RE: Request for a Proclamation for Recovery Month September 2011
Dear Mr. Mayor:
I am writing today to request your assistance in securing a proclamation from the City of Medina
in declaring the month of September 2011 Recovery Month: Prevention Works, Treatment is
Effective. People Recover.
The purpose of Recovery Month is to promote access to recovery, celebrate those in treatment,
and continue to educate our communities about how to overcome the barriers of stigma and
discrimination. When a local government endorses Recovery Month, more people in their
community are educated about the conditions of substance use disorders and mental disorders as
well as the benefits that treatment and recovery support services have on our local communities
and society. In addition, Recovery Month spreads the message that behavioral health is essential
to health and overall wellness, and that prevention works, treatment is effective, and people with
substance use and mental disorders can and do recover.
Throughout the years, hundreds of proclamations have been signed to support Recovery Month,
including 176 issued in communities across the country in 2010. The President of the United
States has signed a proclamation declaring September as Recovery Month for the past ten years,
further recognizing substance use disorders and mental disorders as conditions that need to be
addressed, just like any other illness. In 2010, the Governor of the State of Washington, the City
of Kirkland, and the City of Edmonds each signed proclamations declaring September National
Recovery Month. Our goal is that every city in King County celebrate the lives reclaimed and
proclaim September 2011 Recovery Month.
Now in its 22nd year, Recovery Month highlights individuals who have reclaimed their lives and
are living healthy lives in long-term recovery, and also honors the treatment and recovery service
providers who assist the individuals and families with recovery. King County provides resources
to several service providers who provide substance abuse and mental health services including

Youth Eastside Services. Recovery Month promotes the message that recovery in all its forms is
possible and also encourages citizens and communities to take action to help expand, improve
and support the availability of effective recovery services.
Each September, thousands of treatment and recovery programs and services around the country
celebrate the recovery successes and share them with their neighbors, friends, and colleagues in
an effort to educate the public about recovery, how it works, for whom, and why. There are
millions of Americans whose lives have been transformed through recovery. These successes
often go unnoticed by the broader population, therefore Recovery Month provides a vehicle to
acknowledge and celebrate these accomplishments.
I have included a link here for you to review sample proclamations that have been issued and
included a link to the National Recovery Month website for further information. I am available
to present additional information or testimony if that would be helpful.

PROCLAMATION
WHEREAS, behavioral health is an essential part of health and one's overall wellness, and
prevention works, treatment is effective, and people can and do recover from substance use
and mental disorders; and
WHEREAS, all people have the fundamental and inherent value to be accepted and treated
with respect, human dignity, and worth; and
WHEREAS, individuals should have access to fully participate in community life including
economic advancement and prosperity; fair and decent housing; quality education; positive
opportunities to benefit from and contribute to material, cultural, and social progress; and
WHEREAS, it is critical to educate our policymakers, friends and family members, health care
providers, and businesses that substance use and mental disorders are treatable, and that
people should seek assistance for these conditions, with the same urgency as they would any
other health condition; and
WHEREAS, all Americans have the opportunity to access provisions within the Affordable Care
Act and Mental Health Parity and Addictions Equity Act (MHPAEA), aimed to improve physical
and emotional health while ensuring people will receive the care they need at a more
reasonable cost; and
WHEREAS, substance use and mental disorders are serious public health problems. In 2009,
4.3 million people received treatment for a substance use disorder and 30.2 million people for a
mental health problem (2009 National Survey on Drug Use and Health), we must continue to
reach the millions more who need help; and
WHEREAS, to help more people achieve long-term recovery, and learn how recovery positively
benefits the Nation's overall well-being, the U.S. Department of Health and Human Services
(HHS), the Substance Abuse and Mental Health Services Administration (SAMHSA), the White
House Office of National Drug Control Policy (ONDCP), and the City of Medina invite all
residents of Medina to participate in National Recovery Month: Prevention Works,
Treatment is Effective, People Recover (Recovery Month); and
NOW, THEREFORE, the Medina City Council, by virtue of the authority vested in the laws of
Medina, Washington, do hereby proclaim the month of September 2011 as National Recovery
Month: Prevention Works, Treatment is Effective, People Recover in the City of Medina and
call upon the people of the City of Medina to observe this month with appropriate programs,
activities, and ceremonies supporting this year's theme, "Join the Voices for Recovery. -
Recovery Benefits Everyone. "

Subject: City Manager Report
1. City Hall is very close to being completely wrapped up. We only have a few
contractors coming and going each week. Our hope is to have a final report and
budget amendment in October. Dave Clark will provide an update during staff
reports. The only real visible change will be to try and make the main floor office
work stations more functional and customer friendly by reconfiguring two of the
work areas. The office staff will most likely be in the same locations, but with a
better orientation to the counter area.
2. The background investigation for the Police Chief finalist is scheduled to be
complete the week of the 12'h. To date, as you would expect, there were no
surprises in the background information with the caliber of final candidates, but,
Public Safety Testing is still working on the final screening. When I have all the
information, I will be reviewing that with Garry Anderson and will let you know
when I have enough information for a final decision.
3. Joe Willis is out of the office until September 191h. I did not have an opportunity to
discuss the work on Lake Washington Blvd. with him before he left, but his e-mail
said that the contractor was waiting on the electrical installment. Joe asked
Transpo to oversee the construction work while he was away. I talked with Jon
Pascal with Transpo on Tuesday and told him to get the contractor to take care of
any safety concerns with the construction site and to get the work moving. Jon
and Pat Crickmore and I will be working with Bellevue utilities to get the project
moving as soon as possible.
4. We received a request for the lighting at City Hall to be reduced. The specs show
each exterior light has two 26 watt QE fluorescent light bulbs for a total of 52
watts. It sounds like they are producing too much light for such a small wattage.
The simplest thing to do will be to remove one of the two bulbs to make the output
26 total watts. If that becomes too dim, we can make other changes.
5. Linda Crum has provided the following summary of the 2011 Lifeguard Medina
Beach season. There were six lifeguards, with four returning from last season.
Three Guards were on duty each day, and worked a total of 656 hours for the
nine -week season. Approximately 100 patrons visited Medina Beach each day,
which is less than previous years. As of August, approximately $22,000 was
expended, which is well within budget. This season an added enhancement to
the Lifeguard Program was testing the water quality to assure the safety of the
swimmers. It proved to be valuable information when a resident reported that his
daughter came home suddenly ill and thought it could be from swimming at
Medina Beach.

Communication/Outreach
Between August 4 and September 6, 26 notices were issued via GovDelivery. A detailed report is
attached.
Currently e-notices have the potential to reach 1,376 individual subscriber profiles with a total of
10,189 subscriptions. There were 92 new and 28 deleted individual subscription profiles since
September 6.
To date the City has issued 11 postcards, including: seven council, one park board, two shoreline, and
one communication tower.

Public Records Requests
Approximately 196 public records requests have been received by the city clerk's office between
January 1 and September 6. During the same period last year 101 requests had been received out
of a total of 146 for the year.
Passports
A total of 213 passport applications have been processed by department staff during 2011, an
increase of 25 since last month's report. A total of 256 were processed during the same period in
2010.
WCIA Audit
The city manager, finance director and city clerk met with a WCIA representative on September 2
for the annual review. As a result of this meeting, it was learned the City met all performance
recommendations established by the 2010 personnel audit conducted by WCIA last year and
satisfied all standards outlined as a part of the 2011 WCIA audit portion focused on the Public
Records Act.

Planning Commission Meeting Recap:
The Planning Commission held two quasi-judicial public hearings on project -permit
applications. The first hearing was for a site plan review to demolish an existing 845 square
foot pool house and construct a 2,538 square foot accessory structure to contain a pool
cabana, exercise room, three car garage and storage room. The address is 2047 Evergreen
Point Road. The applicant is Legacy Trust. The Planning Commission approved the
application subject to conditions.
The second hearing was for a Level 2 Construction Mitigation Plan to perform an interior
remodel of the existing residence including structural, mechanical, plumbing, electrical, and fire
protection work. The address is 111 841h Avenue N.E. The applicant is Charles Simonyi. After
some discussion about school bus stop times, the Planning Commission approved the
application subject to conditions.
Discussion continued on the Shoreline Master Program update. A revised discussion draft of
the shoreline regulations was presented that included the shoreline advisory committee's
recommendation on shoreline setbacks. Several members of the public commented. Charlie
Kling, representing "Medina Now", provided comments on a variety of items. He pledged to
provide to staff before the next meeting with some suggested revisions. The shoreline advisory
committee is expected to conclude their work within the next couple of weeks and a complete
discussion draft document of the shoreline regulations is anticipated to be presented at the
next meeting.
Finally, the Planning Commission discussed revising their meeting schedule through the end of
the year due to scheduling conflicts and holidays. The dates tentatively agreed upon include
Wednesday, September 28; Wednesday, October 26; Monday, November 28; and
Wednesday, December 28.

Other Items of Interest:
Shoreline Master Program Update: A public meeting with the shoreline advisory committee
was held August 17 to discuss shoreline setbacks. There was a large turn -out of residents with
concerns about the setbacks. Staff made a presentation walking everyone through the thought
process and possible setback alternatives. Much of the meeting was spent asking and
answering questions. At the conclusion of the meeting, the committee made a
recommendation that was forwarded to the Planning Commission for consideration at their
August meeting.

It is anticipated that a complete discussion draft of the shoreline regulations will be ready by the
next Planning Commission meeting. Once the Planning Commission completes its review of
the discussion draft, an open house will be held to answer questions from the public and to
gather additional comments. A final draft SMP document will be prepared for public hearing
after which the Planning Commission will formulate its recommendation to be forwarded to the
City Council
SR 520 Shoreline Permits: The Washington State Department of Transportation submitted its
shoreline permit applications for construction of the SR 520 bridge replacement, the east
approach, the bridge maintenance facility, and a dock for maintenance vessels. The project
will require two shoreline conditional use permits, which require Ecology's final approval, and
two substantial development permits.
It's worth noting that the bridge and maintenance facilities are designated essential public
facilities. This means the City cannot deny permits that allow for these projects to move
forward, but we can require reasonable conditions to mitigate impacts. When the contractor for
the project is fully onboard, WSDOT has indicated that there will be additional permits
submitted including a noise variance for the project and building permits, construction
mitigation plan and tree removal permit for the maintenance facility.
Puget Sound Energy Tree Trimming: Puget Sound Energy has submitted an application to
perform tree trimming maintenance in the public rights -of -way around its utility facilities. A
large mailing notice was sent to homes in Medina informing them of the activity. Tom Early,
the City tree consultant, has received a large volume of calls from residents mostly interested
in information about the tree trimming, or asking for trees to be removed. The hearing is
scheduled for Wednesday, September 21, 2011, before the hearing examiner.
FCC Comments on Wireless: Earlier this year the Federal Communication Commission issued
a Notice of Inquiry to address government policies for obtaining access to rights -of -way and
wireless facility placement. More specifically, they were seeking input on expanding the reach
and reducing the costs of deploying broadband. PCIA, representing wireless interests,
submitted comments identifying Medina (as well as dozens of other local governments) as
using consultants who were a source of barriers and prohibitive costs associated with
deployment of wireless facilities. Generally, the FCC will accept comments as fact if they go
unchallenged. The risk to local government of not responding is that the FCC may rely on
these comments to issue new rules that could preempt local zoning authority about wireless
facility placement. Staff is working with the City attorney to formulate a response, which is due
by September 30.
Request for Qualifications: The City is tentatively scheduling interviews the last week of
September to select a consultant(s) to perform engineering, construction mitigation planning,
and geotechnical review services. The panel conducting the interviews will include me, Joe,
and Craig Olson (Clyde Hill Public Works Director).
Fairweather Wireless Lease: Daniel Schweigard has been working with staff to complete the
lease agreement with Independent Towers for use of Fairweather Park for a wireless
communication facility. The lease agreement will include allowances for location of a
temporary tower during SR 520 construction and the permanent location once SR 520
construction is completed. Once the lease is finalized, Independent Towers has indicated they
will seek to obtain a temporary use permit to erect facilities while the non -administrative special
use permit process is taking place.

Medina officer responded to a report of damage to a security gate that occurred over the
weekend. The officer examined the gate and concluded the gate was hit by a vehicle.

Medina resident reported between 07/31/11 and 08/12/11, person(s) unknown stole a

E-lert #11-23
Between 9:30PM 8/29/11 and 9:30AM 8/30/11, a vehicle was stolen from the 8300 block
of Hunts Point Circle. The vehicle had been locked and left in the driveway. The keys
for the stolen vehicle were acquired from another vehicle parked in the driveway. The
second vehicle was locked but a window was not all the way up. Two pair of sun glasses
valued at approximately $250 were also taken from the second vehicle. As of the time of
the release of this E-lert the vehicle has not been recovered.
MISDEMIANOR CRIMES
No significant misdemeanor incidents occurred during the month of August.

SPECIAL MEETING
The August 8, 2011 Special Meeting of the Medina City Council was noticed pursuant to
RCW 42.30.080. The Special Meeting began at 5:00 pm and concluded at 6:30 pm. The
meeting agenda included: 1. Community Meet and Greet: Police Chief Candidate Finalists,
and 2. Medina City Hall Open House.
CALL TO ORDER
Mayor Bret Jordan called the August 8, 2011 Regular Meeting of the Medina City Council
to order at 6:35 pm.
ROLL CALL
Council Members Present: Patrick Boyd, Doug Dicharry, Bret Jordan, Katie Phelps,
Janie Lee, Mark Nelson, and Shawn Whitney
City Staff Present: Donna Hanson, City Manager; Bruce Disend, City Attorney,
Kenyon Disend; Dan Yourkoski, Acting Police Chief; Robert
Grumbach, Development Services Director; Joe Willis, Public
Works Director; Nancy, Adams, Finance Director; and Rachel
Baker, City Clerk
Mayor led members of the audience, council members, and City staff in the Pledge of
Allegiance.
APPROVAL OF MEETING AGENDA
Council member Whitney requested postponement of approval of the July Check Register
until September 12 because the finance committee has not yet reviewed the report.
MOTION BOYD AND SECOND NELSON TO ADOPT AGENDA AS AMENDED AND
MOTION CARRIED 7-0 AT 6:37 PM.
PRESENTATION
Medina City Hall construction manager Dave Clark presented the City with a plaque to
memorialize completion of the project. Mayor thanked Mr. Clark for his efforts and the
public and staff for flexibility and patience during construction of the project.

Mayor read guidelines concerning public comment period and opened floor to public
comments at 6:41 pm.
Medina resident Wilma Edmonds spoke on behalf of her neighbors on Northeast 24 Street
and thanked public works director and city manager for interfacing with WSDOT
concerning construction parking violations associated with the SR 520 project and thanked
the city manager for communicating with Allied Waste regarding recent pick up schedule
changes.
Mayor closed public comment period at 6:43 pm.
REPORTS AND ANNOUNCEMENTS
Mayor reported he requested Hunts Point mayor send Medina City Council members a
copy of the Transpo traffic study results for use of roundabout on 84 Avenue Northeast
and announced addition of a ten-minute comment period at end of agenda.
Mayor read proclamation presented to St. Thomas Episcopal Church and St. Thomas
School.
Council member Phelps promoted Medina Days, conveying it begins tomorrow night with
the concert in the park and events continue through Saturday night. Council member Lee
voiced donations are still needed.
Development services director announced notice of application for Puget Sound Energy
tree trimming permit will be mailed this week to approximately 1,000 parcels and
responded to council member Boyd's questions regarding SR 520 nighttime noise
threshold. In response to council member Phelps, city manager responded City is
investigating resources to assist with uptick in public records requests and city clerk
confirmed number of Govdelivery subscription profiles questioned by council member Lee.

2012 Annual Budget Preparation (6:54 pm)
Finance director provided brief overview of revenues, expenditures, and city council and
finance department strategic goals.
Mayor opened public hearing at 7:04 pm.
Medina resident Miles Adam expressed his concerns related to the 2011 Budget,
specifically implementation of utility taxes and franchise fees and moving money out of
reserve fund expressing neither needed to be done and hoped the council would
reconsider actions before repeating in 2012. Mr. Adam requested council retain funding in
2012 Budget to extend installation of public safety cameras to all City entrances.
Resident Mark Parry requested council consider financial provisions for cameras near SR
520 to capture foot and public transportation traffic near park and ride area. Mr. Parry also
requested funding to enhance Fairweather Park in order to blend future lid with the park.
Resident urged council to prioritize funding allocations for expenses, such as low income
housing versus capital projects. He thanked council and staff for completion of city hall
project.

OTHER BUSINESS
Approval of Points Loop Trail De Minimus Agreement (7.11 pm)
Public works director summarized proposal and responded to questions concerning trail
maintenance, trail placement, new sidewalk location, and public notification process.
MOTION PHELPS AND SECOND BOYD TO APPROVE CONCURRENCY
REQUEST FOR A DE MINIMIS IMPACT TO RELOCATE THE POINTS LOOP
TRAIL TO THE SOUTH SIDE OF SR 520 AND NE 28TH STREET AND
AUTHORIZE MAYOR/CITY MANAGER TO SIGN THE CONCURRENCY

SPECIAL MEETING
The August 16, 2011 Special Meeting of the Medina City Council was noticed pursuant to
RCW 42.30.080.
CALL TO ORDER
Mayor Bret Jordan called the August 16, 2011 Special Meeting of the Medina City Council
to order at 5:37 pm.
ROLL CALL
Council Members Present: Patrick Boyd, Doug Dicharry, Bret Jordan, Katie Phelps,
Janie Lee, Mark Nelson, and Shawn Whitney
City Staff Present: Donna Hanson, City Manager; Bruce Disend, City Attorney,
Kenyon Disend; and Rachel Baker, City Clerk
EXECUTIVE SESSION
The City Council recessed into Executive Session at 5:39 pm pursuant to RCW 42.30.110
(1)(i) to discuss with legal counsel representing the agency litigation or potential litigation
to which the agency, the governing body, or a member acting in an official capacity is, or is
likely to become, a party; and pursuant to RCW 42.30.110 (1)(f) to evaluate the
performance of a public officer or employee. Mayor estimated Executive Session would
require approximately ten to fifteen minutes.
City council members Patrick Boyd, Doug Dicharry, Bret Jordan, Janie Lee, Mark Nelson,
Katie Phelps, and Shawn Whitney; city manager; and city attorney Bruce Disend, Kenyon
Disend, PLLC were present. Executive Session attendees met in a conference room while
the public remained in the council chambers. Council member Whitney excused herself
voluntarily from Executive Session and returned to the council chambers at 5:40 pm.
Executive Session adjourned and the Special Meeting reconvened at 5:51 pm.
SPECIAL MEETING
Mayor announced the council would publicly evaluate the performance of a public officer
or employee and recounted rules governing special meetings.

FROM COUNCIL MEMBER WHITNEY. MOTION CARRIED 5-2 (LEE AND WHITNEY
OPPOSED) AT 5:59 PM.
MOTION BOYD AND SECOND NELSON FOR REPEATEDLY DISREGARDING
COUNCIL GROUND RULES AND GUIDELINES, AND FOR IGNORING THE COUNCIL
AND CITY LEGAL STAFF AND PUTTING PERSONAL INTERESTS AHEAD OF BEST
INTERESTS OF THE CITY, A MOTION TO CENSURE COUNCIL MEMBER WHITNEY.
MOTION CARRIED 5-2 LEE AND WHITNEY OPPOSED AT 6:07 PM
Mayor noted a resolution for censure will be presented to council for review and adoption
September 12.
MOTION NELSON AND SECOND BOYD TO ABOLISH FINANCE COMMITTEE.
MOTION CARRIED 5-2 (LEE AND WHITNEY OPPOSED) AT 6:15 PM.

Revenue:
Key Items for 2011 Revenue include:
• Property Taxes of $1.3M YTD 2011 are $70K higher than YTD 2010.
• Sales Taxes are $50K higher for YTD 2011 compared to 2010.
• Utility Tax & Franchise Fee Revenue is $154K as of July 30th. Major Payments will be
made in April, July, October and January. (Payments are received one month after the end
of the Quarter.) $154K represents 2 Quarters of 2011 Revenue. The 4th Quarter payment
will be made in January 2012.
• Licenses/Permits are $71 K higher for YTD 2011 compared to 2010.
• Intergovernmental Revenue: We have received 2 Quarters of Payments from Hunts Point
for Police Contracted Services. 2011 Billing will be ($27K) lower than Budget due to credits
for Actual Expenditures for 2010.
• Planning & Development Revenue is $141 K YTD 2011 compared to $74K for YTD 2010.
• Fines, Traffic Infractions: Kirkland Municipal Court has only paid us for 5 months of the year
due to a clerical error which they have fixed. Once they pay us, we will most likely still trend
low in this line item by @ ($30K) for the year.
• REET (Real Estate Excise Tax) Revenue is at $696K YTD 2011 compared to $182K for
YTD 2010.
Total Revenue (for all funds) is $827K higher for YTD 2011 than YTD 2010. We are on target to
meet our 2011 Revenue Projections. Hunts Point ($27K) and Kirkland Court ($30K) are the only
projected unfavorable variances at this time.
Expense:
Key items for 2011 Expense include:
• General Fund Expenditures were ($96K) lower for YTD 2011 than YTD 2010.
City Hall Project:
City Hall Expenditures for July 2011 YTD are: $1.7M
City Hall Expenditures for 2010 were: $496K

The August 2011 Financial Reports include:
• August 2011 Revenue & Expense Summary
• August 2011 AP Register Activity Detail
Revenue:
Key Items for 2011 Revenue include:
• Property Taxes of $1.3M YTD 2011 are $72K higher than YTD 2010.
• Sales Taxes are $299K higher for YTD 2011 compared to 2010. We received $323K for Sales
Tax for the month of August.
• Utility Tax & Franchise Fee Revenue is $169K as of August 31st. Major Payments will be made
in April, July, October and January. (Payments are received one month after the end of the
Quarter.) $169K represents 2 Quarters of 2011 Revenue, The 41h Quarter payment will be
made in January 2012.
• Licenses/Permits are $84K higher for YTD 2011 compared to 2010.
• Intergovernmental Revenue: We have received 2 Quarters of Payments from Hunts Point for
Police Contracted Services. Shoreline Master Program Grant Revenue was budgeted to be less
in 2011 than in 2010.
• Planning & Development Revenue is $71 K higher for YTD 2011 compared to 2010.
• REET (Real Estate Excise Tax) Revenue is at $762K YTD 2011 compared to $251 K for YTD
2010.
• Other Revenue: We received $49K from WA DOT (unbudgeted-one time revenue) for a sale of
Right of Way Parcel on Upland Road.
Total Revenue (for all funds) is $1.068M higher for YTD 2011 than YTD 2010. We are on target to
meet our 2011 Revenue Projections. Hunts Point ($27K) and Kirkland Court ($30K) are the only
projected unfavorable variances at this time.
Expense:
Key items for 2011 Expense include:
• General Fund Expenditures were ($163K) lower for YTD 2011 than YTD 2010.

The Planning Commission meeting of July 26, 2011, was called to order at 6:30 PM
by Vice -Chair Price.

ANNOUNCEMENTS (6:32 PM)
Grumbach welcomed new Commissioner Morcos to his first meeting and made the
following announcements:
• Staff spent the day moving back into the City Hall building. This will be the last
Planning Commission meeting at St. Thomas Church.
• The next City Council meeting on August 81" will include an open -house for the
public to tour the new building as well as a "meet and greet" with the final
candidates for the police chief position.
Nunn added that if citizens are interested in participating in the police chief interviews
they can submit their name for consideration.

AUDIENCE PARTICIPATION (6:36 PM)
Charlie Klinge addressed the commission on shoreline issues and made suggestions
for changes related to setbacks, the requirement for a geotechnical analysis to
replace a bulkhead and the restrictions for new impervious surfaces.
Mark Parry, Medina resident, suggested that the commission address security issues
related to the new bridge installations. Grumbach responded that this issue should
more appropriately be taken to the city council and suggested Mr. Parry contact
them.
Councilmember Janie Lee addressed the commission and audience, speaking to the
strategic points for discussion prior to the 2012 budget meetings. Lee mentioned that
there are a lot of changes taking place and many of these issues should be included
in the budget talks. She encouraged people to talk with other council members as
well.
Suzanne Cohen, Medina resident, commented that she had sent two letters and had
spoken at one planning commission meeting and wondered if the commission was
interested in further comments from her on shoreline issues. She was assured her
comments, particularly on the topics that had not yet been addressed, were welcome
Commissioner Price raised the issue of how to better communicate to the public
where the city is in the SMP process. Grumbach provided a short summary that the
shoreline setback issue had been referred back to the shoreline advisory committee
and the city would soon be advertising their next meeting, which was expected to
take place during the second or third week of August. He went on to say that the
city's website had been updated to better clarify the process and the timeline. When
the commission completes work on the draft document there will be an open house
for the public to ask questions and provide comments, and then the document may
be further amended before it is forwarded to the council for their consideration.
Commissioners raised the possibility of hiring additional consultants to help with the
SMP update process. Grumbach explained that the current consultant being used,
The Watershed Company, was hired by the City and took directions from City staff.
He noted that they were doing a good job in helping us look at the science and
figuring out ways to minimize changes. He further explained that if additional
consultants are desired, it would be best to look for them when we are preparing the
Cumulative Impact Analysis that will analyze "no net loss". This would occur after the
planning commission has settled on a draft set of regulations. Commissioner Nunn
asked Grumbach if he was comfortable with the consultant help we are receiving now
and he responded that he was. There was a general consensus among the
commissioners to wait on the prospect of hiring additional consultant help.
Cohen also commented on shoreline stabilization and stated that the winds in
Fairweather Bay create large waves.
David Douglas, Integrity Shoreline Permitting, stated that he had worked on fourteen
shoreline master program updates and was now working with Lake Stevens as a
property owners' advocate. Douglas suggested that the city's consultant is not pro -
property owner and that the Department of Ecology is making a concerted effort to
have bulkheads removed and docks made smaller, even though nothing says they
can't stay the way they are.
Colin Radford, resident on Fairweather Lane, volunteered to help to get people
involved and let them know what's going on. He indicated that he had read all the
documents by the Cities of Medina, Hunts Point & Mercier Island, to get perspective.

He noted that Medina has a unique topography and pointed out that the area had
bulkheads because storms had been eating away at properties. Radford expressed
concern that the underlying assumptions about the Medina environment were
actually false.
Bob Rudolph, Medina resident, suggested that the community needs a consultant
who is prepared to do everything they can to protect the property rights of the
owners, as aggressively as is possible within the law. Nunn expressed concern that
the City's consultant had exhibited a fairly defensive posture. Grumbach noted that
the contract with that particular consultant (AHBL) was done and that we would only
be going forward with the other consultant (The Watershed Company).
May addressed the issue of property rights and stated that the SMP law says that
property rights are to be protected so that there are no unconstitutional infringements.
He reassured the audience that the commission is concerned with this issue as well.
Tim Panos, Medina resident, echoed the comment that Fairweather Lane is unique.
He added that it is at the very end of the point and properties there are triangular in
shape. He stated that if the proposed setbacks were applied to his lot the setback
line would run through his living room and would wipe out an enormous area of the
buildable portion of the property. He said this is discouraging to him and to others
with similarly -shaped lots.
Jim Girardot, resident, commented that he doesn't own shoreline property, but that
he is concerned with the timing of the process. He said he hoped the city did not
take action too quickly because of the approaching deadline.
Council member Lee commented that it might be worth hiring an additional consultant
to give property owners the feeling that there is someone that has their back and
asked how much of the grant money is still available.
Grumbach responded that we have $25,000 as of July 1 st through June of 2012, but
the cost of the cumulative impact analysis that is required to support the SMP is a
necessary expense yet to be deducted from the grant dollars.
Council member Lee noted that it is important that there is over -communication or
citizens will come in after the fact and bombard the city council. She said she would
rally the council to make sure that they communicate with waterfront homeowners.
Steven Burnstead, who was also representing his father who lives next door to him
on Groat Point, stated that he had been to several property owner meetings and
listened to the comments. He stated that they need both staff and a consultant to be
an advocate for the property owners. He stressed that the challenge will be to try for
the least regulatory environment as is possible and that the setbacks are the primary
focus.
Commissioners discussed how decisions would be made. The drafting of a mission
statement was suggested by Nunn, but not implemented.

(*At the August 30, 2011, planning commission meeting Commissioner Nunn
requested the minutes be amended to reflect that there was "a vigorous discussion
with a consensus that the draft document should take a more pro -property owner
stance than they felt was happening up to then". There were no objections from the
other commissioners regarding the amendment to the minutes.)
OTHER BUSINESS
1) Securing Abandoned Homes (7.56 PM)
Grumbach updated the commissioners that he had received a response on the
subject of securing an abandoned construction site as had been requested. He
pointed out, however, that it was a confidential attorney -client communication so he
will need to run it by the City Attorney before releasing it, but thought he would be
able to talk about it at the next planning commission meeting. Grumbach explained
that it evaluated different options the city could take and provided an analysis of
each.
2) Shoreline Master Program Update — Development Regulations, Shoreline
Modification Regulations (continued discussion) (7.58 PM)
Grumbach explained that they were working off the same discussion document
unchanged from the last meeting. He informed the commissioners that the city's
website had been updated to clarify the SMP process and timeline and had also
added supplementary information, such as links to the status of other jurisdictions.
Grumbach addressed the issue of pier walkway width raised at the last meeting and
noted that Ecology was starting to take a position of limiting walkway widths to 4 feet.
Morcos raised the issue and commissioners discussed the possibility of allowing the
dimensions of a pier to be whatever the Corps of Engineers would approve. May
commented that this would provide some flexibility. Grumbach noted that this issue
was raised with the shoreline committee and that there was some concern about
predictability for residents in what they can expect. Morcos commented that the
Corps regulations are already very stringent and that there is no point in having our
own regulations unless they are more restrictive than the Corps'.
May suggested that the biggest issue is consistency in how far docks will stick out
into the lake. Grumbach noted that our regulations also include height standards.
Burnstead advised that, from a safety standpoint, a 6 ft. walkway should not be given
up.
The subject of shoreline stabilization was discussed. May commented that he felt
there was an inconsistency between the definition that included protecting both
buildings and land and the regulations that focus on protecting buildings. Grumbach
noted that the draft is trying to follow the state guidelines as close as possible.
May stated that this is a major philosophical question and felt that it is critical to
include the consideration of property as part of what is to be protected. It was

pointed out that most of Medina already contains shoreline stabilization. May also
suggested a preference for looking at opportunities to reduce the requirement for a
geotechnical analysis.
Douglas suggested that the issue of major vs. minor repairs is a sticking point that
should be clarified so it will be clear when a repair triggers the requirements for a new
structure.
May indicated that the last major issue is the requirement for vegetation when a pier
is replaced and suggested the commission ask Grumbach to provide that information
at the next meeting. Grumbach concurred and stated that he would incorporate the
current comments as well as the comments from the previous meeting into an
updated document for next month.
There was discussion on performance bonds, and Grumbach explained that there is
generally a five-year monitoring plan when vegetation is required and a performance
bond is standard. Burnstead disputed the five-year time period as necessary or
desirable. Klinge clarified the difference between a performance bond and a
maintenance bond. May suggested Grumbach provide information regarding
alternatives to performance bonds or maintenance bonds at the next meeting.

Grumbach addressed the commission on their availability for the August meeting to
determine if there would be a quorum and indicated he would suggest alternative
dates via email.

RESOLUTION NO.
A RESOLUTION OF THE MEDINA CITY COUNCIL
CENSURING COUNCIL MEMBER SHAWN WHITNEY
WHEREAS, the citizens of the City of Medina expect and demand the highest
ethical standards of their elected officials; and
WHEREAS, of paramount importance to the public trust is that elected officials
only exercise the authority and influence of their position in the public interest; and
WHEREAS, the City Council has determined that Council member Whitney has
disregarded Council Ground Rules and Guidelines, ignored legal counsel, and placed
personal interests ahead of the best interests of the City; and
WHEREAS, Council member Whitney was afforded an opportunity to address
these concerns and complaints at a special meeting of the City Council on August
16,2011, and Council Members had the opportunity to discuss the circumstances; and
WHEREAS, Council directed the City Attorney to draft a resolution of censure
directed to Council member Whitney;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA,
WASHINGTON, DOES RESOLVE AS FOLLOWS:
Section 1. Council Member Whitney has brought suit against the City alleging that the
City has violated the Public Records Act. The City Council finds that allegations
contained in the suit breach the confidentiality of Council executive session in violation
of RCW 42.23.070(4) which states: "No municipal officer may disclose confidential
information gained by reason of the officer's position, nor may the officer otherwise use
such information for his or her personal gain or benefit."
Section 2. The City Council operates under "City Council Ground Rules for City
Council Meetings and Council/Staff Interaction." The stated goal of the Ground Rules
"is to provide direction in how council members are expected to treat one another, city
staff, constituents and others they come into contact with in representing the City of
Medina."
The City Council finds the conduct of Council Member Whitney to be in violation of the
following Council Ground Rules:

l.d. The council moves forward expeditiously without rehashing
previously discussed information or engaging in conversation with
the public during the business meeting.
Le. The city council conducts itself in a courteous, professional and
respectful manner toward each other, the staff and the public.
l.f. Council members maintain a balanced perspective in conducting
the public's business.
Li. Council members do not surprise one another or staff at a public
meeting with anything that could be discussed before- hand so that
council members and staff can be prepared to respond.
l.j. Council members speak with one voice once a vote has been taken
and do not work to undermine the decision of the council.
City Council/Staff Interaction Ground Rules
2. d. Council members shall not publicly criticize the city staff. If there
are concerns it should be discussed with the city manager
privately.
2.e. Council members shall at all times be respectful of staff and treat
them as professionals.
Section 3. The City Council has adopted its own set of Guidelines to assist the Council
by documenting accepted practices and clarifying expectations. The guidelines declare
that administration of City Council affairs is greatly enhanced by the agreement of the
Council and staff to be bound by these practices. Section 1.03 of the Guidelines states
that the procedures were established so that expectations and practices can be clearly
articulated in order to guide council members in their actions.
The City Council finds the conduct of Council Member Whitney to be in violation of the
following City Council Guidelines:
2.01 City Council Generally.
... [C]ouncil acts as a body. No member has any extraordinary powers
beyond those of other members.... It is also important to note that policy
is established by at least a majority vote of the council. While individual
members may disagree with decisions of the majority, a decision of the
majority does bind the council to a course of action. Council members
should respect adopted council policy. In turn, it is staff's responsibility to
ensure the policy of the council is upheld.

Section 4. The City Council finds that the conduct of Council Member Whitney has
obstructed the Council's ability to operate in an efficient and cohesive manner by
engaging in the following activities:
• Letting honest differences of opinion degenerate into personality conflicts.
• Make decisions on the basis of personal interest rather than public policy.
• Surprising fellow Council Members and staff at Council meetings by raising
matters not on the agenda and that are designed to embarrass others.
Section 5. In order to avoid any future adverse conduct or communications, the Council
has removed Council member Whitney from the position of Deputy Mayor and abolished
the Council Finance Committee on which she served.
Section 6. Based upon the foregoing findings, the City Council does hereby censure
Council Member Whitney for violating Council Ground Rules, Guidelines, state law and,
ultimately, the public trust by conducting herself in a manner that does not reflect the
high ethical standards that elected officials must maintain.
