1. Washington Association of Sheriffs and Police Chiefs received 27 applications for
the Medina Police Chef position. I am working with Garry Anderson of WASPC to
screen the applications for experience, education, and response to the
supplemental questionnaire. We will conduct preliminary phone interviews and
bring the finalists back for three panel interviews and a public candidate forum
later in July and early August.
2. WSDOT just issued a decision to relocate the Evergreen Point Road temporary
park and ride lot to the north edge of the DOT right of way and construction
staging area. Due to limited space and to avoid cutting down six mature trees,
the lot will be reduced from the current capacity of 50 stalls to 19 stalls for the
remainder of the construction project. The full 50 stalls will be restored when the
new park and ride lot is opened in its final location in 2013. WSDOT will work with
Metro to provide notice to transit riders of this change. They have also stated that
they will work with the City to address neighborhood and community concerns
regarding safety and privacy.
3. Lifeguards opened the beach last Friday for great weather over the 41h of July
weekend. The hours this summer are from noon to 7:00 pm. The season will end
Wednesday, August 241h. Construction area will stay fenced until the first of
August to let the sod get a head start for Seafair and Medina Days. Also this year,
Medina Beach is opening a "Swim Lap Area" to the south (left) of the floating
dock. Thanks to the Seattle Harbor Patrol, they placed a buoy marked "Swim
Area" to protect the area from boaters. This area is for the Lifeguards to do in-
service training as well as give opportunity for swim teams and tri-athletes to
train.
4. City Hall is accepting checks for Medina Days. So far we have received
$2850.00. We pass the checks along directly to the Medina Days Committee. I
don't know what they have received directly, but am sure they will always accept
more. The fireworks display is already under contract with the City.
5. The WSDOT traffic study for the roundabout on 84th Ave NE and 520 was not
ready for this Council meeting. It is rescheduled for August 81h. However, staff is
meeting with consultants and staff from Clyde Hill to review concepts for the
design and construction of 84th Ave NE from 12th to 24th. This is the project that
received grant funding for the two cities joint project.
6. The move back to City Hall will occur sometime the last two weeks of July if the
construction is complete on time. All meetings in July will most likely take place at
St. Thomas unless otherwise noticed.

Communication/Outreach
Between June 9 and July 5, 23 notices were issued via GovDelivery. A detailed report is attached.
Currently e-notices have the potential to reach 1,210 individual subscriber profiles with a total of
8,604 subscriptions. There were 204 new and 37 deleted individual subscription profiles since June 9.
To date the City has issued eight postcards, including: four council, one park board, two shoreline,
and one communication tower.
Staff has received a few calls recently from residents not receiving City bulk mailings (postcards).
Missed addresses were verified with the City's mailing vendor who informed us that the bulk mailing
lists purchased from the USPS may indeed exclude certain names and addresses, pointing out mailing
addresses may be removed from bulk mailing lists upon request of a property owner as a way to
minimize junk mail. For those that prefer to avoid bulk mailings, copies of the City's postcards can be
viewed via the City's online records repository and are delivered to e-notice subscribers via email.
In addition to e-notices, there are a number of resources available on the City's website to assist with
service needs, some include: an online help desk, online forms and public records repository.
The help desk tool has recently been upgraded and is intended to allow citizens and
businesses to submit requests to the City online. Requests are then automatically directed to
appropriate staff for a response.
The website contains links to numerous department -specific forms, including public records
request, building permit applications, house watch request and many more.
The records repository contains a wealth of public records, forms, and other documents
categorized by department and/or purpose. The database is updated nearly daily and can be
accessed through the City's website.
Public Records Requests
Approximately 157 public records requests have been received by the city clerk's office between
January 1 and July 6. During the same period last year 72 requests had been received. A quarterly
report identifying 2011 requests is attached.
Passports
A total of 175 passport applications have been processed by department staff during 2011, an
increase of 21 since last month's report.

Planning Commission Meeting Recap:
The Planning Commission continued discussion on vacant residences and abandoned
construction sites. This was a follow-up related to their memo to the Council urging
more aggressive means to resolve these situations. The Planning Commission
requested the City Attorney and the City's insurance carrier provide an analysis of the
options the City can take to resolve the problem of the "hole" at 78th Avenue N.E. and
the legal risks associated with these options. (Post meeting note: WCIA has agreed to
provide an assessment.)
Discussion continued on the Shoreline Master Program update with the focus on docks
and piers. Several members of the public attended and provided comments including
Dave Douglas with Integrity Shoreline Permitting, Charlie Kling with Washington
Sensible Shorelines Association (they are involved with promoting an alternative for
Bellevue's shoreline master program), and Steve Burnstead, Suzanne Cohen and Jim
Gerardo, who are Medina residents. The comments primarily expressed concerns
regarding the setbacks, notification of the public about the updates, and requirements
for the docks and piers.
Hearing Examiner Decisions:
The hearing examiner approved, subject to conditions, a shoreline substantial
development permit to install a boatlift (SDP 2011-01). The property is located at 3616
Evergreen Point Road.
Land Use Administrative Decisions:
• Approved lot consolidation for Lots 30 and 31 at 8102 5th Street N.E. The applicant
is Isola Real Estate.
• A Determination of Nonsignificance was issued to install two in -water free standing

1) The Director of Public Works and David Clark continue to meet with the Contractor to
discuss the work, items or issues of concern, remaining work, and anticipated impacts
to the park. Council will continue to receive monthly reports from David Clark on the
progress of the work along with a project budget status report.
The barrier fencing will remain in place as the final grading and landscape work is
underway. I have requested that the landscape contractor install grass sod rather than
seeding in order to have the site in better condition for the upcoming Medina Days
celebration. The building and fire system utility connection was completed and the fire
hydrant has been installed. Paving will be completed this week and final power
connections are anticipated this week. The Project is presently on schedule with
completion of the building scheduled for July 15th.
Staff and council members met with the construction manager and residents who are
concerned about the new staircase from the main floor of city hall into the park area.
We agreed to look at options to see if the emergency exit requirements can be
addressed if the staircase is moved to a different location. The building official's
concerns focus on the fact that the state building code requires two exits from the
second (main) floor, and that there is only one exit from the third floor with the travel
distance from that floor to the ground outside being very restricted by the code.
2) The SR 520 Eastside Transit and HOV Project design and construction by the design/build
contractor Eastside Corridor Constructors (ECC) is well underway with temporary
construction access provided from SR 520 westbound and eastbound at Evergreen Point
Road so that truck hauling traffic can be kept off of the City streets.
ECC holds weekly meeting to discuss the scheduled work and maintenance of traffic,
monthly meetings for coordination of utility relocation work, and initial permit requests.
Review of the project roadway alignment and profiles, paving plan, and pavement marking
plan in Rough Grading Package #2c including the roundabout design (from 80th to 84th Ave
NE) were accomplished with follow up meetings held with City Technical Review Staff,
WSDOT representatives, and ECC members to discuss the review comments.
The temporary park & ride lot situated on the west side of Evergreen Point Road
(across the street from Fairweather Park) will remain open for another few weeks, but
thereafter will need to be relocated on the north side of the temporary construction
loop ramp where approximately 19 parking spaces can be accommodated without the

removal of the trees, or will have to be closed in order for the present area to be
utilized for the construction of the Evergreen Point Road lid structure. City staff is
working closely with WSDOT and ECC to evaluate the temporary park & ride facility,
review its design, and all possible mitigation such as screening from the residential
area to the north and east of the site.
NE 12th Street/Lake Washington Blvd Traffic Safety Improvement Project will begin this
week and be completed by September. Selection and design of the gateway light standard
and entry sign are still under consideration and will be a topic for Council to consider at their
study session scheduled for July 25th. The cost of the gateway light and sign were not
included in the awarded contract.
3) Public Works continues to maintain and prepare Medina Park, Fairweather Park, Viewpoint
Park, and Medina Beach Park for summer use. The lifeguards assisted with the sanding and
finishing of the seating bench at Medina Beach Park, weeding and landscape maintenance
at Medina Park during the last two weeks of June. Their help has been appreciated by the
crew. Regular lifeguard duty resumed at Medina Beach over the 4th of July weekend.
The ATC addition to the City Shop building continues. The roofing is completed and siding is
being installed. Wiring, insulation, and sheetrock installation are in process. Underground
service conduits have been installed.

Sometime during the night, unknown suspect(s) broke in via the back garage door,
entered the main residence and broke into the master bedroom. The owner was not home
at the time. Nothing was taken.

On June 7th, between the hours of 10:30 am and 12:30 pm, a burglary occurred in the
2500 block of Medina Circle. Unknown suspect(s) successfully entered the home by
breaking a window on the first floor in the rear of the house. The house did not have an
active alarm system. The only item stolen was a laptop computer. The Medina Police
have developed a person of interest and will be continuing to investigate.
MISDEMEANOR CRIMES
Theft 2011-001357 06/04/11
1200 block of Evergreen Point Rd
Medina camera alerted Medina officers of a stolen plate and located the vehicle parked in
the driveway. Owner stated he did not recognize the license plate number. The vehicle
still had the correct license plate on the front. The plate was entered into the state system
as stolen.
Assault (DV) 2011-1373 06/06/11
800 block of 84th Ave NE
Upon arrival the Medina officer observed two individuals in a verbal confrontation.
After interviewing both parties, it was learned one of the individuals assaulted the other
and was taken into custody.
Theft 2011-001453 06/13/11
2800 block of Evergreen Point Rd (Metro Park & Ride)
Medina officer responded to a theft that occurred over the weekend of a storage
container. A couple pieces of equipment were taken with a total estimated loss of $3,250.
Camera footage of the storage containers is still pending.

A resident requested to make a police report to document threatening phone calls because
he was concerned for his safety.

Mayor read guidelines for public comment and said comment period may be divided
into two sections with the second section picking up following public hearings. Mayor
opened public comment period at 7:46 pm.
Seattle resident Jeffrey Chen addressed audience and council members concerning
police chief employment matter.
The following Medina residents provided public comment in regard to matter
concerning former police chief: Doug Epstein, Laura Weingaertner, Tim O'Brien,
Chuck Lyford, Steve Brustkern, Miriam Naini, Paul Major, Jim Gerardo, Scott Hannah,
Curtis Wong, Ching Pi -Wang, Cy Humphries, Diana Murray, Doug Hutson, Ally
Svenson, Marnix Bosch (represented by Heija Nunn), David Lee, Todd Nunn, Heija
Nunn, and (first name inaudible) Ewing.
Bellevue resident Jim McGraw provided comment related to police chief employment
matter.
The following Hunts Point residents provided public comment in regard to matter
concerning former police chief: Edward Furia, Doug (last name inaudible), Janet
Dailey, and Peter Henning.
Mayor closed public period at 7:47 pm and added another comment period between items
Proposed Ordinance for Minimum Maintenance Standards for Vacant Residential and
Abandoned Construction Sites and Council Agenda Calendar.
Motion Lee and second Whitney to continue public comment. Dicharry offered
amendment to limit comment period to ten minutes and Lee rejected amendment.
Motion failed 2-4 (Lee and Whitney in favor, Phelps absent) at 7:49 pm.
REPORTS AND ANNOUNCEMENTS
Council members Lee and Whitney commented on public records requests made by
Whitney for expense reports for police department gasoline receipts and three other
public records requests submitted by Whitney the night after Jeff Chen's termination.
Planning commission chair Judie O'Brien reported the shoreline report presented to
council was an inaccurate reflection of the work of the shoreline committee,
suggested hiring a company to help the shoreline committee, and expressed her
disappointment in not being present during volunteer applicant interviews for planning
commission.
Park board chair Matt Kochel vocalized concerns regarding reconstruction of
Fairweather Park and relayed the park board has received requests for a field turf and
field lighting. He encouraged the public to attend a discussion before the park board
in coming months and summarized the park board's open house held April 18. Kochel
called for Medina Days volunteers and donations and pointed supporters to go to
www.medinadays.org.

Medina resident Diana Murray expressed concerns about impacts of construction and her
preference for a park and ride, excluding use by construction workers there and along
Evergreen Point Road.
Medina resident Tobey Bryant spoke about shortage of athletic fields in Bellevue area and
encouraged installation of a turf field in Medina.
Medina resident John Maffei supported Ms. Bryant for field in Medina. He commented
most park and ride users reside outside Medina and such a facility increases crime in
surrounding area.
Medina resident Cindy Adkins expressed desire to keep park as a park and strongly
opposed park and ride.

Medina resident Matt Kochel said Medina, not WSDOT, desires park and ride in Medina.
Mr. Kochel said the park board is in favor of a turf field and does not support lights at
Fairweather at this time, and as a citizen prefers the park to remain a park during
construction and not a park and ride.
Speaker (name not disclosed) commented about park use and did not support staging
area.
Medina resident Heija Nunn suggested Bellevue Christian may be an option for a turf field
and suggested openness to all creative possibilities, especially if on WSDOT's dime.
Medina resident M3 Sweatt recommended council seek out more commentary on issue

Revenue:
Key Items for 2011 Revenue include:
• Property Taxes of $1.31VI YTD 2011 are $74K higher than YTD 2010.
• Sales Taxes are $33K higher for YTD 2011 compared to 2010.
• Utility Tax & Franchise Fee Revenue is $90K as of June 30th. The payments are received
one month after the end of the Quarter, so we will receive cash receipt revenue for 3
Quarters by October, and the 41h Quarter payment in January.
• Licenses/Permits are $78K higher for YTD 2011 compared to 2010.
• Planning & Development Revenue is $113K YTD 2011 compared to $65K for YTD 2010.
(Last year this revenue was reported as "Pass through Non -Revenue". Per BARS
guidelines, this Revenue will now be charged to Planning & Development Revenue).
• REET (Real Estate Excise Tax) Revenue is at $574K YTD 2011 compared to $136K for
YTD 2010.
Total Revenue (for all funds) is $579K higher for YTD 2011 than YTD 2010. This is primarily due to
the 2011 increases in REET Revenue.
Expense:
Key items for 2011 Expense include:
• General Fund Expenditures were ($58K) lower for YTD 2011 than YTD 2010.
• Capital Fund :
o Expenditures are $1.21VI higher for YTD 2011 compared to YTD 2010 due to the City

The Emergency Preparedness Committee Meeting was called to order at 7:05 p.m. by Chair
Kay Koelemay.

APPROVAL OF MINUTES
MOTION ACHESON/SECOND KOELEMAY TO APPROVE January 19, 2011 MEETING
MINUTES AS WRITTEN. MOTION APPROVED.
Japan Earthquake and Tsunami and Radiation Concerns
Chair Koelemay reported on the March 11"' earthquake and tsunami in Japan and concerns
related to possible effects of radiation on those close to and far away from the affected
nuclear facilities.
Noting that the situation changes every few hours, she stated that the United States is
monitoring frequently and that the EPA and government agencies constantly track these
measurements. She said that they are responding to the concerns of the public and are
saying that there is nothing to worry about in the United States.
Discussion relative to the probability of earthquakes in the future for the West Coast and
specifically the Seattle area followed. The similarities of the subduction zone in Japan and
the Cascadia Subduction Zone were compared. Preparedness in the community was
discussed, during which it was elaborated that it may be up to one's neighbors to rescue
individuals, as the city and first responders may be overwhelmed quickly in a disaster.
Medical Committee
Chair Acheson reported that she had reviewed the medical supplies in the trailer at the
public works shop, along with Drs. Kay Koelemay and Doug Dicharry and Emergency
Preparedness Coordinator Finnigan. She said that the supplies would be used primarily for
first aid.
She noted that a "wish list" of additional and replacement for expired items had been
developed and would be going through the process for purchase in the near future.
ITEM CA-3
Koelemay stated that medical staffing may be lacking as physicians are concerned about
liability. She explained that there are some things being worked on at the state level to
alleviate this concern.
Communications Committee
Volunteer Dicharry reported that the radio net, with public service radios provided by the city.
was continuing.
He expressed the idea that family service radios would be a good addition to the program,
linking with public service radios, in time of emergency. He said that Map Your
Neighborhood and CERT Programs would be natural fits for these radios working together.
The strengths of marine radios were noted by Volunteer Morcos.
Volunteer Gulacsik shared that work had been continuing on a system that allows sending
email through HAM Radio — the WINLINK 2000 System. In addition, he explained that if this
region's internet is out, a connection can be made to one further away.
Volunteer Sultan said that the communications group had been working on setting up some
type of drill, in the not too distant future.
Citizens Emer encv Response Team (CERT) Program
The CERT Program was discussed and described as "First Responder Lite." Dicharry noted
the importance of self sufficiency, and stressed that the more volunteers who are involved in
the program, the stronger the community will be.
Dicharry explained that in a disaster situation, the Fire Department does a windshield survey
and will not be able to stop to assist, due to limited resources.
Map Your Neighborhood (MYN) Program
Koelemay reviewed the program, as well as difficulties involved in jump-starting the program.
She noted that she had made contact with Medina Elementary School and would be meeting
with others soon and appeal through PTSA.
Volunteer Sweatt suggested promotion of the program during Medina Days in August, as
well as through Medina Matters.
Those in attendance expressed interest in the program. It was decided to make a strong
effort to hold MYN Meetings before the next Emergency Committee Meeting. It was also
planned to present the Map Your Neighborhood Program at that meeting, to be held in St.
Thomas' Great Hall.

The next Medina Emergency Committee Meeting was scheduled for Wednesday, May 18,
2011. The meeting was adjoumed at 8:40 p.m.

Board members discussed park board vacancies. Kochel requested that future roll call be
taken in alphabetical order. Willis announced that the western portion of the public works
shop had recently been demolished in preparation of the new addition which will house the
ATC equipment, and employees spent several days moving tools and equipment to a
portable trailer.

Medina Park (6:09 pm)
Mickel reported on the following issues related to Medina Park:
-A large sign near the middle bridge had been removed.
-There is a broken tree branch near the south pond.
-The dog water bowl located in the southeast area of the park does not drain.
Loren -Taylor inquired about dead trees in one area of Medina Park. Willis confirmed that
he would research the matter.
Dickmann asked if the city had a need for a small maple tree in Medina Park. Willis
responded that he would ask Pat Crickmore to contact her regarding her inquiry.
Dykes discussed the location of the Medina Park dedication sign.

Dickmann suggested holding a celebration in honor of Medina Park's 40th anniversary,
possibly in coordination with Medina Days. Board members discussed the possibility of
relocating the park dedication sign and the Windsong sculpture during such an event.
Board members spoke about the importance of protecting Windsong from the rain,
especially since it collects water and never fully dries out. Willis agreed with Kochel that in
10 to 20 years the sculpture would deteriorate if not sheltered from the elements. Mickel
volunteered to ask Wells Medina Nursery owners if they would be willing to house
Windsong under a covered area until there is funding for a permanent shelter in Medina
Park. Board members also discussed funding options for a new picnic cover/Windsong
shelter.
Medina Beach Park: (6:24 pm)
Willis confirmed that the city hall remodel was on target for completion in mid -July.
Fairweather Nature Preserve: (6:24 pm)
Willis confirmed that sports teams would be allowed to practice in Fairweather until
WSDOT begins work in that area.
Indian Trail: (6:25 pm)
Flagg reported that tall weeds are growing along Indian Trail.
Lake Lane: (6:26 pm)
Board members discussed Milfoil growth along Lake Washington in Lake Lane Park. Willis
explained that he had plans to hire a contractor to destroy the Milfoil. Willis confirmed that
the contractor would obtain environmental permits before proceeding with the work.
NEW BUSINESS
April Parks Open House Discussion Items (6:27 pm)
Loren -Taylor reported that there are dog owners who consistently violate city rules by not
picking up their dog's waste in Medina Park. She described instances where a dog owner
repeatedly disregarded the rules. Loren -Taylor suggested that park board members be
allowed to issue violation cards to dog owners who disregard rules. She explained that the
card would summarize local laws and monetary fines related to neglecting to clean up
after dogs. In agreement, board members determined the first step would be to draft the
violation text.
Kochel suggested that information and email links regarding the picnic table/Windsong
cover and design preferences be provided on the city's homepage. Board members
agreed with the idea and discussed it further.
Board members and Willis spoke about the prospect of replacing Fairweather sports field
with turf. Willis explained that he asked WSDOT about the possibility of them installing an
all-weather field with drainage after the SR-520 construction work was completed, but that
it still had to be cleared through an environmental process because it is a change from the
original scope of work. Boardmembers supported replacing the grass sports field in
Fairweather with turf.
Boardmembers, Willis, and Medina resident Wilma Edmonds discussed matters related to
parks topics addressed at the April 18 open house:

Board members confirmed that the Easter egg hunt was a success. There were roughly
300 attendees, approximately 2000 eggs were donated, and the ages of children
participating ranged from toddler to 12 years old.

CALL TO ORDER
The Planning Commission meeting of May 24, 2011, was called to order at 6:32 PM
by Chair O'Brien.

ANNOUNCEMENTS (6.33 PM)
O'Brien explained that the absences of planning commission members Price, Goudy
and Wang were previously known and were excused.
Grumbach made the following announcement:
• He participated in a briefing the previous evening with the City Council
regarding the proposed zoning regulations.
• The City Hall remodel is moving along well. The target date for move -in is the
end of July or August.
• The City is advertising that we will soon begin to accept advanced deposits for
charges associated with consultant services for permits. There have been
problems in the past collecting for charges incurred by applicants and the City
has lost money. Grumbach explained the process for requiring deposits up
front and drawing down the account as charges are incurred.
• A postcard was sent to citizens in an effort to receive opinions on the preferred
design options for the wireless communications tower to be constructed at
Fairweather Park. The Council will decide, based on citizen input, at their
June meeting.
• Nunn announced for the audience that there is a vacancy on the Planning
Commission which will remain open until filled by the City Council.

Chair O'Brien announced that audience members had the choice of speaking during
the audience participation portion of the meeting on any subject or they could choose
to wait until the agenda item came up to speak at that time.
There were no comments and Chair closed the audience participation portion of the
meeting.
PUBLIC HEARINGS
QUASI JUDICIAL:
Construction Mitigation Plan No. C-2975: 2441 Evergreen Pt. Rd. (6.42 PM)
Proposal: Demolish existing 12,000 square foot house and construct a 3,500 square
foot single-family dwelling inside the existing footprint. The home is located within a
geologically hazardous area.
Chair O'Brien explained the process and opened the public hearing. She addressed
the commission on the Appearance of Fairness doctrine and asked if commissioners
had any contacts to disclose. There were no comments.
City Engineering Consultant Christopher Ruiz introduced the project, stating that the
project had been properly noticed and that there were no additional exhibits. He
noted that no grading/drainage permit would be required because the applicants
anticipated reusing the existing foundation. They will be applying for a limited
exemption for the Critical Areas Review requirement. Ruiz recommended that the
CMP be approved with the conditions stated in the staff report, which mainly involve
monitoring by the geotechnical engineer.
Dale Stern of Mark Anderson Consultants, agent for the owner, and construction
supervisor August Swanson from contractor Krekow Jennings were present to
explain the project. Stern presented a site plan to the commission and pointed out
that the 5-acre site is comprised of several parcels. He described the process they
would be using to deconstruct the existing house and reuse all material to the
greatest extent possible. Materials will be removed and stored off -site and then
selected for reuse and brought back to the site. The site is accessible largely only by
barge, with a tram that accesses the house from above. There is no vehicular
access to the house and all materials will be brought in by barge.
Stern advised that there is a conservation easement on the property so no trees can
be sacrificed and they must maintain the natural state of the environment.

May asked about the possibility of spillage or a major event associated with the
barging and what protections might be implemented. Swanson responded that they
would make sure that the sub -contractor will have all necessary equipment on board,
such as spill kits, booms, and anything else associated with their regulatory
requirements. He went on to say that there would be a single point of access and
that they have a good landing site.
Stern and Swanson responded to the commission's questions, including discussion
on the existing retaining wall to remain. Ruiz explained that they will be required to
provide weekly structural reports and environmental conditions. If the geotechnical
engineer observes disturbance or movement they will begin structural re -
enforcement. Swanson estimated that the deconstruction portion of the project would
take approximately 3 1/2months.
There were no additional questions and the public hearing was closed. (6:58 PM)
Grumbach reported that the project will probably qualify for a Site Plan Review
exemption since they are not increasing the size of the footprint.

OTHER BUSINESS
1) Shoreline Master Program Update — Development Regulations, Shoreline
Modification Regulations (700 PM)
Grumbach introduced the City's shoreline consultant, Gabe Snedeker. Grumbach
distributed a packet of the comments that had been received to date so the
commission would have a complete record and a memo with background about what
is being proposed as well as a map showing the proposed and existing setbacks. He
went on to explain that he had briefed the council the previous evening on the draft
document that was out for public comment and noted that the major discussion item
and most controversial issue was the shoreline setbacks.
O'Brien took issue with the setbacks proposed in the document and claimed that that
was not what the committee had decided. Grumbach and Snedeker confirmed that
the document had not changed since the shoreline committee completed it.
Commissioners reviewed and discussed the map provided. O'Brien emphasized the
need to push the envelope with the state regulations. Snedeker explained that, as
proposed, the setbacks shown could be reduced up to 50% with enhancement
activity. Grumbach explained that they would continue to review for changes and
that the council supports the attempt to retain as much as possible the current
requirements.
Discussion followed on how other nearby communities are approaching this and the
methodology used.

Chair opened the discussion to public comment. (724 PM)
Dave Douglas, Integrity Shoreline Permitting, addressed the commission, speaking to
the difference between "buffer" and "setback". Douglas distributed a memo with his
comments regarding the discussion draft. He stated that he thought the setbacks
were extreme but overall the commission's approach was.good. He advised that the
Dept. of Ecology would like the bulkheads to be removed and that the WAC shoreline
modifications don't necessarily relate to fresh water lakes
Robert Short, resident, stated that he had received the post card but had not read the
document. However, he was concerned that his most valuable asset would be taken
away. He suggested that property owners should be told that their properties will
become non -conforming as a result of the proposed changes. Short also suggested
that property owners should be notified that they need to pay more attention to this
issue since they have something to lose.
O'Brien responded that the goal was to keep setbacks to the minimum possible.
Nunn suggested a possible joint hearing with the council.
Snedeker emphasized that water resources are important for human use and clarified
that lawns and recreational activities will continue to be allowed between the
shoreline and structures. Grumbach added that this draft does not preclude
everything from setbacks; there would be exceptions such as walkways, patios and
other intrusions allowed in the setbacks, although not in an actual buffer.
Councilmember Shawn Whitney addressed the commission, asking about the
requirement for an applicant to post a bond to do landscaping within a buffer.
Grumbach responded that it is typical to require a bond for a five-year period for
monitoring and maintenance of a buffer if an applicant triggers the requirement to
provide mitigation. Whitney asserted that in Medina people maintain their yards so it
seems unnecessary to require a bond.
Resident Alex Morcos addressed the commission, noting that it was not easy finding
the information on the website. He said he had researched other cities over the last
couple of days and had looked at Bellevue, Mercer Island and other cities. He
reported that Burien fought DOE and managed to obtain concessions and surmised
that that Medina is similar to these communities so our plan should be comparable to
theirs. Morcos went on to say that it is not fair to take half of a resident's property
away and that we should all work together to come up with something better.
Nunn & O'Brien affirmed that it was the goal of the commission to work together with
citizens on this for a better outcome.
Grumbach indicated that after talking with Ecology he felt that they would potentially
allow setbacks to be based on another method. He suggested that there is a
question mark on the diminishing return in providing prot ction to the lake.
Grumbach claimed that there is no data for urban environments, which are not the

same as pristine conditions. He said they will be looking at these pieces of the
puzzle so they may have more flexibility to look at other possibilities.
May suggested a step back to review other possible approaches. O'Brien agreed
and recommended they start where they want it to be and then provide a couple of
options. She stated that the goal of the shoreline committee had been to maintain
the setbacks at 60 ft. or less.
Snedeker pointed out that they would need to have a defensible proposal; however, it
is not easy to pinpoint Ecology's bottom line. He said he had studied cases that have
been successful and the science involved. It is not purely technical and there is an
element of negotiation with Ecology. He said they would look at what the data
reveals about the existing conditions, if the commission would want to minimize the
differences between the different areas.
May, going back to his earlier point, raised the question of keeping the zones or
contemplating a change to an average percentage for all properties, and what that
might look like.
Grumbach responded that they had originally looked at that and it was worse.
Snedeker offered that Ecology has recommended that cities not come in with a "one
size fits all" setback.
Lee offered that the plan is not detailed enough and not broad enough. It doesn't
address individual homeowners.
May suggested and the consensus was to send the issue of setbacks back to the
committee and the commission move on to other matters.
Additional discussion followed regarding the process for dealing with DOE, the
deadline for completion of the plan and the possibility that the deadline will be
pushed back by the state.

BACKGROUND/SUMMARY:
State law requires all municipalities to prepare and submit their planned six year transportation
improvement plans to the State Department of Transportation by July of each year and in addition, to
qualify for grant funding, each project for which funding is requested must appear on the adopted City
TIP. The attached draft plan merges the CIP and TIP into one document for overall fiscal planning. A
Public Hearing to consider the annual plan was held on June 13, 2011 and no comments were received.
DISCUSSION:
The Proposed CIP/TIP Plan for years 2012 through 2017 was developed from street and right-of-way
improvement condition assessment, storm drainage deficiencies, public facility evaluations, and
incorporates planned improvements such as Phase II of the security camera program in year 2012 and
an overlay of the City Hall parking lot. The attached 2012 — 2017 CIP/TIP Project Summary lists the
projects by year, project scope, budget, and revenue source.
The proposed annual expenditure for the Plan was reduced from the 2010 plan that was programmed at
$ 515,000 to an annual amount of $ 488,00 for year 2012 through 2017 based on the 2011 budget
projections of $ 63,000 Motor Fuel Tax and $ 425,000 REET tax revenues.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF MEDINA, WASHINGTON,
ADOPTING A SIX -YEAR TRANSPORTATION IMPROVEMENT PROGRAM AND DIRECTING
THE SAME TO BE FILED WITH THE STATE SECRETARY OF TRANSPORTATION AND
THE TRANSPORTATION IMPROVEMENT BOARD.
WHEREAS, pursuant to the requirements of Chapters 35.77 and 47.26 RCW, the City
Council of the City of Medina has previously adopted a Comprehensive Street Program,
including a collector and local access street construction program, and thereafter periodically
modified said Comprehensive Street Program by resolution, and
WHEREAS, the City Council has reviewed the work accomplished under said Program,
determined current and future City collector and local access street needs, and based upon
these findings has prepared a Six -Year Transportation Improvement Program for the ensuing
six (6) calendar years, and
WHEREAS, a public hearing has been held on the said Six -Year Transportation
Improvement Program, and
WHEREAS, the City Council finds that there will be no significant adverse environmental
impacts as a result of adoption or implementation of the Six -Year Transportation Improvement
Program.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Washington, that:
Section 1. Program Adopted. The Six -Year Transportation Improvement Program for the
City of Medina, as revised and extended for the ensuing six (6) calendar years (2012 — 2017,
inclusive), a copy of which is attached hereto as Exhibit A and incorporated herein by this

reference as if fully set forth, which Program sets forth the project location, type of improvement
and the estimated cost thereof, is hereby adopted and approved.
Section 2. Filing of Program. Pursuant to Chapter 35.77 RCW, the City Clerk is hereby
authorized and directed to file a copy of this resolution forthwith, together with the Exhibit
attached hereto, with the Secretary of Transportation and a copy with the Transportation
Improvement Board for the State of Washington.

BACKGROUND/SUMMARY:
The SR 520 Medina to SR 202, Eastside Transit and HOV Project Design/Build Contractor, Eastside
Corridor Constructors (ECC) requested the use of the Fairweather Park Playfield for a staging area and
temporary Park & Ride lot during the period of the new Evergreen Point Road lid construction
(approximately 24 months). ECC agreed to restore the area by constructing a new all-weather playfield
following its use.
Per 23 CFR Part 774 (Federal Registry), an impact to a park, recreational area, or wildlife and waterfowl
refuge may be determined to be "de minimis" and allowed if the transportation use of the Section 4(f)
resource (in this case Fairweather Park), including consideration of the impact avoidance, minimization,
and mitigation or enhancement measures, does not adversely affect the activities, features, and
attributes that qualify the resource for protection under Section 4(f).
A Public Hearing was held on June 13, 2011 to consider the request. While there was public support for
a new all-weather playfield, the overwhelming expressed public comment was not in favor of the
removal of the playfield for the period of the new Evergreen Point Road lid construction. Since use of
the Park as a temporary park & ride lot and staging area for the contractor will have an impact on
present activities and features of the park for the period of the construction it is recommended that the
Council deny the request for concurrency on the de minimis determination request.

Summary: The City entered into a consulting contract with Immobili to provide educational,
market assessment and development of standards for wireless communication. Jeff Langdon
and Tom Holland have been the primaries providing wireless consulting services to the City.
The contract was amended and capped at $25,000 in December 2010 to include work on the
wireless communication facility at Fairweather Park. Subsequently, Immobili has been
purchased by Crown Castle and Jeff Langdon is no longer available through Immobili.
However, he is available through Pacific Telecom Services, the firm Tom Holland is a Principle
in.
If the City wishes to continue receiving wireless consultant services to complete the work at
Fairweather Park, a new contract is required. There remain authorized expenditures under the
original contract of approximately $6,635. The consultant is recommending a flat fee of $5,000
to support completing the work on the wireless communication facility at Fairweather Park and
$200 per hour for other wireless communication consultant services the
City might request not to exceed the cap. The City attorney has reviewed the contract.

CONSULTING SERVICES CONTRACT
THIS CONTRACT is made and entered into this day of July, 2011,
by and between the City of Medina, a municipal corporation of the State o1
Washington (hereafter referred to as the "City"), and Pacific Telecom Services,
LLC a Washington limited liability company (hereafter referred to as
"Consultant");
In consideration of the mutual promises and obligations hereafter set forth, the
Parties agree as follows:

Scope of Services
A. The Consultant shall diligently and completely perform the services
and deliverables described in Exhibit A attached hereto and
incorporated herein.
B. After execution of this Contract, the City shall have the right to make
changes within the general scope of services and/or deliverables by a
change order or amendment, in writing, to this Contract. If the changes
will result in additional work effort by Consultant, the City will agree to
reasonably compensate the Consultant for such additional effort up to
the maximum amount specified herein.

exceed $6,635 without the written consent of the City. Said price shall

be the total maximum compensation for Consultant's performance
hereunder including, but not limited to, all work, deliverables, materials,
supplies, equipment, sub- consultant's fees, and all reimbursable travel
and miscellaneous or incidental expenses to be incurred by
Consultant.
C. The Consultant shall submit monthly invoices for services completed
and/or deliverables furnished during the previous month. Upon City's
request, Consultant shall submit necessary and appropriate
documentation, as determined by the City, for all invoiced services and
deliverables.
D. Payment shall be made through the City's ordinary payment process,
and shall be considered timely if made within 30 days of receipt of a
properly completed invoice.
E. All payments shall be subject to adjustment for any amounts, upon
audit or otherwise, determined to have been improperly invoiced.
4. Independent Contractor Status
A. The services and deliverables shall be furnished by the Consultant as
an independent Contractor, and nothing herein contained shall be
construed to create a relationship of employer/employee or
master/servant. No payroll or employment taxes of any kind shall be
withheld or paid by the City with respect to payments to Consultant.
The payroll or employment taxes that are the subject of this paragraph
include, but are not limited to, FICA, FUTA, federal income tax, state
personal income tax, state disability insurance tax and state
unemployment insurance tax. By reason of Consultant's status as an
independent Contractor hereunder, no workers' compensation
insurance has been or will be obtained by the City on account of
Consultant. Consultant may be required to provide the City proof of
payment of these said taxes and benefits. If the City is assessed or
deemed liable in any manner for those charges or taxes, the
Consultant agrees to hold the City harmless from those costs,
including attorney's fees.
5. Potential Conflict Disclosure
A. Jeffrey Langdon ("Langdon"), a telecommunications consultant, is
currently providing the City with consulting services. Langdon also
provides services to Consultant, Pacific Telecom Services, LLC,
Independent Towers, LLC, (Independent). Independent has an
interest in locating a communications facility at the City's Fairweather

Park ("Site"). Such relationship, as disclosed below, has the potential
to create a conflict of interest for Langdon with regard to the Site:
• Langdon is an investor in and an employee of Tarpon Towers, LLC
(Tarpon)
• John Stevens, a principle of Independent is also an investor and
employee of Tarpon
• Tarpon consults with, employs and has Joint Venture relationships
with Independent.
• Such relationships might in the future involve the purchase or other
transfer of all or partial ownership or financial interest in the Site
from Independent to Tarpon
• Langdon may benefit financially from such a transfer.
B. Consultant agrees that, in regard to any dealings concerning the Site,
Langdon shall exclusively represent the interests of the City.
C. The City acknowledges the potential for a conflict of interest and
waives any claim against Consultant related to such potential conflict:
6. Termination
A. The City may terminate this Contract at any time, with or without
cause, by giving ten (10) business days written notice to Consultant.
In the event of termination, all finished and unfinished work prepared
by the Consultant pursuant to this Contract shall be provided to the
City. In the event City terminates this Contract due to the City's own
reasons and without cause due to the Consultant's actions or
omissions, the City shall pay the Consultant the amount due for actual
work and services necessarily performed under this Contract up to the
effective date of termination, not to exceed the total compensation set
forth herein.
7. Indemnification
A. The Consultant shall indemnify, defend, and hold harmless the City, its
officials, officers, agents, employees, and volunteers, from any and all
claims, demands, damages, lawsuits, liabilities, losses, liens, expenses
and costs arising out of the subject matter of this Contract; provided
that this provision shall not apply to the extent that damage or injury
results from the fault of the City, or its officers, agents, or employees.
The term "fault" as used herein shall have the same meaning as set
forth in RCW 4.22.015, as that statute may hereafter be amended.

B. This indemnification shall extend to and include attorneys' fees and the
cost of establishing the right of indemnification hereunder in favor of
the City. This indemnification shall survive the termination of this
Contract.
8. Insurance
During the course and performance of the services herein specified,
Consultant will maintain the following insurance coverage:
A. Automobile public liability and property damage - $1,000,000 single
limit combined for bodily injury and property damage.
9. City ownership of Work/Rights in Data and Publications:
A. To the extent that Consultant creates any Work subject to the
protections of the Federal Copyright Act in its performance of this
Contract, Consultant agrees to the following: The Work has been
specially ordered and commissioned by City. Consultant agrees that
the Work is a "work made for hire" for copyright purposes, with all
copyrights in the Work owned by City. The rights granted hereby to
City shall survive the expiration or termination of this Contract.
10. Miscellaneous Provisions
A. Governinq Law and Venue. Washington law shall govern the
interpretation of this Contract, with Venue in King County.
B. Assignment. The Consultant shall not assign, subcontract, delegate,
or transfer any obligation, interest or claim to or under this Contract or
for any of the compensation due hereunder without the prior written
consent of the City.
C. No Third Party Beneficiaries. This Contract shall be for the sole benefit
of the parties hereto, and nothing contained herein shall create a
contractual relationship with, or create a cause of action in favor of, a
third party against either party hereto.
D. Waiver. A waiver or failure by either party to enforce any provision of
this Contract shall not be construed as a continuing waiver of such
provisions, nor shall the same constitute a waiver of any other
provision of this Contract.
E. Severability and Survival. If any term, condition or provision of this
Contract is declared void or unenforceable or limited in its application
or effect, such event shall not affect any other provisions hereof and all

other provisions shall remain fully enforceable. The provisions of this
Contract, which by their sense and context are reasonably intended to
survive the completion, expiration or cancellation of this Contract, shall
survive termination of this Contract.
F. Written Notice. All communications regarding this Contract shall be
sent to the parties at the addresses listed below, unless notified to the
contrary. Any written notice hereunder shall become effective as of the
date of mailing by registered or certified mail, and shall be deemed
sufficiently given if sent to the addressee at the address stated in this
Contractor such other address as may be hereafter specified in writing.

G. City Representative. The primary City representative for management

H. Entire Contract. This Contract and the attached Exhibits, as modified
herein, contain the entire agreement between the parties as to the
services to be rendered hereunder. All previous and

conditions relating to the subject matter of this Contract are
superseded hereby. The Parties hereto mutually acknowledge,
understand and agree that the terms and conditions set forth herein
shall control and prevail over any conflicting terms and conditions

Summary: The City hired AHBL and The Watershed Company to assist with updating the
Medina SMP. The funding for the consultants came from a $125,000 grant that was awarded to
the City. The grant is paid over three fiscal years with the first two fiscal years completed on
June 30, 2011.
The contracts for the consultant services contained limits on expenditures and a distribution of
work tasks to be completed by each based on the funds available for the first two years. While
much of the work identified in the contracts has been completed, there is still work to be done.
The City has $25,000 available from the third fiscal year of the grant to complete this work. This
work includes revisions to and completing the Accumulative Impact Analysis once a final draft of
the shoreline regulations are completed, revisions to the Shoreline Restoration Plan, and
assistance in completing the local SMP adoption process.
Because of the narrower scope of work necessary to be completed, staff is recommending
moving forward with only one consultant. The Watershed Company was chosen because of
their unique knowledge and experience with the eastern shores of Lake Washington and the
City of Medina, and their work in this area supporting other communities with their SMP
updates. The proposed amendment provides a scope of work for the consultant based on what
remains to be done and contains an expenditure cap not to exceed the $25,000 available from
the grant.

AMENDMENT NO.1 TO
AGREEMENT FOR PROFESSIONAL SERVICES
This Amendment No. 1 to the Agreement for Professional Services ("Amendment")
between the City of Medina ("City") and The Watershed Company ("Consultant") amends that
certain Agreement for Professional Services, dated July 31, 2009 between the City and
Consultant ("Agreement").
WHEREAS, City and Consultant entered into the Agreement to provide professional
services associated with updating the City's Shoreline Management Program; and
WHEREAS, the City and the Consultant wish to modify the scope, term and maximum
compensation of the Agreement, as hereafter set forth, pursuant to paragraph IX thereof;
NOW, THEREFORE, the City and Consultant agree to amend the Agreement as follows:
1. Paragraph IIA is hereby amended to read as follows:
The total amount to be paid by City for Consultant's full and complete performance of
the Services described in Exhibit A shall not exceed $25,000, without the written consent
of the City. Said price shall be the total compensation for Consultant's performance
hereunder including, but not limited to, all work, deliverables, materials, supplies,
equipment, sub -consultant's fees, and all miscellaneous or incidental expenses to be
incurred by Consultant.
2. Exhibit A is hereby amended to read as follows:
This confirms the agreement between the City of Medina ("City") and The Watershed
Company (hereafter "The Watershed Company" or "Consultant") for shoreline master
program update services.
A. The services provided by The Watershed Company will be consistent with the
scope of work listed in paragraph B, which will be authorized via written task order or
email or other written request.
B. This paragraph presents The Watershed Company's scope of work for the City of
Medina Shoreline Master Program (SMP) Update. The scope of work is consistent with
the Washington State Department of Ecology (Ecology) standard scope of work and the
level of effort appropriate for the City of Medina.
The Watershed Company's goal will be to support the City of Medina's efforts to create
useful products that meet Ecology's requirements, maximize use of existing information
and the current SMP and critical areas regulations (where consistent with 2003 Shoreline
Master Program Guidelines), and reflect property owner and citizen input.

Phase A: Ongoing Communications & Coordination
1. Upon request, The Watershed Company will coordinate with Ecology, and
other agencies, such as adjacent jurisdictions engaged in similar SNIP update tasks or
other appropriate entities that may have useful scientific, technical, or cultural
information, including federal agencies, salmon recovery lead entities, universities and
other institutions, individual outdoor recreators, and conservationists, and organizations
with special expertise representing these interests.
2. The Watershed Company will coordinate work of The Watershed
Company's staff, ensuring that Tasks are completed on time and on budget, and that the
City is continuously updated on progress.
3. The Watershed Company will provide the City with monthly progress
reports, and develop and update the project schedule on a regular basis.
4. Deliverables shall include monthly progress reports and schedule updates.
Phase 1: Preliminary Assessment and Public Participation Plan
1. The Watershed Company will participate in public participation events or
meetings as requested by the City, either citizen advisory meetings, planning commission
or City Council meetings, workshops, or open houses, to the extent allowed by the
budget.
Phase 3: Shoreline Policy, Environment Designation, and Regulation Development
1. The Watershed Company will continue development of the cumulative
impacts analysis. The preliminary analysis shall be drafted by others.
2. Deliverables will include a preliminary cumulative impacts analysis.
Phase 4: Restoration Planning: Revisiting Phase 3 Products and Analysis
1. The Watershed Company will revise the Draft Shoreline Restoration Plan
based on City, public and Ecology comment.
2. The Watershed Company will assist the City in re-evaluating and
adjusting the draft SNIP based on the findings of the cumulative impacts analysis, and
will revise the cumulative impacts analysis as needed. The Watershed Company will
finalize relevant maps.
3. Deliverables will include revised environment designation maps,
contributions to revised policies and regulations that address the findings of the
cumulative impacts analysis upon City request, a revised cumulative impacts analysis, a
revised Shoreline Restoration Plan, and final SMP jurisdiction maps.

Phase 5: Local SMP Adoption Process
1. The Watershed Company will peer review the City's programmatic SEPA
(SEPA Checklist and DNS anticipated) on the proposed SMP. The City will prepare the
notice of intent to adopt that will be directed to the State agencies.
2. The Watershed Company will prepare for and attend public hearings or
other public meetings as requested by the City.
C. The Consultant shall report to and work under the general supervision of the City
Director of Development Services, or other person designated by the City Manager.
D. The Consultant shall neither subcontract any of the work, nor assign any rights
acquired hereunder, without obtaining prior written approval from the City.
E. The City shall have access to all books, documents, papers and records of
Consultant that are pertinent to this Agreement for the purpose of City audit,
examination, excerpts and transcripts.
F. All work products produced by Consultant under this Agreement, such as reports,
plans, specifications, data maps and documents, shall be the property of the City.
Consultant will not be held liable for the re -use or modification of work products by the
City for any other project without the express written permission of the Consultant.
G. Payment:
1. The City agrees to pay the Consultant on a time and materials basis for
services performed in accordance with the following staff positions and hourly billing
rates, not to exceed $25,000, for the scope of work outlined in paragraph B above:

AND THE WATERSHED COMPANY
THIS AGREEMENT is made this day of July, 2009, between the City of Medina,
(hereinafter the "City") and The Watershed Company, a Washington Corporation (hereinafter
"Consultant").
WHEREAS, Consultant is in the business of providing certain professional services
specified herein, and
WHEREAS, the City desires to contract with Consultant for the provision of such
services and Consultant agrees to contract with the City for same; and
NOW, THEREFORE, in consideration of the mutual promises set forth herein, it is
agreed between the parties as follows:
TERMS
I. Description of Work. Consultant shall perform work as described in Exhibit A, "Scope
of Work," which is attached hereto and incorporated herein by this reference, according to the
existing standard of care for such services. Consultant shall not perform any additional services
without the express permission of the City.
II. Payment.
A. The total amount to be paid by City for Consultant's full and complete performance of
the Services described in Exhibit A shall not exceed $50,120, without the written consent
of the City. Said price shall be the total compensation for Consultant's performance
hereunder including, but not limited to, all work, deliverables, materials, supplies,
equipment, sub -consultant's fees, and all miscellaneous or incidental expenses to be
incurred by Consultant.
B. Consultant shall submit payment invoice to the City after such services have been
performed, and the City shall make payment within thirty (30) days after the submittal of
the approved invoice. Such invoice shall detail the work, and a description of the tasks
performed.
C. If the City objects to all or any portion of any invoice, it shall so notify Consultant of the
same within five (5) days from the date of receipt and shall pay that portion of the invoice
not in dispute. The parties shall immediately make every effort to settle the disputed
portion.
III. Relationship of Parties. The parties intend that an independent contractor — client
relationship will be created by this Agreement. The Consultant is customarily engaged in an

independently established trade which encompasses the specific service provided to the City
hereunder; no agent, employee, representative or subcontractor of Consultant shall be or shall be
deemed to be the employee, agent, representative or subcontractor of the City. None of the
benefits provided by the City to its employees, including, but not limited to, compensation,
insurance and unemployment insurance, are available from the City to the Consultant or his
employees, agents, representatives or subcontractors. Consultant will be solely and entirely
responsible for his acts and for the acts of Consultant's agents, employees, representatives and
subcontractors during the performance of this Agreement. The City may, during the term of this
Agreement, engage other independent contractors to perform the same or similar work that
Consultant performs hereunder.
W. Duration of Work. This Agreement shall be effective for a period commencing from
the date of signature to completion of the project, as described in Exhibit A, except as provided
for in paragraph V below.
V. City ownership of Work/Rights in Data and Publications. To the extent that
Consultant creates any Work subject to the protections of the Copyright Act (Title 17 U.S.C) in
its performance of this Agreement, Consultant agrees to the following: The Work has been
specially ordered and commissioned by City. Consultant agrees that the Work is a "work made
for hire" for copyright purposes, with all copyrights in the Work owned by City. To the extent
that the Work does not qualify as a work made for hire under applicable law, and to the extent
that the Work includes material subject to copyright, Consultant hereby assigns to City, its
successors and assigns, all right, title and interest in and to the Work. Consultant shall execute
and deliver such instruments and take such other action as may be required and requested by City
to carry out the assignment made pursuant to this section. Any documents, magnetically or other
materials created by Consultant pursuant to this Agreement shall be owned by City and subject
to the terms of this sub -section. To the maximum extent permitted by law, Consultant waives all
moral rights in the Work. The rights granted hereby to City shall survive the expiration or
termination of this Agreement.
VI. Termination.
A. Termination Upon the City's Option. The City shall have the option to terminate this
Agreement at any time with or without cause. Termination shall be effective after thirty (30)
days upon delivery of written notice to the Consultant, except as provided for in
subparagraph V.0 below.
B. Termination Upon the Consultant's Option. The Consultant shall have the option to terminate
this Agreement after thirty (30) days upon delivery of written notice to the City.
C. Termination for Cause. If Consultant refuses or fails to complete the tasks described in
Exhibit A, or to complete such work in a manner satisfactory to the City, then the City may,
by written notice to Consultant, give notice of its intention to terminate this Agreement.
After such notice, Consultant shall have ten (10) days to cure, to the satisfaction of the City
or its representative. If Consultant fails to cure to the satisfaction of the City, the City shall
send Consultant a written termination letter which shall be effective upon deposit in the
United States mail to Consultant's address as stated below.

D. Rights upon Termination. In the event of termination, the City shall only be responsible to
pay for all services satisfactorily performed by Consultant to the effective date of
termination, as described in the final invoice to the City. The City Manager shall make the
final determination about what services have been satisfactorily performed which decision
shall be final, binding and conclusive.
V. Discrimination. In the hiring of employees for the performance of work under this
Agreement or any subcontract hereunder, Consultant, its subcontractors or any person acting on
behalf of Consultant shall not, by reason of race, religion, color, sex, national origin or the
presence of any sensory, mental, or physical handicap discriminate against any person who is
qualified and available to perform the work to which the employment relates.
VI. Indemnification. Consultant hereby releases, covenants not to bring suit and agrees to
indemnify, defend and hold harmless the City, its officers, officials, employees, agents and
representatives from any and all claims, costs, judgments, losses or suits including attorneys'
fees, awards or liabilities to any person, including claims by Consultant's own employees to
which Consultant might otherwise be immune under Title 51 RCW, to the extent arising out of
the Consultant's negligent performance of this Agreement, except for injuries and damages
caused by the sole negligence of the City.
In the event of liability for any reason described above which is caused by or results from the
concurrent negligence of the Consultant (and his employees, agents and representatives) and the
City (and its officers, officials, employees, agents or representatives), each party's liability shall
only be to the extent of its negligence. Such indemnification obligations shall extend to claims
which are not reduced to a suit and any claims which may be compromised prior to the
culmination of any litigation or the institution of any litigation.
The City's inspection or acceptance of any of Consultant's work when completed shall not be
grounds to avoid any of these covenants of indemnification. It is further specifically and
expressly understood that the indemnification provided herein constitutes Consultant's waiver of
immunity under Title 51 RCW, solely for the purposes of indemnification. This waiver has been
mutually negotiated by the parties.
VII. Insurance.
A. The Consultant shall procure and maintain for the duration of the Agreement, insurance
against claims for injuries to persons or damage to property which may arise from or in
connection with the performance of the work hereunder by the Consultant, its agents,
representatives, or employees.
B. No Limitation. Consultant's maintenance of insurance as required by the agreement shall not
be construed to limit the liability of the Consultant to the coverage provided by such
insurance, or otherwise limit the City's recourse to any remedy available at law or in equity.
C. Minimum Scope of Insurance. Consultant shall obtain insurance of the types described
below:
1. Automobile Liability insurance covering all owned, non -owned, hired and leased
vehicles. Coverage shall be written on Insurance Services Office (ISO) form CA 00

O1 or a substitute form providing equivalent liability coverage. If necessary, the
policy shall be endorsed to provide contractual liability coverage.
2. Commercial General Liability insurance shall be written on ISO occurrence form CG
00 01 and shall cover liability arising from premises, operations, independent
contractors and personal injury and advertising injury. The City shall be named as an
insured under the Consultant's Commercial General Liability insurance policy with
respect to the work performed for the City.
3. Workers' Compensation coverage as required by the Industrial Insurance laws of the
State of Washington.
4. Professional Liability insurance appropriate to the Consultant's profession.
D. Minimum Amounts of Insurance. Consultant shall maintain the following insurance limits:
Automobile Liability insurance with a minimum combined single limit for bodily
injury and property damage of $1,000,000 per accident.
2. Commercial General Liability insurance shall be written with limits no less than
$1,000,000 each occurrence, $2,000,000 general aggregate.
3. Professional Liability insurance shall be written with limits no less than $1,000,000
per claim and $1,000,000 policy aggregate limit.
E. Other Insurance Provisions. The insurance policies are to contain, or be endorsed to contain,
the following provisions for Automobile Liability, Professional Liability and Commercial
General Liability insurance:
1. The Consultant's insurance coverage shall be primary insurance as respect the City.
Any insurance, self-insurance, or insurance pool coverage maintained by the City
shall be excess of the Consultant's insurance and shall not contribute with it.
2. The Consultant's insurance shall be endorsed to state that coverage shall not be
cancelled by either party, except after thirty (30) days prior written notice by certified
mail, return receipt requested, has been given to the City.
F. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M. Best
rating of not less than A: VII.
G. Verification of Coverage. Consultant shall furnish the City with original certificates and a
copy of the amendatory endorsements, including but not necessarily limited to the additional
insured endorsement, evidencing the insurance requirements of the Consultant before
commencement of the work.
IX. Modification. No waiver, alteration or modification of any of the provisions of this
Agreement shall be binding unless in writing and signed by a duly authorized representative of
the City and Consultant.
X. Assignment. Any assignment of this Agreement by Consultant without the written
consent of the City shall be void.

XII. Non -Waiver of Breach. The failure of the City to insist upon strict performance of any
of the covenants and agreements contained herein, or to exercise any option herein conferred in
one or more instances shall not be construed to be a waiver or relinquishment of said covenants,
agreements or options, and the same shall be and remain in full force and effect.
XIII. Resolution of Disputes, Governing Law. Should any dispute, misunderstanding or
conflict arise as to the terms and conditions contained in this Agreement, the matter shall be
referred to the City Manager, whose decision shall be final. Any appeal from the decision of the
City Manager shall be to King County superior court. In the event of any litigation arising out of
this Agreement, the prevailing party shall be reimbursed for its reasonable attorney fees from the
other party. This Agreement shall be governed by and construed in accordance with the laws of
the State of Washington.

the budget set forth in Exhibit B for the City of Medina Shoreline Master Program (SMP)
Update. The scope of work is consistent with the Washington State Department of Ecology
(Ecology) standard scope of work and the level of effort appropriate o the City of Medina. This
scope of work recognizes that AHBL Inc. will be partner in the City's SMP update, and will
coordinate as needed.
The Watershed Company's goal will be to create useful products that meet Ecology's
requirements, maximize use of existing information and the current SMP and critical areas
regulations (where consistent with 2003 Shoreline Master Program Guidelines), and reflect
property owner and citizen input.
Phase A: Ongoing Communications & Coordination
1. The Watershed Company will coordinate throughout the SMP update process
with Ecology, and other agencies, such as adjacent jurisdictions engaged in similar SMP update
tasks or other appropriate entities that may have useful scientific, technical, or cultural
information, including federal agencies, salmon recovery lead entities, universities and other
institutions, individual outdoor recreators and conservationists, and organizations with special
expertise representing these interests.
2. The Watershed Company will coordinate work of The Watershed Company's
staff, ensuring that Tasks are completed on time and on budget, and that the City is continuously
updated on progress.
3. The Watershed Company will provide the City with monthly progress reports, and
develop and update the project schedule on a regular basis.
4. Deliverables shall include monthly progress reports and schedule updates.

Phase 1: Preliminary Assessment and Public Participation Plan
1. The Watershed Company will collect relevant and available GIS layers from the
City, King County, Ecology and other state or federal agencies or entities to be used in our
preliminary determination of shoreline jurisdiction. As available, layers that support the
jurisdiction assessment include the current Lake Washington shoreline boundary, topography,
wetlands, and aerial photographs.
2. The Watershed Company will compile the layers and prepare possible shoreline
boundary layers in GIS, including minimum jurisdiction and possible extension of jurisdiction to
wetland buffers.
3. The Watershed Company will prepare a memorandum to the City summarizing
the methodology and rationale for the selected shoreline boundary, and Ecology will be asked to
review and provide feedback on the revised boundary and memo prior to commencement of the
Shoreline Inventory to ensure agreement in the overall approach and methodology.
4. The Watershed Company anticipates participation in public participation events
or meetings as requested by the City, either planning commission or City Council meetings,
workshops, or open houses, to the extent allowed by the budget.
5. Deliverables will include a memorandum summarizing the methods and rationale
for the selected jurisdiction boundary and alternative shoreline jurisdiction maps.
Phase 2: Shoreline Inventory, Analysis & Characterization
1. The Watershed Company will conduct a shoreline inventory consistent with
topics in WAC 173-26-201(3)(c). The Watershed Company will maximize use of the existing,
available information such as King County GIS; City maps; WRIA 8 maps, reports and data;
City's Comprehensive Plan; local critical areas studies, etc. Additional field work, however, to
produce a comprehensive data layer of shoreline hardening is suggested and included in this
scope of work.
2. The Watershed Company will develop a draft list of information sources, sorted
by topic, which will inform mapping and characterization of the City's shorelines. Ecology and
the City will be asked to review and contribute to a list of known data sources.
3. The Watershed Company will create a GIS map folio that will compile all
available data sources into a coherent, consistent map folio that meets Ecology's criteria for
illustration and presentation of information.
4. Using the products from the Shoreline Inventory, The Watershed Company will
prepare an analysis report that characterizes ecosystem -wide processes and ecological functions
for all areas of shoreline jurisdiction as outlined in WAC 173-26-201(3)(d).

• The ecosystem -wide characterization will include a coarse -scale analysis of the
broader area that influences the shoreline jurisdiction, including areas that are
impaired, that should be preserved, and that can be restored. It will include a
narrative with reference to maps that describes and illustrates the processes in the
larger drainage area that are linked to the shoreline through hydrologic flows. These
processes include the uptake, transport and deposition of sediment, nutrients, woody
debris, and pollutants.
• The Watershed Company will develop a characterization of shoreline functions by
reach. In general, the following is anticipated: (1) Set the waterbody into the context
of the watershed or basins; (2) Separate the jurisdictional shoreline into appropriate
reaches at major changes in geomorphology (generally as observable using
topography and surficial geology mapping), land use, and biological character
(generally as observable from aerial photography and vegetation mapping); (3)
Evaluate and assess shoreline ecological function using current scientific
understanding of the relationship between the conditions of ecosystem -wide
processes and functions within shoreline jurisdiction. Identify functions that are
healthy, functions that are adversely impacted and functions that may have existed
and are now missing.
5. The Watershed Company will prepare a shoreline inventory and characterization
report including maps that present inventory data, ecosystem characterization and shoreline
functions, and shoreline use and public access findings (contributed by the City or others). The
report will also provide preliminary options and recommendations for the SMP goals, policies,
and regulations.
6. Deliverables shall include a draft list of information sources and inventory map
folio — working draft. Additionally, deliverables shall include a preliminary, draft, and final
Shoreline Characterization and Analysis Report.
Phase 3: Shoreline Policy, Environment Designation, and Regulation Development
1. The Watershed Company will assist in preparing general use policies, regulations,
and standards, consistent with WAC 173-26-221 andl73-26-251. The Watershed Company
would share this task with the City or others. Topics anticipated to be addressed by The
Watershed Company include:
• critical areas,
• flood hazard reduction (if relevant),
• shoreline vegetation conservation, and
• water quality, storm water, and non -point pollution.
2. The Watershed Company will prepare specific use policies, regulations, and
standards for selected sections of the SMP, generally those shoreline modifications and uses that
take place primarily at or waterward of ordinary high water. Those topics are anticipated to
include:
• Shoreline stabilization;
• Piers and docks;

• Fill;
• Breakwaters, jetties, groins, and weirs;
• Dredging and dredge material disposal;
• Shoreline habitat and natural systems enhancement projects;
• Boating facilities; and
• In -stream structural uses (if relevant).
Goals, policies and regulations for these topics would be prepared consistent with WAC 173-26-
231 and 241, and the use priorities for shorelines of statewide significance consistent with WAC
173-26-251.
3. The Watershed Company will support development of the cumulative impacts
analysis by others, focusing on the changes to shoreline functions/processes that could occur as a
result of that development and any affiliated mitigation under the new SMP, and discussing how
other local or regional programs/activities (as outlined in the SMP restoration plan) could impact
shoreline functions/processes.
4. Deliverables will include contributions to the preliminary cumulative impacts
analysis.
Phase 4: Restoration Planning: Revisiting Phase 3 Products and Analysis
1. The Watershed Company will develop a plan for restoration of impaired
ecological functions in specific shoreline reaches based on the Inventory and Characterization
report, and utilizing information provided in the WRIA 8 reports (e.g., Lake Washington/Cedar
Sammamish Watershed (WRIA 8) Chinook Salmon Conservation Plan, 2005). The Restoration
Plan will identify programs, projects, priorities, goals, and monitoring and evaluation strategies.
The City is expected to provide The Watershed Company with information about existing
restoration efforts, beyond those outlined in existing watershed or sub -basin plans.
2. Others will re-evaluate and adjust the draft SMP and cumulative impacts analysis.
The Watershed Company will finalize relevant maps.
3. Deliverables will include revised designations, policies, and regulations that
address the findings of the cumulative impacts analysis, revised cumulative impacts analysis and
final SMP jurisdiction maps.
Phase 5: Local SMP Adoption Process
1. The Watershed Company will peer review the City's programmatic SEPA (SEPA
Checklist and DNS anticipated) on the proposed SMP. The City will prepare the notice of intent
to adopt to the State agencies.
2. The Watershed Company will prepare for and attend one public hearing.
C. The Consultant shall report to and work under the general supervision of the Director of
Development Services, or a person designated by the City Manager.

D. The Consultant shall neither subcontract any of the work, nor assign any rights acquired
hereunder, without obtaining prior written approval from the City.
E. The City shall have access to all books, documents, papers and records of Consultant that
are pertinent to this Agreement for the purpose of making audit, examination, excerpts and
transcripts.
F. All work products produced by Consultant under this Agreement, such as reports, plans,
specifications, data maps and documents, shall be the property of the City. Consultant will not
be held liable for the re -use or modification of work products by the City for any other project
without the express written permission of the consultant.
G. Payment:
1. The City agrees to pay the Consultant on a time and materials basis for services
performed in accordance with the following staff positions and hourly billing rates and subject to
the budget set forth in Exhibit B:

BACKGROUND/SUMMARY:
The SR 520 Medina to SR 202, Eastside Transit and HOV Project Design/Build Contractor, Eastside
Corridor Constructors (ECC), is ready to begin the construction of the Evergreen Point Roadway lid.
Exhibit "A" attached, shows the present WSDOT right-of-way and the location of the new bridge
structure abutment footing relative to the Fairweather Park playfield and tennis courts. The excavation
for the bridge footing of over 30 feet below the present grade will require a temporary shoring wall
along the WSDOT right-of-way line with subterranean soil nail tiebacks extending from 30 to 40 feet
north of the right-of-way limit under the park to support the cut slope. This work was anticipated during
the initial environmental assessment process and was determined to have a "de minimis" impact on the
park that was agreed to by the City Council in April of 2010.
To complete the excavation, a series of lifts will be excavated and the shoring wall installed in succession
as the depth increases. The temporary shoring wall tieback rods as proposed will extend underground
along the south edge of the playfield and the existing tennis courts in Fairweather Park. Following the
pouring of the footing and abutment wall, the temporary shoring wall material will be removed with the
tieback rods abandoned in place as the area is backfilled. That portion of the Park to be impacted by
subterranean tiebacks is shown hatched on the referenced plan (6,500 SF).
Also shown on Exhibit "A" is a cross hatched portion of the southwest corner of the park needed for
maintaining temporary pedestrian access to the Freeway Transit Flyer -Stop, and an area needed for the
construction of the temporary detour roadway across the completed east portion of the new Evergreen
Point Road lid structure while the existing bridge is demolished and the west portion of the lid is
constructed (shown as Temporary ROW Use 2,645 SF).
All of the temporary easement areas will be restored and new landscaping installed commensurate with
the final Evergreen Point Road lid hardscape and landscaping completion. ECC proposes to compensate
the City for the easement area at a rate of $1.03 per SF based on the negotiated rate to be paid to the
Bellevue School District for a smaller area they need on the south side of the new lid.
