RE: Labor Consultant Contract
It is recommended the City Council authorize the City Manager to sign a consulting agreement, as
presented, with Cabot Dow of Cabot Dow Associates, Inc, to negotiate a new labor agreement
with the City Of Medina Police Guild.
Mr. Dow is well known as one of the top labor contract consultants in the State of Washington. He
is often a speaker at AWC (Association of Washington Cities) labor relation seminars. He is well
organized and thorough and has a reputation for keeping the bargaining process moving and
achieving good contracts that are fair to both labor and management.
AGREEMENT
AGREEMENT dated this day of , 2008, by and between the
CITY OF MEDINA, hereinafter called "City", and CABOT DOW ASSOCIATES,
INC., hereinafter called "Dow".
WHEREAS, the City must soon begin negotiations for 2009 labor relations
contract(s); and
WHEREAS, the City wishes to enlist the aid of a professional labor-management
relations consultant to work with the City in said negotiations:
NOW, THEREFORE, in consideration of the conditions and covenants contained
herein, the parties agree as follows:
1. Dow shall, under the direction of the City, perform such of the following
services as shall be desired by the City: Represent, advise and/or assist
the City in negotiation of collective bargaining agreement(s); evaluate
labor agreement proposals; compare the compatibility of proposals with
conditions and/or proposals of similar public and private employers;
prepare responses to proposals received from authorized bargaining
representatives; represent the City, if necessary, in mediation and interest
arbitration proceedings; and perform such other appropriate services
related to the City's personnel and collective bargaining matters as shall
be desired by the City.
2. The City shall pay to Dow the sum of one hundred forty dollars ($140) per
hour for said services.
3. It is understood and agreed that in the event Dow represents other entities
in the area and spends time performing personnel and labor relations
services for other entities on any particular day, the charges would be
prorated on the basis of time spent on the City of Medina business.
4. The Term of the Agreement shall be until negotiations have been
competed to the satisfaction of the City and terms and conditions of the
contract(s) with the bargaining unit(s) have been solidified; provided,
however, that either party may terminate said Agreement upon ten (10)
days' written notice to the other party.
