calls. Victim requested this be reported as informational only.

Medina officer responded to a harassment complaint. While contacting the victim, the
suspect called and it was determined he was suicidal. Medina officer located the suspect
and he was involuntarily committed to a local hospital.

MEDINA DOG FOUND IN PORTLAND
While visiting their daughter in Portland, Oregon over the weekend, a Medina couple
brought their dog along for the visit. While in Portland, the dog ran away. Fortunately, a
Portland police officer found their dog the next day and noticed it had a Medina animal
license permit. Upon contacted the Medina Police Department, the owner was advised
and eventually reclaimed their pet. (See attached email)
GROUP VISITS THE POLICE DEPARTMENT
During this month, a small group of young girl scouts visited the Medina Police
Department. During their visit they had an opportunity to meet City Manager Mark
Weinberg. (See attached thank you from the girls).

I am most glad that Java is safely back: home, and gratified the Medina animal licensing
program played a pivotal role.
This is an extreme example why the Medina Police Department provides our own animal
control services instead of contracting with King County Anir.al Control. The expeditious
and seamless manner our officers can access our own city animal 1-1cense database can make
all the difference when time is of the essence. I do not think for a moment the Portland
Police Department would have been able to speak to a "Live person at King County A-imal
Control on the weekend to connect the dots so to speak. The resul for Java 'might not have
been so kind if the Portland PD would not have been able to locate you.

Dear chief :Chen,
Kay and I would like to commend Officers Marshall and King for prompt, professional
handling of a situation that led to the recovery of our lost dog, Java.
We were: visiting our daughter in Portland this weekend and took Java along. Saturday night
he stayed in our daughter's apartment while we all went out for dinner. When we returned,
he bolted out the front door. We attempted a wide search with no luck, so we tried to
sleep and hoped for the best.
Sunday morning we had a message on our home phone from Medina PD,, Officer Marshall, that
Portland police had picked up a lost dog. Java had been out all night in freezing, rainy.
weather, and was shivering in the parking lot at a Starbuck°s in the early morning, about
a mile from the apartment. Two Portland police officers coaxed him out with a pastry,
checked his tags, contacted Medina police, who called to leave a message and stopped by
our house. We contacted Portland PD, who delivered the dog. The communicating officer
noted that the Medina police were verb helpful. To top it off, w€ received a follow-up
call from officer ring,..
We appreciate our Medina police force This is just one example of how teamwork and
communication make the Department such_a great service to our community..

Planning Commission Meeting Recap - The February 26, 2008 meeting of the
Medina Planning Commission had two items on their agenda.
Construction Mitigation Plan C-2013, Level 2, Kuula Residence — 3425 Evergreen
Point Road — The Medina Planning Commission approved a CMP for the Kuula
Residence. The proposed project includes demolition of an existing single —family
residence and the construction of a larger 8,100 single family residence on a 48,805 SF
lot in an R-20 zoned area. Site improvements will include retaining walls, replacement of
an existing private lane, and landscaping. Approximately 3,042 cubic yards of exported
soil and 42 yards of imported soil are estimated for this projected. It is estimated that
this is equivalent to 309 truck loads to be transported. The project is estimated to cost
$2,100,000. The CMP was approved by the Planning Commission subject to conditions.
Discussion — Oversized Homes (mega houses) — The Planning Commission's 2007
work program identified the need to discuss the issue of oversized homes occurring
within the City of Medina. The Planning Commission received in their February 26, 2008
agenda packets documentation from the Cities of Bellevue and Kirkland as to how they
are currently dealing with oversized homes. In addition, the Commission also received
literature from other municipal jurisdictions in the United States which are attempting to
cope with oversized homes. The Planning Commission discussed the issue only briefly
and decided to wait until the new Development Services Director is on staff, before
launching into a full discussion on this matter. The March 25, 2008 PC agenda will have
on it the oversized issue for discussion.
Building Permit Appeal — The hearing record for the appeal of the issuance of a
building permit is now closed. A decision on the appeal of permit B-1640 regarding the
determination of original grade is now due on Friday March 141h. Following the Hearing
Examiners decision a review of current operating procedures regarding original grade
determination is needed.

RE: February 2008 Public Works Activity Report
1. The Public Works Crew has focused on vegetation management this month
planting new trees along Indian Trail, transplanting rhody's, pruning and
trimming street plantings and Medina Beach Park, pruning the willow tree on
the north side of Medina Park pond all in preparation for spring, that we all
look forward to and long for.
2. The Medina Beach Park Shoreline Improvement project is substantially
complete. The new seating bench wood laminated top was delivered to the
park and is waiting for the contractor to install it. The contractor has delayed
some of the final punch list items of work pending good weather.
3. The new emergency generator for City Hall is ready for installation as soon
as the utility agencies install the new utility services. The utility service
conduit crossings under Evergreen Point Road have been accomplished.
The next step is the rerouting of the overhead lines and connection of the
power, telephone, and cable services for City Hall. When the new natural gas
meter is installed, the emergency generator will be installed and connected to
City Hall.
4. The Architect for the City Hall renovation project (Johnston Architects)
completed the design documents and advertised the project. A pre -bid
conference was held on February 21 st and a number of contractor and
subcontractors were in attendance. An alternate bid item for new lighting
fixtures was included in the documents for consideration should sufficient
funds be available to improve the building lighting. Bids will be opened on
March 4t" and will be presented to Council on March 10t". Construction
should begin by April 1 St and extend to August 15t".
An alternative City Hall location is being pursued at this time to reduce
interference with the work, reduce the contractors risk and limit the liability
exposure, and to provide adequate facilities rather than occupy the building
during the work. The primary location under consideration is located in the
Banner Bank complex at 12443 Bel -Red Road in Bellevue with ample space
for City Hall staff and Council chambers. Police temporary location at this
time is planned to be in a local residence. Moving preparations are underway
with the tentative moving scheduled for March 28t". More information and

posting on the City web page and in a newsletter will be forthcoming as
information develops.
5. The Bellevue waterline replacement project along Evergreen Point Road
north of SR 520 is nearing completion with the final replacement of the east
half of the concrete roadway. Final clean up and frontage restoration will
follow the completion of the roadway work.
6. The Public Works crew will be placing traffic counters at 84`" and Lake
Washington Blvd. to track vehicle speeds for possible enforcement and/or
other traffic safety considerations.
7. The Park Board has scheduled a community work day on March 22nd in
Medina Park at 5-Corners to trim, prune, and thin the shrub plantings to
prepare for some new landscaping accent plantings to improve the
appearance of the park and the entry to the community. All council members
are encouraged to bring their gloves, pruners, and participate.
