At this time, citizens may address the City Council regarding any issue related to city business,
excluding public hearings. To ensure equal opportunity for the public to comment, a speaker’s
comments shall be limited to three minutes per person, per meeting. Those who have service
requests or complaints are encouraged to first bring such matters to the city manager for prompt
attention and resolution.
Council meetings are business meetings where City Council may hear from residents and take
action on official City business. In order to accomplish all the business on the agenda and be
respectful of everyone’s time, Council Members will not be able to engage in dialogue with individual
members of the audience.

1. Our last Regular City Council meeting of the year will begin with a Special Executive session
at 5:30 on Monday December 10th. Because we are beginning an hour early, we will
provide a light meal starting at 5:00. Council is welcome to arrive early in order to have a
bite to eat before the meeting. Also the regular business agenda is short so that we can
recess into a study session to discuss the topics requested at the November Council
meeting. Please see the agenda.
2. Don’t forget City Hall will be closed Monday December 24th, Christmas Eve Day, as well as
Christmas Day, Tuesday December 25th. We will reopen Wednesday December 26th, 27th,
28th, and 31st. Then we will be closed again January 1st for New Years Day. Our next
Regular City Council meeting will be Monday January 14th.
3. You still have time to bring food for the food drive benefiting Hopelink which serves more
than 3,000 families each week. Everyone is invited to help Eastside families in need of the
following: canned meals, canned meats, cereal, dry beans, fruit (canned and fresh), pasta,
peanut butter, rice, soup, tomato products, vegetables (canned and fresh), baby food, paper
towels and toilet paper. Please remember that Hopelink cannot accept expired food.
Donations may be dropped off at City Hall any time during regular business hours. Your
donations & support are greatly appreciated.
4. You also still have time to purchase individual gifts of children’s clothing and toys for the
Childhaven giving tree in City Hall lobby. You can choose the tag from the tree with the gift
you would like to buy. Gifts should be returned unwrapped no later than 5 pm Friday,
December 14th. We started with 75 tags for children and still have many from which to
choose. If it has been a while since you have been to a toy store, pickup a tag and have
some fun selecting a gift. We appreciate your support.
5. Staff spent a lot of time reviewing the 2012 budget this week in preparation for the
December 10th Council meeting and the 2012 budget amendment we are recommending.
Most items are housekeeping, but it was a good opportunity to review how much has been
accomplished over the last year. We will provide a complete overview early in 2013.
6. In our quest for softer gentler lights on the outside of city hall, we have been able to reduce
the glare by turning off the lobby lights on the main and lower levels at night. This week we
also took all the bulbs out of six of the 12 fixtures on the balcony on the main entrance floor.
The fixtures on the ground floor on the park side of the building remain on for safety around
the restrooms and security for the police department. Again these are affordable fixes and
we are still looking at safe film to add to the existing fixtures.

COMMUNICATION TO OUR COMMUNITY
E Notice Program:During the month of November,the City issued 42 bulletins amounting to a total of
13,652 bulletins emailed to subscribers,approximately 21.8%were opened.A summary is attached.
Postcards:Council’s November,2012”postcard was distributed via Govdelivery and posted online.
Website Hits:The attached report identifies hits on the City’s website pages during the month of
November.

RECORDS REQUESTS
As of November 30,184 public records requests have been received by central services during
2012.Of these,seven remain open and the City is responding in installments.Staff continues to
respond in installments to two 2011 requests,as well.In addition to tedious reviews for broad
request responses,staff has been responding to time consuming discovery requests over the past
few months.A quarterly report summing up 2012 will be provided to council next month.
PASSPORTS
During the month of November,32 passport applications were processed at City Hall.A total of
306 have been processed during 2012.For comparison,between January 1 and November 30,
2011,268 applications were processed by staff.
VOLUNTEER SERVICE OPPORTUNITIES
The City continues to recruit for a vacancy on the Medina Planning Commission.The term is open
for immediate appointment and the position will expire 6/30/2014.
The City will begin recruiting for a vacancy on the Civil Service Commission.The term for this
position will begin at appointment and expire 06/30/2015.
HUMAN RESOURCES
Recruitment for the one quarter time accounting assistant position began October 23 with a
seven day internal announcement followed by the October 31 external announcement.
Advertisements were posted with the WFOA Washington Finance Officers Association),WCMA
Washington Municipal Clerks Association),AWC Association of Washington Cities),on the City’s
website and online with The Seattle Times.Notice was also emailed via Govdelivery.The
recruitment period was extended this month and ads have been extended for 30 days.
Open enrollment for 2013 benefits recently concluded.Staff will participate in a wellness training,
activity and lunch on December 13.Another wellness event and training session is planned for
January 28.
City Hall will be closed Monday,December 24,and Tuesday,December 25 this year.Council
approved Resolution 358 in September expressing the City’s appreciation for its employees through
the award of an additional holiday on the 24th.

City employees are sponsoring a food drive to benefit Hopelink and a Giving Tree

Hall during business hours between until December 14.

Subject: Monthly Development Services Department Report
Planning Commission Meeting Recap: The Planning Commission held a public
hearing on a Level 2 Tailored Construction Mitigation Plan. The proposal is to
redevelop an existing residential waterfront lot, including construction of a new
single-family home and replacement of the existing bulkhead and dock. The CMP
contained a unique feature in that the property owner wants to remove the house
by barging it to a new location outside of Medina. Public comments were received
from the neighbors. The Planning Commission voted to approve the construction
mitigation plan subject to conditions.
The Planning Commission discussed its 2013 work program. Several possible
work program items and order of priority were discussed including adding an
update to construction mitigation plan regulations. After deliberating, the
commissioners reached a consensus on the work program to be submitted to the
City Council for consideration.
The Planning Commission agreed to cancel their December meeting.

Other Items of Interest:
1. Shoreline Master Program. Department of Ecology has forwarded the public
comments it received on the Medina Shoreline Master Program. Eight people/
agencies provided 37 comments that the City must provide written responses
too. The City has 45 days to respond to the comments and may also request
time extensions if necessary.
2. Pre-decision Hearing. The City Manager noted last week in her weekly report
that staff would update the City Council on the hearings that took place the
week of November 26 through 30. The Planning Commission hearing is noted
at the beginning of this report. The second hearing was by the hearing
examiner who held a pre-decision hearing on a shoreline substantial
development permit to remove three existing boatlifts and replace them with
two new ones including a grated platform lift. There was no public testimony

and the hearing was completed in about 30 minutes. A decision is expected by
mid-December.
3. 2012 Permits. As can be seen in the October 2012 Permit Report, the City has
issued permits with a total of $63.5 million in construction value. This
represents a significant 311 percent increase over the 2011 totals with two
months to go. How the construction value in 2012 is shaping up in comparison
to past years is outlined below:

1. The Medina Park lower pond outlet structure and piping were installed in preparation for the
installation of the Thirsty Duck outlet float control device.The installation of the outlet
structure required sand bags to maintain the lower pond water level,dewatering of the area
between the sand bags and the sheet pile wall,excavation for placement of the concrete
outlet box,and installation of the outlet structure and piping through the sheet pile wall.The
Thirsty Duck flow control float insert was delivered on November 26th.The contractor will
install the float control device on the outlet structure on December 12th.

2. The Public Safety Surveillance and ALPR Camera Project contractor installed the overhead
pole foundations for mounting of the cameras this month.The installation required use of the
City contracted jet vactor truck to clean out the auger holes prior to the foundation pour.
Present work involves installation of the service cabinets to be followed by the pole
placement and field wiring.Work is expected to be completed by the end of the year.

3. The Transpo Group transportation consultants)at the request of the Director of Public Works
evaluated Evergreen Point Road intersections at NE 12th and NE 24th Streets to determine if
all way stop signs at those intersections were warranted.According to the Manual of Uniform
traffic Control Devices MUTCD)the decision to implement multi way stop control should be
based on an engineering study where the volume of traffic is approximately equal at each
approach.Traffic counts at the intersections verified that the volumes at each approach are
approximately equal throughout the day.
The MUTCD provides criteria that should”or may”be considered for multi way stop
applications.The should”wording suggests that multi way stop be installed if criteria is met,
while may”gives an option to install multi way stop control or not.The Transpo Group study
indicated that the locations do not warrant installation of multi way stop control under the
should”MUTCD criteria,but do under the may”criteria as follows:
Evergreen Point Road,NE 12th Street and NE 24th Street are all similar in design and
operating characteristics.
Implementation of stop control would help control pedestrian/vehicle conflicts at both
intersections.
Traffic volumes at all intersection approaches are similar throughout the day.
It is important to note that the implementation of a stop sign to control speed is not a
recommended practice by the MUTCD.Studies monitoring the use of multi way stop control
to reduce vehicle speeds have shown increases in vehicle speed downstream from the
intersection as if to make up for the time delay caused by the stop).The City did not
undertake this study to reduce vehicle speeds the average speed on Evergreen Point Road is
between 26 and 28 mph).It is the recommendation of the City Engineer to install multi way
stop control for assignment of rights of way for vehicles and pedestrians at these
intersections due to their similar operating characteristics and similar traffic volumes
throughout the day.That recommendation has been reviewed and accepted by the Public
Works Director,City Manager,and Police Chief.All way Stop signs will be installed at the
corners or 12th and EPR and 24th and EPR in January 2013 after some public education.
4. The Transportation Improvement Board TIB)provided notice of an award of 103,770 to
complete walkway improvements along the west side of Evergreen Point Road from NE 8th
Street to Overlake Drive West and Medina Park/City Hall.This project will replace the narrow
buckled walking area that is presently hidden from the street and provide better pedestrian
access to the Park and City Hall.The project application scope of work provided by the
Director of Public Works included removal of the overgrown trees and vegetation,installation
of a concrete curb and 5 foot wide sidewalk along the back edge of the resurfaced parking
aprons to be surfaced with asphalt)and new landscaping along the property frontages.The
City matching amount will be 50,000 to complete the project.
5. The SR 520 Project has progressed to the point that most of the overcrossing bridge structures
are in place.Recent work has included the center of roadway transit stop construction,
drainage culverts,and sound walls.
The Floating Bridge Landing project is underway on the eastside.The first floating pontoons
fabrication and site work area can be seen in the following picture:

6. The Public Works Crew planted drought tolerant plants in the landscaped islands along the
north side of NE 24th Street between 78th and 80th Ave NE to replace those that had not
survived.Street sweeping of the entire City and cleaning of 20%of the City’s storm drainage
catch basins were accomplished.Seasonal lighting was installed on trees and shrubs in the
landscaped garden area of Medina Park.

7. In preparation for the Public Works Shop Building expansion,the Public Works shop yard
area was expanded to the south of the existing shop building to capture an unusable brushy
drainage ditch area by turning it into usable yard area.This was accomplished by reusing the
old ecology blocks that constituted the material and waste bins.The blocks were placed
along the south property line two high to form a wall to support granular fill placed behind
the wall to extend the yard area to the south an additional 17 feet.Replacement of fencing
will occur in December.The approval of the cost for this site work is included in this Council
packet under item OB 2.

Council member Phelps proposed to place two Teamsters labor agreements on consent
agenda and council member Dicharry seconded. Motion carried 6-0. Dicharry noted a
correction to October 8 meeting minutes to amend roll call and Phelps voiced addition of
continued executive session to end of meeting agenda. The amended agenda was
approved 6-0.
PRESENTATION
On behalf of the council, mayor recognized Mr. John Dern Palmer’s twenty years of
service to the civil service commission.
PUBLIC COMMENT
Mayor read guidelines for public comment period and opened floor to public comment at
6:43 pm.
Sherrie Wen addressed council about her concern of residential fires caused by lightning
strikes to trees throughout the United States and how the danger could be addressed
through legislation in the City’s Tree Code. Ms. Wen emphasized threat of fallen trees and
fires in Medina during windstorms and landslides.
No other statements were presented and mayor closed comment period at 6:50 pm.
REPORTS AND ANNOUNCEMENTS
Mayor reported he toured drained Locks and structure is sound. There were no council
member or board and commission reports.
City manager followed up on citizen request to enforce unsightly garbage and yard waste
bin placement and noted only one city was found to have an enforcement policy. City will
send an email to subscribers reminding residents to pull cans back in.
City manager said Roger Ngouenet was appointed to the temporary civil service
commission meeting for the November 14 hearing.
Police chief reported new hire will be in the police academy through March and in field
training until July. He said a lateral officer position will be advertised soon. Responding to
accreditation question he said the department remains on target for May however
recognition could occur in November.

than budgeted as of November YTD.
Development: Consultant fees for Planning, Engineering, Landscape and Hearing Examiner have
increased by $171K as a result of higher Development activity during 2012. Note: Development
Revenue has increased by $484K for 2012.
2012 Budget Amendment:
Please see the 2012 Ordinance Amending Budget Ordinance 880 in the City Council Packet. The 2012 Budget
Amendment amends the 2012 General Fund Budget to properly account for Revenue and Expense increases
and provides visibility into department budget impacts within the General Fund for 2012.
The 2012 Year End Forecast is anticipated to be very close to what was reported in the October 31, 2012
forecast. Any new items which were not forecasted or budgeted as of November 30, 2012 have been included
the 2012 Budget Amendment.

BACKGROUND/SUMMARY:
The City Council awarded the south Medina Park Pond outlet control structure site work to Cascade
Materials Aggregate,LLC on August 13,2012.The contractor completed the work in November of
2012 at the bid price of 32,379.15 plus tax.
After the Public Works shop renovation project was approved,the Director of Public Works
requested that the contractor also complete site work at the shop yard in preparation for future
shop building and yard area improvements.This was done on a time materials basis and resulted
in a cost savings for mobilization as the contractor’s backhoe and equipment were already on site.
The first item of work was accomplished by the City crew;removal of the south fencing and removal
of the larger scrub trees.The contactor then utilized the old ecology block wall segments that had
been used for material and waste bins to construct a two block 4 foot high wall along the south
property line to support the placement of granular fill behind the wall to extend the Public Works
yard area to the south for better utilization of the limited yard area.The granular fill allowed the
yard area to expand to the south approximately 17 feet in what was formerly unusable space
without any impact to the park area on the north side of the shop.New fencing will be added to
secure the yard prior to construction.

Vice-Chair Flagg called the October 15, 2012 Park Board meeting to order at 6:05 pm.

APPROVAL OF MINUTES
OTHER BUSINESS
Windsong Sculpture (6:06 pm)
Denise Bisio of Artech, Inc. sent Willis an email regarding her company’s interest in restoring the
Dudley Carter Windsong sculpture in Medina Park. She stated that her company has experience and
expertise restoring the artist’s work.
The board spoke about the condition and appearance of Windsong and recalled their plan to have the
sculpture relocated to the Medina Park picnic shelter. The board decided to revisit the matter after the
shelter is installed in the spring of 2013.
Fees for Sports Field Use (6:13 pm)
Willis discussed an email from Debbi Sellers, WCIA Risk Management Rep. She advised against
charging a field use fee due to liability issues and maintenance upkeep. The board acknowledged her
recommendation and resolved not to pursue the fees.
Policing Medina Park (6:17 pm)
The majority of the board expressed interest in inviting Chief Thomas to the November meeting to
discuss the possibility of officers periodically patrolling Medina Park. Willis confirmed that he would
speak to the Chief and follow-up with board members.
PUBLIC COMMENT
Medina resident Shawn Fitzpatrick provided public comment via email. Ms. Fitzpatrick’s touched
on topics related to Medina Park. She also noted concern over people utilizing the park after
dark. She suggested that the city install a sign stating that the park closes at dusk.
Willis explained that city ordinance mandates that Medina Park closes at 10 pm. The board
asked Willis to forward Ms. Fitzpatrick the ordinance stating the park is closed from 10 pm to 6
am.

appearance of fairness. Commissioner Heija Nunn and Chair Judie O’Brien stated
they had been approached by residents about this project, but declined to speak with
them due to their role on the planning commission. Chair O’Brien also disclosed that
she lives approximately four parcels north of the subject property, but stated she felt
she could be fair and impartial in voting on this application. Chair O’Brien asked if,
on the basis of the disclosures, anyone wished to challenge the participation of any
commission members. No objections were raised.
Chair O’Brien explained the procedures for conducting the public hearing.
Grumbach administered an oath to those who testified during the meeting.
Amie Broadsword, City Construction Mitigation Plan (CMP) Consultant, made a
presentation. She displayed the property site plan and identified the location and
access to the property. She indicated there is adequate parking onsite (6 stalls) and
no additional provisions for offsite parking. There is sufficient area for onsite staging.
She added that the site is well-screened to the north, west and south. Security
fencing will enclose the site.
Broadsword went on to say that a truck travel route was provided which avoids
school zones. However, she recommended that trucks be prohibited during school
bus pick-up and drop-off times.
Broadsword entered into the record and gave copies to the commissioners an email
containing comments on the proposal from resident Joanne Bohdanowicz.
Broadsword concluded by recommending approval of the CMP with the seven
conditions listed in the staff report.
Commissioner Nunn asked Grumbach to speak about the role of the Planning
Commission with respect to the project hearing. Grumbach explained that the
commission’s role is to review the construction impacts under Chapter 15.20 of
Medina Municipal Code, and to limit their consideration to the construction impacts
on the neighborhood. He emphasized that the commission should focus on the
approval criteria in the code.
Commissioner Papano asked about the truck traffic from the excavation activity.
Grumbach estimated that there would be approximately 75 truck trips each way
based on the cubic yardage of soil to be removed. Grumbach answered other
questions from the commission, explaining the different levels of CMPs. Broadsword
added that the valuation of the project was what triggered the requirement for the
Level 2 Tailored CMP.
Brian Swedick, Lochwood Lozier Homes, represented the applicant. Swedick
testified that the size of the house is not unusual for Medina and that the construction
period for this type of home is usually 10-12 months. He explained that there was
nothing unusual about this project and that they would do everything required to
comply with Medina’s regulations.

Swedick answered commissioners’ questions regarding when the project would likely
begin, parking, noise and the nearby school bus stop.
Chair O’Brien opened the hearing to public testimony. The following people provided
written comments and/or testified during the public hearing:
a. Lori Brustkern provided written comments expressing her concern that the
home is not intended as a single family residence.
b. Joanne Bohdanowicz provided written comments expressing concern that the
blueprints indicate a large dwelling that is excessive to accommodate one
family. Additional concerns regarding property values were raised, should the
City allow small apartment structures of this nature to be built on single family
resident streets.
c. Kristina Moran provided written comments expressing concern that the
proposed project will be breaking the covenants for Fairway View plat, which
was designated as a single family home lot.
d. Kit Thayer provided written comments expressing concerns that the proposed
design is not in keeping with other homes in Fairway View, and questioned
whether or not it is a single family dwelling. She also testified about concerns
regarding the project. She asked about the number of parking spaces,
bedrooms and bathrooms.
e. Kathleen Kirk testified that she lives directly across the street from the subject
project. She asked about the height of the home, how many people would be
living there, and fences.
f. Diana Murray testified about her concern that the home will not be used as a
single-family home. She also stated that there were CC&Rs on the Fairview
Plat applicable to the neighborhood. She also noted there had been previous
problems with parking on the street.
g. Rick Bohdanowicz testified that he lives directly north of the subject property.
He stated that he operates a home business and his office window is about
ten feet from the construction activity. He was particularly concerned about
the noise from dump trucks. He also noted that there are CC&Rs on the
property and expressed concern that the builder seemed unaware of them.
He also commented on previous activity that had occurred on the property.
Bohdanowicz stated that he would like construction not to begin before 8:00
am. Finally, he asked about the drainage being planned on the property and
explained that his property is significantly lower than the subject property and
was concerned about runoff.
h. Mark Nelson testified to the need to give consideration to home businesses
located near construction sites. He also suggested the City do something to
inform residents about possible CC&Rs on their properties.

On the issue of CC&Rs, Grumbach suggested the applicant check with the
homeowners’ association. He explained that the City does not have the authority to
enforce CC&Rs and that permits can be issued regardless of the proposal’s
compliance with the CC&Rs. He further explained that the homeowners’ association
has responsibility for enforcing CC&Rs and could use legal action. However, the City
would not be involved with this.
Discussion followed on the noise and Mr. Bohdanowicz’s concerns about the
proximity of trucks operating near the home business office in his home.
Commissioner May asked about limiting the construction hours. Grumbach
suggested that the commissioners ask the applicant if he had an objection to a later
start time so that it was on the record. If the applicant objected, they should take the
objection into consideration, but it would be the commission’s decision. The
commissioners asked the applicant and Swedick responded that he could not make
that decision, but that he did not see that it would be a problem.
Commissioner Nunn addressed the resident’s concerns about usage of the property
by explaining that there is no evidence that the use is contrary to city regulations and
that it is not something the Planning Commission can address. Commissioner
Morcos suggested that the residents put their concerns in writing to the homeowners’
association and Chair O’Brien recommended that residents use the homeowners’
association to enforce the CC&Rs.
Grumbach advised the residents that they will get a copy of the decision and that
they have appeal rights. He recommended they make sure to provide their contact
information for notification purposes.
Chair O’Brien closed the public hearing.

1) Comprehensive Zoning Code Update Discussion
Grumbach reported that he had made revisions since the last meeting which were
underlined and also referenced a summary of changes which he provided. He went
on to say that he would solicit comments from professionals in the community who
use the code and have the City’s attorney review it prior to bringing it back to the
commission, which would most likely occur in January. Then a public hearing will be
scheduled and formal noticing and other procedures conducted.
Commissioner May had questions regarding two sections:
Parking (page 47), for which he did not recall having a previous discussion.
Grumbach explained that this was added since the last draft and was based
on the existing code. A discussion on parking followed.
Private Lanes – Grumbach explained that the language on private lanes was
based on existing code, but that he had to do quite a bit of editing because the
language was outdated. He shared that he added the private lane
maintenance provisions and the minimum construction standards to ensure
that there are maintenance provisions. He also made changes to provide
consistency with the current fire code. Grumbach reported that he had
removed sections pertaining to dimensional standards for turnarounds since
this is covered in the fire code, and explained that these only come into play
when a property is redeveloped.
Grumbach also pointed out that he had added new definitions.
May remarked that moving all the regulations into a consolidated development code
section made a vast improvement.
Nunn thanked Grumbach for the considerable amount of work he had done on this
document.
Grumbach mentioned that after bringing the draft document back, the next phase
would be to possibly make changes to the Official Zoning Map. Discussion followed.
Grumbach presented ideas about moving zoning boundaries to follow property lines
on properties that have multiple zoning districts, on rezoning the St. Thomas property
so that the school would become a conforming use, and on rezoning the City’s
property adjacent to Medina Beach Park. The Commissioners agreed with looking at
the ideas.

The primary reason for recommending a 2012 Budget Amendment is due to increases in Building
Permits as well as increases in Other Planning and Development activity.
The 2012 Budget is adopted at the Fund level,not by individual Departments,however it is important
for Council to see the Department level shifts to understand where dollars are being spent and to
provide good historical documentation of what occurred during a given budget year.
The 2012 Budget Amendment Ordinance items are related to Development primarily),Police Civil
Service Hearing Expense,Park signs and a small item for Central Services.

1. Permit Fees:Increase of 162,500
2. Subdivision Development and Other Planning/Development:Increase of 321,000
Expenditures:New 265,441
1. Development:170,500 increase for 2012 Planning,Engineering and Landscape Consultant,
Prof.Services Plan Reviews,Testing,Peer Reviews)and Hearing Examiner Fees.Additional
Development expenditures will be incurred in 2013 as a result of the building activity revenue
increases which were received by the City in 2012.
2. Finance:9,700 for 2012 Development Fees as a result of increased Merchant Credit Card form
of payments to the City.We added a 3%Merchant Credit Card usage fee for 2013).

WHEREAS, the Medina City Council enacted Ordinance 880 on November 14, 2011
approving the budget for 2012; and
WHEREAS, it is necessary to increase General Fund Revenues and Expenditures
