From: Hunts Point SR520 / 84th ave. interchange committee
Re: SR520 On -Ramp Recommendation to the Hunts Point Council
The Committee recommends retaining the Loop On -Ramp design for the following
reasons:
1) Preserve the Quality of Life and the Sylvan Nature of Hunts Point. The Half -
Diamond design mitigation will require additional lanes of pavement and the
destruction of surrounding Trees and sidewalks. Additional Stop signs or a traffic
light will be required to allow 700 cars per hour to access SR520 via a left turn.
2) Safety for Fire / Police / EMS access to and from Hunts Point. The Half -
Diamond design forces the Hunts Point / HOV lane to encounter a stop sign and
may block free access without a mitigating 4th lane across the lid.
3) Convenience and Safety of Residents Access to and from Hunts Point
4) Minimize the takings of Private property of Hunts Point Residents.
5) Minimize impacts to the surrounding points communities by allowing better
traffic flow and not creating extraordinary mitigation measures required for the
Half -Diamond on -ramp. Specifically Medina Circle and the Hawthorne
neighborhoods will be blocked Monday through Friday during afternoon rush
hours with the Half -Diamond design.
6) Familiarity with the existing neighborhood traffic patterns using the loop on -ramp
which has been working well for many years.
7) The loop on -ramp design Lid Park offers less public access to the Hunts Point
Neighborhood via the park preserving Hunts Point Privacy and Security.
8) The Half -Diamond design will encourage and force additional traffic to use the
Hunts Point traffic circle instead of staying on 84th and points drive.
Furthermore, the committee recommends that the Town commit its full resources in its
attempt to retain the Loop On -ramp and that the current committee be retained to work
with WSDOT and continue negotiations to retain the Loop On -Ramp. After that time, we
recommend forming a new more inclusive committee to work with WSDOT and the
SR520 Contractor to review and implement the detailed design of the on -ramp, bicycle
path, sound walls, vegetation screening, and the design of the lid park.
The Committee also recommends that we continue this process in an open and inclusive
format.

On Friday September 10 and Monday, September 13, 2010, I checked references and background on Par -
Tech Construction, the apparent low bidder for the above referenced project.

Executive Summary:
Banking information: Solid financials, no apparent issues
Insurance & Bonding: Solid long term company
Credit check: Did not check due to expense.
State regulatory agencies: Checked, L&I, DOR and ESD: No issues
Project references: One very high recommendation, rest were average. First change order
problem being too high, rest were better. Some staff have personality problems. Very
on processing required state public works forms. Appears that the closer the project t
the better the project. The projects further away from Oregon have issues with supe on,
paperwork and subcontractors.

Wrote the bid and will write the performance bond, also handles their general and commercial
insurance. With this Medina project, PTC will be at or slightly exceed their limit. They have
approximately 4.5 million single, 6.5 million aggregate in capacity, and they can easily expand
that. ANW has no problems with PTC. PTC is an excellent company since 1985, doing
municipal, school district and military projects. They have never had attachments to their
performance bond (This is not correct — see reference check #1 comments below). They do not
have attachments to their GC state bond. They had a recent auto accident claim, but PTC was
deemed to not be at fault. They are a great account.

Staff confirmed that the company does not appear to be delinquent in their Department of
Revenue tax payments. Internet report indicates no problems. They could not cowmen
on the pace of filings on required state forms.
Verbal References:
Par -Tech Construction:
Talked with Roger (President), Nancy (Vice -President) and Brock (estimator
projects are public works in the 3 to 5 million dollar range, mostly municip
military type projects. They have 3 site supervisors, I project engineer, 1 s tor,
and the president and vice president. Crew size varies depending on job 1 some
work with their own forces.
Reference #1: Project: Seattle area Fire Station, 99% complete
Their project is a complete remodel and addition, about 1.6 million. Par-T
(PTC) was ok, just know what you are getting into. Oregon subs are probl of
managed as well as they would have liked. They were two months late move
problem subs. Recommended we pay attention to the sub list. They currently
ten workers for Viking Drywall that didn't get paid, and as such, they have file
attached PTC's bond. PTC was slow on the paperwork side of the project, slow o
Intents, Affidavit of Wages paid, subcontractor approvals, shop drawings, permits, etc.
quality of the work was OK, but things got promised and were slow to perform. PTC did
significant portions of the construction work themselves. They had problems on the amount of
markup that was charged on change orders.

Reference #2: Project: Southwest Washington Multi Purpose school building, complete
PTC was a challenging contractor. Superintendent was not qualified and did not run the project
properly, which resulted in poor coordination. The superintendent was terminated near end of the
project and after that things went well. Roger (president) and Phil (general superintendent) were
good to deal with. The first change order was very high and it was a battle to get them to agree.
In the end, they did agree and all change orders after that were easy.
Reference #3: Project: Oregon Military
PTC did several projects with them, ranging from small to several million dollars. Outstanding
company, great people. Would love to have them do all his work. Won't kill you with change
orders, works within scope and budget. Does well in value engineering if asked. Fixes things
after the fact, very competent people. Has nothing but really good comments to say.
Reference #4: Project: Oregon Schools
Did multiple projects, didn't perform as well on the first ones but did better in the more recent
projects. Public works forms were a problem, but they did a good job. Lots of change orders,
but that wasn't the contractor's fault and they were fair on the costs. They used a lot of their
own forces in the construction.
Reference #5: Project: Oregon County public remodel project
Three projects over two years. PTC did alright, but the superintendent was rough around the
edges. Happy with their work, they had tight timelines and PTC performed and got it done. The
subs were good. The change orders were fine, lot were negotiated. There was a lot of head
butting with their young Architect, mainly t)ersonality problems.
In closing, it appears that Par -Tech Construction is an average contractor with gr
operates further away from their home office in Oregon, they have problems filir
required paperwork. The project superintendent is critical for coordination and
have not yet proposed a superintendent. Change orders will be a problem at first
on the first few proposals, it should improve as the project goes on. Strong conti
construction documents will help.

AGREEMENT FOR SERVICES
Consultant: David A. Clark Architects, PLLC
This Agreement is entered into by and between the City of Medina, Washington, a
municipal corporation, hereinafter referred to as the "City," and David A. Clark Architects,
PLLC, hereinafter referred to as the "Consultant."
WHEREAS, the City desires to have construction management services performed for its
City Hall/Police Department expansion project; and
WHEREAS, the City has selected the Consultant to perform such services pursuant to
certain terms and conditions;
NOW, THEREFORE, in consideration of the mutual benefits and conditions set forth
below, the parties hereto agree as follows:
1. Scope of Services to be Performed by Consultant. The Consultant shall perform those
services described in Exhibit "A" of this agreement. In performing such services, the Consultant
shall comply with all federal, state, and local laws and regulations applicable to the performance
of such services. The Consultant shall perform services diligently and completely and in
accordance with professional standards of conduct and performance.
2. Compensation and Method of Payment. The Consultant shall submit invoices for work
performed using the form set forth in Exhibit `B".
The City shall pay Consultant:

commencing upon execution and ending , unless sooner terminated under the provisions
of the Agreement. Time is of the essence of this Agreement in each and all of its provisions in
which performance is required.

Subject: RFQ for City Hall Construction Management Services
The City of Medina is requesting a statement of qualifications to provide
construction management services for the City Hall Addition and Renovation
Project located at 501 Evergreen Point Road. Bids were received for the project on
September 2, 2010 and the anticipated date for award is September 13th. The
apparent low bid was received from Par -Tech Construction for $ 1,635,000. The
project duration is expected to be from October 2010 to July 2011.
The selection of the most qualified service provider will be based on past
experience managing successful public projects, responses to this RFQ,
references, and by interview. Please provide references that demonstrate your
expertise and management skills. Submit to Joe Willis, Director of Public Works at

Construction Management scope of services will include but not be limited to the
following:
• Perform due diligence of apparent low bidder and advise City staff prior to
contract award
• Serve as the Owners Representative, coordinating between the Contractor,
the Design Architectural Team, and city management staff to accomplish
the project within the allotted budget and time frame
• Review the plans and specifications for potential conflicts and change order
claims
• Monitor the project from Notice of Award through project close out
• Act as the City's prime contact for the Architect Team (Group Mackenzie)
and the contractor, and review, evaluate, and process all invoices from the
Architectural Team, testing agency, and others
• Working with the Architectural Team to clarify project requirements to the
Contractor, monitor compliance with the contract documents, and provide
documentation of all directives and correspondence
• Review disputes and conflicts and coordinate with City staff to resolve
• Provide onsite construction management and observations, verify testing
and special inspections are accomplished, and provide weekly reports
• Establish regular weekly meetings with the Contractor and Architect to
discuss schedule, work issues and progress, submittals, document
discussions and provide meeting notes
• Ensure all construction activities are coordinated in advance, monitor for
compliance with the contract documents
• Review and monitor the Contractor's project schedule
• Review the project budget and track it in relation to the Contractor's
progress versus the bid breakdown for the items of work, provide monthly
reports
• Log and track all submittals, RFI's, and change order requests for timely
processing
• Review, evaluate, and process all pay applications
• Make monthly presentations to the City Council
• Assist the City in obtaining furnishings for the new City Hall
• Review as -built drawings monthly and ensure they are being updated
• Participate in project punch list inspections, building system testing and
commissioning, and final O & M document review
• Assist with the project close out

AGREEMENT FOR SERVICES
Consultant: David A. Clark Architects, PLLC
This Agreement is entered into by and between the City of Medina, Washington, a
municipal corporation, hereinafter referred to as the "City," and David A. Clark Architects,
PLLC, hereinafter referred to as the "Consultant."
WHEREAS, the City desires to have construction management services performed for its
City Hall/Police Department expansion project; and
WHEREAS, the City has selected the Consultant to perform such services pursuant to
certain terms and conditions;
NOW, THEREFORE, in consideration of the mutual benefits and conditions set forth
below, the parties hereto agree as follows:
1. Scope of Services to be Performed by Consultant. The Consultant shall perform those
services described in Exhibit "A" of this agreement. In performing such services, the Consultant
shall comply with all federal, state, and local laws and regulations applicable to the performance
of such services. The Consultant shall perform services diligently and completely and in
accordance with professional standards of conduct and performance.
2. Compensation and Method of Payment. The Consultant shall submit invoices for work
performed using the form set forth in Exhibit `B".
The City shall pay Consultant:

The Consultant shall complete and return to the City Exhibit "C," Taxpayer Identification
Number, prior to or along with the first invoice submittal. The City shall pay the Consultant on
a monthly basis, for services rendered, within ten days after City Council approval.
3. Duration of Agreement. This Agreement shall be in full force and effect for a period
commencing upon execution and ending , unless sooner terminated under the provisions
of the Agreement. Time is of the essence of this Agreement in each and all of its provisions in
which performance is required.

3. Workers' Compensation coverage as required by the Industrial Insurance laws
of the State of Washington.
4. Professional Liability insurance appropriate to the Consultant's profession.
Minimum Amounts of Insurance
Consultant shall maintain the following insurance limits:
1. Automobile Liability insurance with a minimum combined single limit for bodily
injury and property damage of $1,000,000 per accident.
2. Commercial General Liability insurance shall be written with limits no less than
$1,000,000 each occurrence, $2,000,000 general aggregate.
3. Professional Liability insurance shall be written with limits no less than $1,000,000
per claim and $1,000,000 policy aggregate limit.
Other Insurance Provisions
The insurance policies are to contain, or be endorsed to contain, the following provisions for
Automobile Liability, Professional Liability and Commercial General Liability insurance:
1. The Consultant's insurance coverage shall be primary insurance as respects the City.
Any insurance, self-insurance, or insurance pool coverage maintained by the City
shall be excess of the Consultant's insurance and shall not contribute with it.
2. The Consultant's insurance shall not be cancelled by either party except after thirty
(30) days prior written notice has been given to the City

Consultant shall furnish the City with original certificates and a copy of the amendatory
endorsements, including but not necessarily limited to the additional insured endorsement,
evidencing the insurance requirements of the Consultant before commencement of the work.
8. Record Keeping and RenortinLy.
A. The Consultant shall maintain accounts and records, including personnel, property,
financial, and programmatic records, which sufficiently and properly reflect all direct and
indirect costs of any nature expended and services performed pursuant to this Agreement. The
Consultant shall also maintain such other records as may be deemed necessary by the City to
ensure proper accounting of all funds contributed by the City to the performance of this
Agreement.

14. Confidentiality. All information regarding the City obtained by the Consultant in
performance of this Agreement shall be considered confidential. Breach of confidentiality by the
Consultant shall be grounds for immediate termination.
15. Non -appropriation of funds. If sufficient funds are not appropriated or allocated for
payment under this Agreement for any future fiscal period, the City will so notify the Consultant
and shall not be obligated to make payments for services or amounts incurred after the end of the
current fiscal period. This Agreement will terminate upon the completion of all remaining
services for which funds are allocated. No penalty or expense shall accrue to the City in the event
that the terms of the provision are effectuated.
16. Entire Agreement. This Agreement contains the entire agreement between the parties,
and no other agreements, oral or otherwise, regarding the subject matter of this Agreement shall
be deemed to exist or bind either of the parties. Either party may request changes to the
Agreement. Changes which are mutually agreed upon shall be incorporated by written
amendments to this Agreement.
17. Notices. Notices to the City of Medina shall be sent to the following address:

18. Applicable Law; Venue; Attorneys' Fees. This Agreement shall be governed by and
construed in accordance with the laws of the State of Washington. In the event any suit,
arbitration, or other proceeding is instituted to enforce any term of this Agreement, the parties
specifically understand and agree that venue shall be exclusively in King County, Washington.
The prevailing party in any such action shall be entitled to its attorneys' fees and costs of suit,
which shall be fixed by the judge hearing the case and such fee, shall be included in the
judgment.
19. Severability. Any provision or part of this Agreement held to be void or unenforceable
under any law or regulation shall be deemed stricken and all remaining provisions shall continue
to be valid and binding upon the City and the Consultant, who agree that the Agreement shall be
reformed to replace such stricken provision or part with a valid and enforceable provision that
comes as close as reasonably possible to expressing the intent of the stricken provision.
20. No Third Party Rights. Nothing in this Agreement, or any circumstances arising as a
consequence of any of the services provided under this Agreement, shall give any rights or

EXHIBIT A — SCOPE OF SERVICES
Project: City Hall/Police Department expansion project
1. Monitor the project from notice of award to 90 days past close out.
2. Review the plans and specs for potential conflicts and change orders.
3. Log Notice of Intent to pay prevailing wages.
4. Review budget on weekly basis, set up budget line items consistent
with city budget codes, administer and track budget for all money
spent in construction, consultant costs, printing, testing, fees,
FF&E, advertising, etc.
5. Act as the City's prime contact for the Architect and the contractor.
6. Interact with City Staff for all aspects of the project, including building,
planning, finance and administration.
7. Make presentations to council at bi-monthly intervals and at close out and
as required.
8. Log and insure all RFI's and change order proposal requests are being addressed.
9. Review, evaluate, approve and process all change orders.
10. Review and monitor contractor's schedule.
11. Review, evaluate, approve and process all pay applications from the contractor.
12. Review, evaluate, approve and process all invoices from the Architect, testing
agency and other groups.
13. Attend all weekly construction meetings and review/edit the Architect's minutes
prior to release.
14. Review disputes and conflicts, coordinate with City staff.
15. Assist the City in obtaining FF&E quotes, bids and handle the selected vendor
from start to finish.
16. Assist the City in obtaining moving bids, coordinate the move in process.
17. Assist the City in obtaining technology bids and coordinate the separate contractor
as above.
18. Review and coordinate all final close out M&O manuals and warranty related issues.
19. Accompany and review Architect's punch list and back check.
20. Review as -built drawings prior to final pay app.
21. Prepare final close out documentation for City staff for easy access.
