Council meetings are business meetings where City Council may hear from residents and take
action on official City business. In order to accomplish all the business on the agenda and be
respectful of everyone's time, Council Members will not be able to engage in dialogue with individual
members of the audience.

1. The Shredder Truck will be at Medina City Park on NE 12th Street, SATURDAY, APRIL
13, 2013 from 9:00 AM TO 1:00 PM. Residents can bring documents with their name,
address, and personal information that could be in danger of Identity Theft. Drug Take
Back will be offered on the same day. A Medina Police Officer will be available to collect
all unused prescription drugs for proper disposal by the Drug Enforcement Agency.
2. Members of the Seattle Harbor Patrol Unit will be conducting a Boater Safety Class at
Medina City Hall on Saturday, May 18 from 9 am to 5 pm. There will be NO CHARGE for
this class however, maximum participants is 60. So far we have 22 people registered.
3. As reported last month, NORCOM dispatch center completed the upgrade of CAD.Net and
New World Systems software in February. Extensive testing was conducted by NORCOM
before this upgrade and everything went well with the installation. After the upgrade took
place however, there were several unforeseen computer problems in the Dispatch Center.
Servers had to be re -booted at times causing the dispatchers to revert to the backup
system. The major problem revolves around a Microsoft software issue which interrupts the
CAD software. This is being addressed by Microsoft, NORCOM, New World, Dell
Computers and other vendors. A temporary fix was put into place and all parties are
working on a permanent solution. If there is another outage, NORCOM has a plan in place
to address this situation. There were no priority calls or major impacts to Medina during
these outages. There have been no outages since March 19.
4. Allyson Jackson has provided an update on the Flight Track issue for Feb -March 2013: A
follow up letter was sent to Donna Warren, FAA Airspace Compliance, informing her that the
City of Medina is reviewing its options with regard to south flow arrival non-compliance.
Interviews were held with two Seattle based environmental law attorneys to discuss
potential legal strategies. Allyson Jackson, Temple Johnson, Michael Luis and Donna
Hanson participated in these meetings. Allyson Jackson and Temple Johnson are locating
an aviation technical specialist who can provide a third party technical interpretation of the
Four Post south flow arrival procedure. A scope of work for the attorney and the aviation
specialist will be provided to Council in May. The Port of Seattle has unofficially stated that
the draft Part 150 study will be available to the public sometime in April.
5. Following is an update on the Skinner matter. The Presiding Superior Court Judge has
decided to hear oral argument on the City's Application for a Writ of Review. They are trying
to work out a date with the court. The current problem in setting a date is with Skinner's
attorney who is involved in an extended arbitration proceeding in San Francisco. We hope to
have a hearing date in the near future. As you will recall, the City is seeking to enjoin the
Commission from further proceedings on back pay and benefits. In the meantime, the
Commission is proceeding with its process for supplemental proceedings to determine the

amount of back pay and benefits. The City complied with the Commission's Discovery
Order. Skinner supplied only limited information required by the Commission's Order.
6. We continue to remind residents of volunteer opportunities that are currently being
advertized:
• Civil Service Commissioner
• Park Board Member
• Planning Commission Member
• Emergency Preparedness Committee Members
We encourage anyone who has an interest in knowing more about these positions to please
contact city hall and they will be directed to the right staff person. It is a commitment of
generally twelve meetings a year, but it is also an opportunity to get involved and learn
about more about the community. Staff makes every effort to lighten the volunteer workload
and to make it fun and interesting. If you decide it's not for you, you don't need to apply, but
you will know a little bit more about what happens in city hall.

Incumbents have been advised of expiring terms and encouraged to reapply for their positions and
public notice has been posted for these positions. All citizens interested in serving must submit an
application. Applications are available at city hall and on the city's website.
As of April 4, the city has received three applications for the park board and one for the planning
commission.
Additionally, the filing period for city council positions begins May 13. Positions 1, 3, 5, and 7 will
expire 12/31/2013. More information can be found online at www.kingcounty.gov/elections.
COMMUNICATION TO OUR COMMUNITY
E-Notice Program: During the month of March, the City issued 35 bulletins amounting to a total of 18,194
bulletins emailed to subscribers; approximately 22.5% were opened. A summary is attached.
As of March 31, the city has 2,236 subscribers with a combined total of 16,860 subscriptions.
Website Hits: The attached report identifies popular hits on the City's website pages during the month of
March.
RECORDS REQUESTS
As of March 31, 46 public records requests have been received by central services during 2013. By
March 31, 2012 the city had received 54 requests. A quarterly report identifying 2013 requests and
older pending requests is attached.
PASSPORTS
During the month of March, 28 passport applications were processed at City Hall, totaling 81 for the
year so far. Last March the City processed 38 applications for a total of 103 by March 31, 2012.

Planning Commission Meeting Recap: The regular Planning Commission
meeting was canceled due to a lack of a quorum. A special meeting was held
April 1, 2013, with four commissioners present.
Two project -permit public hearings were held. The first hearing was on a Level 2
Construction Mitigation Plan for St. Thomas Episcopal Church Life Center. St.
Thomas is requesting to demolish the existing Parish Hall and construct a new two
story facility in its place. A Non -administrative Special Use Permit was approved
for the project by the Hearing Examiner in January. Written comments and oral
testimony was received. After deliberating and modifying some of the proposed
conditions, the Planning Commission approved the construction mitigation plan
subject to nine conditions.
The second public hearing held was on a Site Plan Review and a Level 2
Construction Mitigation Plan to demolish an existing single-family home and
construct a new home with associated site improvements. Written comments were
received. After deliberating, the Planning Commission approved the site plan
review and construction mitigation plan subject to the conditions set forth in the
staff report.
The last agenda item was a discussion on a draft proposed code amendment
updating the zoning code, and permit and approval provisions. Mr. Hotes, a
resident of Medina, provided comments expressing concerns about the changes to
the setbacks because it will make his home nonconforming. He is concern this will
affect his property value when he sells. (Note: the current draft applies setbacks
based on lot size rather than zoning district so larger R-16 lots will become subject
to the 15 percent side yard setback while smaller R-20 and R-30 lots will become
subject to a 10-foot side yard setback.) The planning commission discussed the
tradeoff between some property owners benefiting from the change and some
property owners not benefiting from the change and decided for the purpose of the
hearing to leave the draft as proposed.

Hearing Examiner Decisions:
• The hearing examiner approved, subject to conditions, a non -administrative
special use permit to upgrade AT&T Mobility's wireless communication facility
with newer technologies. The location of the facility is at 8320 N.E. 12t" Street
(St. Thomas Church).
• The hearing examiner approved, subject to conditions, a site plan review and a
substantial development permit to construct a new beach house and other
improvements. The address is 2047 Evergreen Point Road. The applicant is
Legacy Trust.
• The hearing examiner held a public hearing on applications for a substantial
development permit (File No. PL-12-058) and a Level 2 Tailored Construction
Mitigation Plan (File No. CMP-12-031). The address is 432 Overlake Drive
East. The applicant is proposing to redevelop a residential waterfront property
by demolishing the existing home and constructing a new one. Written
comments were received from the Muckleshoot Indian Tribe. Kimberly Allen
was not available so Kristen Larson with Sound Law adjudicated the matter. A
decision is expected soon.

Other Items of Interest:
1. SR-520: There is no new information to report regarding the SR 520
construction ramps and the contractor's plan to revise their construction
mitigation plan.
Attached to this report is the letter and drawing of the view platform trail/
platform that were prepared in response to the south side residents' request.
2. Zoning Code Update: A public hearing is scheduled for the April 23 Planning
Commission meeting on the comprehensive zoning code update and
consolidation of permit requirements. A link on the City's website containing
information on the proposal is available. Additional notice of the hearing was
issued through public notice board postings and a-gov delivery.
3. Shoreline Master Program Update: City staff received a draft of required and
recommended changes from Ecology that are expected to be included in their
decision on the City's submitted shoreline master program. For purposes of
receiving state approval, the City must address the required changes. Some of
the listed changes appear to be minor in nature as they identify specific
language inconsistency with state law. However, some of the changes are
more significant.
Staff is internally reviewing the lists and will brief the City Council on our
findings at the April 22, 2013, study session. Please note that a formal
decision has not yet been issued. The main purpose of the study session will
be to inform the council about what we can expect and to discuss a possible
work program for following -up on a City response once we have the formal
decision.
We should receive Ecology's formal decision soon. However, it is unknown if
we will receive the decision before the study session. If we do receive it, it will
be shared at the study session.

RE: SR 520 Floating Bridge and Landings - noise walls and shoreline access trail in Medina
Dear Neighbors:
Thank you for meeting with SR 520 Floating Bridge and Landings Project staff on Thursday,
Jan. 31, to discuss updated information regarding the noise walls and shoreline access trail in
Medina. Some of you were also able to attend the March 2 meeting with Senator Tom so that
he also could be briefed on these issues.
Following the meeting with Sen. Tom on March 2, he offered to coordinate a follow-up
meeting with WSDOT, Ecology and interested neighbors. If this meeting occurs, WSDOT
would be happy to participate.
During the January meeting we reviewed the design updates that the Washington State
Department of Transportation and Kiewit/General/Manson (KGM) have made in response to
feedback we heard from you during our last meeting, in September 2012. Recent design
updates to the noise walls and shoreline access trail include the following:
Increasing the noise wall height by up to four feet and smoothing the transitions
between wall heights.
Adding an 8-foot-tall privacy wall between the trail and the adjacent properties to
improve privacy for residents.
Helping to improve shoreline access trail user security by straightening the trail to
improve line of sight for trail users.
During the January meeting we heard feedback requesting further changes to the design of
both the noise walls and the trail. This letter provides WSDOT's responses.

Noise walls
Included with this letter as Exhibit A are graphics illustrating the updated height of noise
walls on both the north and south side of SR 520 that are consistent with the designs we
shared at the Jan. 31 meeting. As we discussed at that meeting, we increased the height of
the on -land portion of these walls by four feet as compared to the designs we shared in
September 2012. The adjusted wall heights fully comply with the Federal Highway
Administration (FHWA) and WSDOT criteria for noise mitigation.
As we discussed in January, the FHWA and WSDOT criteria require consideration of cost-
effective noise mitigation for areas of highest use outside of structures. There is no "line of
sight" criteria with respect to the inside living areas or upper floors of a residence. The
adjusted wall heights will provide noise mitigation as outlined in Chapter 5.7 of the project's
final environmental impact statement (see Exhibit B).
We have evaluated your request to further increase the height of the noise wall transition
west of the Evergreen Point Road lid and have found that increasing the height in this area
would not meet the cost criteria because the heights currently provided achieve the required
noise mitigation criteria for all receptors on the south side of SR 520 that are west of
Evergreen Point Road.
Shoreline access trail location
During the January meeting WSDOT agreed to clarify the Washington State Department of
Ecology's position on eliminating or replacing the trail and discuss the feasibility of building
an additional overlook on the north side of the regional shared use path (RSUP), which is
planned for the north side of the new SR 520 bridge.
Since that time, we've had conversations with representatives from both Ecology and
Medina regarding the approval criteria for eliminating the south -side shoreline access trail.
We have the following summary to report:
We spoke to Anthony Boscolo of Ecology and asked him to clarify Ecology's position
on the trail. He confirmed the following:
o In discussions with Medina resident Jen Garone, both he and Geoff Tallent
(Ecology) stated they would consider a permit revision if WSDOT submitted one.
This is consistent with previous conversations between Ecology and WSDOT.
o Simply eliminating the shoreline access trail on the south side of SR 520 will not
be approvable. If WSDOT proposes to eliminate the trail, then a proposal for a
new trail of equivalent or better functional value is required. While Ecology is
willing to review a revision application, WSDOT has not been able to identify an
option that would meet this test.
After speaking with Anthony, WSDOT followed up with Robert Grumbach, Medina
staff. Robert reiterated that he is in agreement with Ecology. He stated that if WSDOT

can do something that enhances the shoreline access on the north side of SR 520
beyond what has already been considered in the current permit approval, and the
enhancement is at least equivalent to what the trail on the south side offers, then
WSDOT would have a case to have a modification approved by the local hearing
examiner.
Both Robert and Anthony have stated that project plans already include shoreline
views on the north side so, to meet the burden of equivalency, WSDOT would need to
do something more than simply add a belvedere or overlook to the RSUP on the north
side of the corridor.
WSDOT also evaluated the feasibility and functional benefit of building an additional
overlook on the north side. This evaluation was based on the equivalency requirements as
stated by Ecology and Medina. We have summarized our findings below:
Although the south -side trail and viewpoint has a row of trees partially screening the
southern perspective, it still allows ample views to the west and southwest. A
viewpoint on the north side would primarily provide views of the noise wall and SR
520 roadway, and would not allow a viewshed to the southwest similar to the south -
side location.
The north -side viewpoint would provide views very similar to or the same as those
already considered and approved in the current shoreline permit. Adding an overlook
in this location would not replace the eliminated viewshed provided by the south -side
trail and viewpoint.
• The north -side viewpoint would contend with pedestrian and bicycle traffic, as well as
the bridge maintenance facility access road and stairway. The south -side trail and
viewpoint provide a user experience removed from the SR 520 roadway level and
busier RSUP, avoiding potential user conflicts and allowing a more open and peaceful
vista at the viewpoint.
Any revisions to the shoreline permits involving relocation or elimination of the currently
permitted view platform and trail would require formal approval, subject to WAC 173-27-
100. WSDOT has determined that a north -side viewpoint would not provide views
equivalent to those achieved at the south -side shoreline access trail and viewpoint, and
would not meet the requirements of WAC 173-27-100. WSDOT therefore is not seeking a
modification to the existing shoreline permit requirement.
Shoreline access trail design
In consideration of the shoreline permit requirement to build a trail, WSDOT and KGM have
worked to refine the south -side shoreline access trail to address concerns WSDOT has heard
from you about privacy and user security. We will make the following design refinements:

Construct an 8-foot-tall privacy wall between the trail and the homes to provide
privacy for the south -side residents.
Adjust the orientation of the trail and privacy wall to maximize the open area. This
will allow ample room for landscaping and increase the line -of -sight for trail users.
We believe this will create a more positive user experience and minimize the effect on
adjacent homes.
You can see Exhibit C for additional design details.
In summary, after considering all of the criteria and permit history for the south -side
shoreline access trail, WSDOT has no alternative trail option that would provide an
equivalent user experience as approved in our shoreline permit. Based on these
considerations, WSDOT is moving forward with the design and construction of the south -
side shoreline access trail with an eight -foot -tall privacy wall and improved sight lines as
illustrated in the attached drawings.

Subject: Police Department Monthly Report
Five crime reports were taken during the month of March in Medina. There were two burglaries
including one where only the garage was entered. Two similar burglaries occurred in Hunts Point
where only the garage was entered. There were three misdemeanors that included two vehicle
prowls and a malicious mischief. We continue to investigate these crimes and review camera footage
for leads. Our crime totals for the first quarter are 18, the same number as last year. Half ofour
crimes for the year (9) have been vehicle prowls.
The police department remains down one officer in addition to one officer in training. Interviews for
the vacant position will likely occur in May or June. Austin Gidlof graduated from -the Police Academy
on March 19, and is currently on a field training assignment with Officer Martin.
On March 21-5t, the police department took a large step forward on the path to state accreditation.
Assessors from the Washington State Association of Sheriffs and Police Chiefs (WASPC) reviewed our
compliance with 132 standards of professional policing required for accreditation. Assessors
inspected facilities, vehicles, records, policies and procedures, and conducted interviews with police
department staff to verify our compliance. We had no findings and no issues requiring changes in the
department's practices. The assessors report will be reviewed by the Accreditation Commission who
then makes a final recommendation to the WASPC Executive Board, The Executive Board meets in
May where they will vote on the issue and presumably confer accreditation on the Medina Police
Department.

The Medina Police Department was originally accredited in 2002 which was valid for four years and
scheduled for reaccreditation in 2005. The department received two extensions while working to
receive reaccreditation. The last extension expired in 2008 and the department has not been
accredited since.
Over the last 18 months, police department staff took on additional workload to prepare for
accreditation. Some of the significant work included implementing a completely new policy manual
that required numerous additional edits to bring us into compliance with all standards. While all staff
contributed to our efforts, our Administrative Specialist, Ms. Courtney Meyer, managed the project
and did a large percentage of the work. Our Records Manager, Ms. Linda Crum, Lieutenant Yourkoski
and Sergeant Kane also completed significant extra work to bring us into compliance with standards.
I have attached three pages from the WASPC overview document on accreditation that provides
additional information on the process and purpose of accreditation.

Accreditation
The purpose of law enforcement agency accreditation is to professionalize the law
enforcement industry by providing a review process for agencies to be certified as
operating under industry best practices and standards. In 1976 the Association was
directed by the Washington State Legislature to develop standards and goals for
Washington State Law Enforcement. The Association has maintained an operational
accreditation program since that time.
The current accreditation, program was updated in 2007 and, is continually updated as
needed. The program is' overseen by the Accreditation Committee, Accreditation
Commission, and Board of Directors. The membership wanted the program to reflect the
highest professional standards, of policing yet be financially accessible to any member
agency that desired to earn it, The main differences between previous WASPC
accreditation programs and the current program are:
1. All standards are "nave -to practices" as determined by law or a universal practice
within the profession;
2. The number of standards is less than 150 but all are mandatory for every agency;
and,
3. The dominant verification method by the on -site assessors includes the
examination of written documents, observations and interviews with the agency
employees. Assessor's review agency files for policies and 'procedures as well as
documentation showing the agency is operating under the direction of those
policies and procedures. Assessors will also interview agency members to gather
additional infbimatio-a.
The Accreditation Committee is responsible for maintaining accreditation standards,
directing assigned WASPC staff and oversight of the program. The Accreditation
Commission is responsible for reviewing accreditation on -site reports and making
recommendations to the Board of Directors on whether an agency should receive
WASPC Accreditation. The Board of Directors is responsible for conferring
accreditation.
Benefits of Accreditation Include:
• To increase public confidence in the agency;
• To increase credibility;
• To provide systemized agency self -assessment;
• To broaden perspectives;
• To intensify administrative and operational effectiveness;
• To ensure recruitment, selection, and promotion processes are fair and equitable;
• To strengthen understanding of agency policies and procedures by agency
personnel;
• To improve agency morale and pride;
• To decrease susceptibility to litigation and costly civil court settlements;

• To potentially reduce liability insurance costs;
To provide state and local recognition of professional competence.
Overview of Accreditation Process:
The Accreditation process occurs in eight phases: Interest and Contract, File
Maintenance; Self -Assessment; On -Site Assessment and Evaluation; Accreditation
Commission Review; Executive Board Review; Award; and Re -Accreditation.
In the interest and contract phase, agencies work with the Association's Director of
Professional Services to develop guidelines for the accreditation process, sip a contract,
and submit payment. The contract establishes a one year timeline for the agency to
schedule an onsite assessment. There are two types of fees associated with the WASPC
Accreditation program, application fees and on -site costs. The application fee for all
agencies is $100. On -sit, assesimentfees are related to the accreditation inspection
process once assessors arrive at an agency and are invoiced After the on -site assessment
and vary by department and availability of assessors. Agencies seeking Accreditation
agree to pay the travel costs associated with bringing in assessors from around the state
and the WASPC employees staff time needed to facilitate agency accreditation. Every
effort. is made to utilize assessors that are regionally close to the requesting agency to
help minimize these costs.
In the selfassesgm4nt phase, agencies assess their ability to meet all WASPC
Accreditation standards addressing major law enforcement areas as established by the
Association's Accreditation Committee. Major areas include emphasis on:

During the file maintenance and self -assessment phases, agencies gather proof of their
ability to meet the standards and proof of the agency's institutionalization of the
standards.
During the on -site assessment and evaluation phase, the on -site assessment team, a group
of volunteer assessors from law enforcement agencies across Washington State, confirms
the agency's ability to meet the WASPC accreditation standards. The assessors review
agency files for policies and procedures as well as documentation (proofs) showing the
agency is operating under the direction of those policies and procedures. Assessors also
interview agency members to gather additional information. As part of the WASPC on -
site process, assessors are encouraged to note areas where improvement can be made.
Suggestions for improvement are compiled in the final on -site report. If an agency is
unable to meet an accreditation standard at the time of the on -site assessment, a 60 day
extension may be requested for the agency to make appropriate changes and submit proof
to the WASPC Director of Professional Services. Dion -compliance issues must be
reconciled to the satisfaction of the Director of Professional Services before the agency's
presentation to the Accreditation Commission. An agency must resolve non-compliance
or `wet ink' issues at least 30 days prior to the Commission meeting at which the
Commission considers the agency's accreditation.
In the Accreditation Commission review Phase, the WASPC Director of Professional
Services or the on -site review team leader, the chief administrator of the agency seeking
accreditation, and the departmental accreditation manager may appear before the
Accreditation Commission for determination if they have met the standards and that the
on -site review team has done a complete job. The Accreditation Commission forwards its
recommendations to the WASPC Board of Directors for final consideration.
In the Executive Board review phase, the WASPC Executive Board reviews the
recommendations by the Accreditation Commission and issues a final decision.
In the Award phase of the accreditation process, the agency is presented with a plaque,
for successfully achieving the professional standards as outlined in the Washington
Association of Sheriffs & Police Chiefs Law Enforcement Accreditation Program.
Presentation of accreditation plaques occurs at the Association's semi-annual training
conferences. The Association also acknowledges CALEA accredited agencies as having
met the necessary standards and awards recognition to those agencies.
During the reaccreditation phase, agencies repeat the entire process. The reaccreditation
process is significantly less cumbersome if agencies institutionalize the accreditation
philosophy and keep agency policies, procedures and records up to date. To maintain
accreditation, agencies must be reaccredited every four years. For additional information
on the reaccreditation process refer to Accreditation Committee Responsibilities and
Procedures #9 on page 12.

of Overlake Drive East through an unlocked rolling door. Once inside they took a
snowboard and ransacked a work room. They also entered three unlocked vehicles
removing loose change and rummaged through all the glove boxes. Some small items
were also removed from the vehicles.

Between midnight and 7:00 am on Sunday March I e, a burglary and three vehicle
prowls occurred in the area of NE 7t' and 86 h AVE NE. These crimes occurred in the
same general area where Bellevue, Clyde Hill and Medina have seen numerous vehicle
prowls over the last several months.

A Medina Officer took a report of a Vehicle Prowl from the victim who states he locked
the door of their vehicle around 1:00 am, but the next morning he discovered the front
passenger door was ajar. It appeared the vehicle was rummaged through and only a
Bluetooth was missing. No damage to the vehicle.

900 block of 8& Ave NE
Medina officer responded to a report of graffiti tagging the substation building. The
officer noted the damage and owner had the area re -painted.

NE 24 Street and 77`h Ave NE

Sometime between midnight and 7AM this morning March 18`h, a 12 year old male went
missing from his Medina residence near NE 24`h Street and 77t' Ave. NE. There is no
indication of foul play. Michael Chang is 5'3 and weighs 120 pounds. He has brown
eyes and short black hair. He was last seen wearing blue jeans, a gray sweatshirt and
black gym shoes.

The juvenile reported missing yesterday from the area of NE 24`h Street and 77`h Ave. NE
returned home last night unharmed. We received several tips and offers of assistance

Road. These crimes are similar to crimes that occurred on March 50' and March 10th in
the Medina Heights area.

The Park Board sponsored the annual Easter Egg Hunt in Medina Park on March 30tn. Arbor
Day celebration is scheduled for April 10tn when a tree will be planted in the Medina Beach
Park at noon. All are welcome to attend to commemorate Arbor Day.
The Board has selected a new picnic shelter style they propose for installation at the
northwest side of the south pond (in the approximate location of the new picnic table on the
south side of the pathway). The shelter they propose is the "Aspen" style as manufactures by
Classic Recreation.
The Aspen Style Shelter is proposed to have 8 x 8 steel upright columns, without brick facing
or surrounding block walls.
Approval to proceed with the purchase of a shelter is in the Council packet for April 8tn

2. The Public Works Crew continues to accomplish spring preparations in the parks. The crew
completed the installation of new vertical entry sign poles at Overlake Drive East, NE 101h and
NE 241h Street entrances in preparation for the new signs to be installed this month. The old
wood entry signs will be removed and potentially donated to the Historical Society.
met with a citizen that was very concerned about litter in the City. During his walks in the
City he has been picking up litter along the streets and was seeking more litter patrol effort by
the Public Works Crew. When I explained the workload and the limited resources available for
our park and street maintenance needs, he agreed to pursue enlistment of volunteers to
assist with litter clean up. I will ask the Park Board if they would be interested in supporting
this effort.
3. Reimbursement was received from the King County Flood Control District in the amount of
$68,654 for installation costs for the Thirsty Duck flow control installation in Medina Park's
south pond outlet. The Grants coordinator indicated that the balance of the City's allocation is
currently $73,863. The coordinator also provided notice that the request for flood control
funds of $28,041 for the Medina Heights storm drain capital project has been approved by the
board.
4. Letter notices to the residents along the sidewalk replacement corridor of Evergreen Point
Road from NE 8th to Medina Beach Park has generated a number of citizen comments. All but
one of the fronting property owners are in favor of the project that will require removal of the
sweet gum trees and replacement of the asphalt pathway on the west side of the right-of-
way. Authorization to request bids for the project is in the Council Packet for April 8tn
5. The Eastside Corridor Contractors (ECC) are in the process of constructing the Evergreen Point
Lid approach slabs on the north and south sides of the crossing. Curbing is being installed
across the Lid in the final roadway alignment in preparation for the traffic shift from the
current temporary crossing to the final roadway alignment that is to be completed this
month. The private driveway connections to the roadway will be completed in mid -April prior
to the traffic shift.
Since the north side of the new final roadway alignment is within a confined space and
difficult to construct with the current temporary roadway usage, ECC proposes to utilize one-
way traffic over the Lid with flaggers on a 24 hour basis for four days to complete the final
roadway approaches. The present schedule which is weather dependent is for the shift to be
accomplished by April 22"d. A graphic showing the traffic shift and associated work area is
attached.

CALL TO ORDER
Mayor Luis called the March 11, 2013 Regular Meeting of the Medina City Council to order
at 6:30 pm and then led members of the audience, council members, and staff in the
Pledge of Allegiance.

PRESENTATION
Mayor recognized volunteer service of Judie O'Brien to the Medina Planning Commission
and noted positions are available on all the City's boards and commission and applications
are currently being accepted.
REPORTS AND ANNOUNCEMENTS
Council member Boyd said he attended a Govdelivery meeting recently and noted the City
is in the top ten percent of customers for the software service provider for subscriptions
per capita and message engagement rate. Council member Dicharry corrected statement

from last month that tolling won't be in the transportation package and latest word is there
may not be a package for this year and local options are supported by King County.
Park board chair Miles Adam provided overview of 2013 work plan.
Public works and development services directors summarized future SR 520 lid
maintenance and responded to questions concerning proposed sound walls and viewpoint
access from lid. Development services director provided a zoning code update noting a
postcard will be mailed to community this week inviting residents to attend a public hearing
during the March planning commission meeting. He also stated the department of ecology
is reviewing the City's comprehensive plan and comments are expected by April.
Public works director and police chief answered questions about graffiti noting it seems to
be located primarily on SR 520 retaining wall near Hunt's Point, and in park restrooms and
on city signs. Police chief stated drivers are becoming more accustomed to new stop signs
on Evergreen Point Road.
Public works director reported city entrance signs should be installed before next council
meeting. Mayor expressed interest in donating an old entrance sign to Eastside Historical
Society.

• March YTD 2013 Revenue & Expense Summary
• 2013 Budget Amendment A and Agenda Bill
Key Items for March YTD (Q1 Reporting) include:
Revenue:
• Property Tax is at $173K as of March YTD. Property Tax is not deposited into our account until
April/May timeframe.
• Sales Tax Revenues are at $215K as of March YTD. Annualized, the trend would give us $860K in
Sales Tax for the year. We lowered the 2013 Annual Budget to $900K for this Revenue Source.
• Real Estate Excise Taxes are $76K as of March YTD, representing only 12.3% of the Budget YTD.
• Planning and Development Revenue is at $316K as of March YTD, representing 42% of the budget for
the year.
Expense:
Key Items for 2013 Expense include:
• Expenses are in line with where they should be for Q 1 Reporting, except for the items which are
included in the 2013 Budget Amendment this month.

Summary:
Positions 3 and 7 are currently open on the Medina Planning Commission. Both are partial terms and
expire 6/30/2014. Four year terms for these positions will begin anew 7/1/2014.
Position 3 was held by David Lee from July, 2010 until he vacated it following his election to the City
Council. His term on the City Council began in November, 2011. The position has remained unfilled
since.
Position 7 was held by Judie O'Brien beginning in June, 2005 until her resignation in February, 2013.
The City received two applications for the planning commission: Randy Reeves applied 12/27/2012 and
Jen Garone applied 1/18/2013. The personnel committee interviewed the applicants on January 22 and
29, respectively, and recommends they be appointed to fill the remaining terms of Positions 3 and 7.
According to Resolution 332, recommendations must be presented to the full council at least ten days
prior to the meeting at which they are to be considered. The attached email was sent in accordance with
this rule and the original record included the applications.
If both applicants are appointed this evening, they can attend the next meeting scheduled for April 23.
Looking forward, the City is still recruiting for Positions 1(currently held by Heija Nunn) and 5 (held by
Ching -Pi Wang) which expire 06/30/2013. The incumbents have been notified and encouraged to
reapply. To date the city has one application on file for the planning commission, which was received on
April 2.

Celebrate Arbor Day
Whereas, in 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture
that a special day be set aside for the planting of trees; and
Whereas, this holiday, called Arbor Day, was first observed with the planting of more
than one million trees in Nebraska; and
Whereas, Arbor Day is now observed throughout the nation and the world; and
Whereas, trees can reduce the erosion of our precious topsoil by wind and water, cut
heating and cooling costs, moderate the temperature, clean the air, produce life-giving
oxygen, and provide habitat for wildlife; and
Whereas, trees are a renewable resource giving us paper, wood for our homes, fuel for
our fires, and beautify our community; and
Whereas, trees in our city increase property values; and
Whereas, trees, wherever they are planted, are a source of joy and spiritual renewal.

Board members discussed the upcoming Easter egg hunt. Flagg suggested that should
additional volunteers be needed, high school students seeking community service credits would
be a good resource.
2013 Work Plan (6:07 pm)
Adam suggested the following work plan modifications:
• Park board will offer input during annual parks budget planning.
• Board members will provide input to WSDOT if needed for both the Fairweather - Lid
Connection and the Lid itself.
Willis stated that he anticipates the City will be responsible for Lid maintenance once
construction is completed.
84th Ave. NE & Points Drive (6:11 pm)
In response to Flagg's inquiry about trimming the bushes at the intersection of 84th Avenue NE
and Points Drive, Willis confirmed that Clyde Hill is responsible for maintaining the right-of-way

on the east side of 84m Avenue NE. Flagg also stated concerns about the lack of visibility at the
intersection. Willis agreed he would forward her concerns to the City of Clyde Hill.
Parks Maintenance List (6:14 pm)
Board members created a list of parks maintenance tasks to be incorporated into the 2013 work
plan. The tasks are as follows:

• Replace old park maps
• Reseed bare grass areas
• Drain wet area by 82 nd Ave parking lot
• Replace older dog stations
• Remove/trim brush around the pond
• Refurbish Par Course items -more gravel -clean frames and signs
Medina Beach Park

• Place picnic table in grass area on east side of park
• Address swim area access to water across rocks
• Add "No Boating" signs to children's beach area

The board decided to postpone discussion of park assignments until all seven park board
positions have been filled.
Placement & Design of Medina Park Picnic Shelter (6:27 pm)
Willis presented drawings of picnic shelters and maps of Medina Park showing possible locations
for placement of the shelter. The board and Willis discussed the options and decided on a shelter
style and ideal site.
Resident and former park board member, Suzanne Fleming enthusiastically discussed the 1991
purchase of Dudley Carter's Windsong sculpture and the subsequent dedication ceremony. She
expressed happiness regarding the plan to shelter the sculpture from the elements. Ms. Fleming

suggested relocating Windsong prior to Medina Days. The board discussed holding a ribbon
cutting ceremony to celebrate the opening of the new picnic shelter and relocation of Windsong.

The board and Willis discussed the April 10th Arbor Day tree planting event including public
involvement; advertising; and ordering and placement of the tree.
PARK REPORTS
Medina Park (6:48 pm)
Dickmann voiced concern over kids racing around Medina Park on motorized mini bikes. She
suggested the city install signs stating that motorized vehicles are prohibited in the park. Willis
indicated that all personal motorized vehicles are forbidden in the park per city ordinance.
Dickmann reported that a recently planted tree is crooked because one of the supports came
loose.

Summary:
During 2012 budget discussions, Council considered the Park Board's request to provide a
picnic shelter in Medina Park for public use that would also provide a covering for the
"Windsong' sculpture created by famed woodcarver Dudley Carter that was donated to the City
in 1991. The approved 2013 Capital Projects Fund ear marked $40,000 for the picnic shelter.
The Park Board considered a number of picnic shelter styles and selected the "Aspen" model
shelter as manufactured by Classic Recreations with a copper color standing seam roof. The
shelter is a 16' x 16' structure with a raised mid -section roof covering that will provide additional
height for suspension of the " Windsong" sculpture. Two picnic tables will be placed under the
shelter on a concrete pad.

Summary:
The 2013 Capital Projects Fund approved by Council in November of 2012 included the asphalt
overlay of 801h Ave NE from NE 24t to NE 281h Street under the line item for Road Construction
with a budget amount of $178,000. The estimated cost for the project is $136,458. The work
includes removal of the overstressed pavement areas and asphalt pathway, installation of an
extruded concrete curb along the west side of the roadway and a new paved walkway.
When the City received notice that an application for a sidewalk grant was approved by the TIB
Board for the replacement of the asphalt pathway along the west side of Evergreen Point Road
from Medina Beach Park to NE 8th Street, I decided to join the two projects into one bid
document under separate schedules to obtain more favorable bids. The sidewalk grant amount
is $103,770. The estimated cost for the project including landscaped islands on each side of the
driveways, paving of the parking aprons, and an overlay of the existing street is $154,889.
To reduce cost for new pavement over the Public Works Yard expanded area, I also included
the paving work into the bid documents as a separate schedule. The City reserves the right to
award the different schedules to one contractor or to separate contractors.
The Public Works Director finalized the design and will solicited bids for the project in April. Bids
will be opened on April 30th with Award scheduled for May 13th

CALL FOR BIDS
CITY OF MEDINA, MEDINA, WA.
Sealed bids for the 2013 80TH Ave NE Asphalt Pavement Overlay; Evergreen Point
Road Sidewalk Improvements will be received by the City of Medina at City Hall, 501
Evergreen Point Road, PO Box 144, Medina, Washington 98039, up to 9:00 a.m. local
time on April 30 , 2013 and will then and there be opened and publicly read.
The Work is as listed below. To determine the full scope of work under the contract or
any part of it, bidders shall coordinate the applicable information in the several parts of
the Plans, Specifications, and Contract Documents.
Schedule A: 80th Avenue NE — Asphalt Pavement Overlay
(from NE 241h Street to NE 281h Street)
Asphalt Pavement Overlay generally consisting of construction of a one and one-
half -inch compacted depth of asphalt concrete overlay. The work includes: 2000
square yards of pavement removal and patching, asphalt planing, approximately
660 tons of HMA, 1200 LF of extruded cement concrete curb, new asphalt
pathway, connections to the existing driveways, traffic control, referencing and
raising of utility covers, monument cases, catch basins, and manholes to grade,
pavement markings, and other work.
Schedule B: Evergreen Point Road Sidewalk Improvement (Overlake Drive West to
NE 8t Street)
Construction of 620 Linear Feet of new 5 foot wide cement concrete sidewalk
and vertical curb and gutter. The work includes: asphalt removal, approximately
125 tons of HMA to pave parking apron, connections to the existing driveways,
extruded concrete planter construction with landscaping, traffic control, pavement
markings, and other work.
Schedule C: Medina Public Works Yard- Asphalt Pavement.
Asphalt Paving in the Public Works Equipment Yard generally consisting of the
removal of an existing asphalt thickened edge, installation of 75 tons of crushed
rock sub -base, 60 tons of new HMA, and other work.
All bid proposals shall be accompanied by a bid proposal deposit in cash, certified
check, cashier's check, or surety bond in an amount equal to five percent (5%) of the
amount of such bid proposal. Should the successful bidder fail to enter into such
contract and furnish satisfactory performance bond within the time stated in the
specifications, the bid proposal deposit shall be forfeited to the City of Medina.
The City of Medina reserves the right to reject any or all bids and to waive formalities.
If a contract is awarded, the Owner prefers to award one contract. Each Bidder by
submission of a proposal acknowledges and understands the rights reserved by the
Owner in awarding the contract and the Owner's right to award individual schedules
and/or modify the size of the project.

of Work designated on the list to be submitted with the Bid. Failure to name such
Subcontractors shall be construed that the Bidder will not use a subcontractor.

AN ORDINANCE OF THE CITY OF MEDINA AMENDING
ORDINANCE NO. 894, 2013 BUDGET
WHEREAS, the Medina City Council enacted Ordinance 894 on November 13, 2012
approving the budget for 2013; and
WHEREAS, it is necessary to increase Street Fund Revenues and Capital Fund
Revenues and Expenditures related to Public Works; and General Fund Expenditures.
WHEREAS, this ordinance has been approved at least five days after its introduction as
required by RCW 35A.33.090;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
