In lieu of a City Manager Report I would like to take this opportunity to say thank you to
staff, Council members, and Medina residents who have been so supportive to me over
the last four and a half years. We have been able to maintain our service levels and do
great things in spite of the economic downturn.
I am very proud of our Police Officers, Public Works crew, and the office staff, who work
together to provide excellent services and deliver great programs and projects. Some
of my favorites are, of course, the city hall remodel and expansion, followed by, 84th
Ave. NE improvements, entrance signs, and sidewalks. The management group is truly
a team who work closely together to solve problems without any concern about who
gets the credit.
I am moving onto (as one city manager calls it) my next phase. I don’t have any idea
what that looks like in the long run, but in the short term, I have a new library card to do
some long overdue reading and I borrowed my neighbor’s pressure washer to do some
serious home maintenance. If this doesn’t sound like much fun, it sounds like the
perfect summer to me.
Thank you again for your support and please take good care of your beautiful city and
the great staff that help run it.

Subject: Monthly Development Services Department Report
Planning Commission Meeting Recap: A public hearing was held on a Revised
Tailored Construction Mitigation Plan (File No. CMP 12-013) for the adding of an
upper deck, concrete pathway and outdoor gas fireplace to a construction project
for a new home. Public testimony was received at the hearing from a neighbor
who was concern about privacy. After deliberating on the proposal, the Planning
Commission voted to approve the revision.
The Planning Commission continued their discussion on updating the city’s official
zoning map. Staff presented a summary of the proposed changes based on the
input from the previous meeting and potential impacts from these changes. After
making a few more revisions to the proposal, there was a consensus by the
commissioners to present the revised zoning map to the public for comment and
input.
Finally, the Planning Commission continued their discussion on the
comprehensive plan amendment on streetscape. They discussed the proposed
amendment including the “sylvan nature” of the community and the sidewalks and
trails. There was a consensus to continue with moving forward on the amendment
and not wait until the state mandated review started.
The commissioners agreed that the agenda items for the Zoning Code Update
PowerPoint presentation and the briefing on the SMP would not be discussed at
this meeting.
Hearing Examiner Decisions:
The hearing examiner conducted a public hearing on a Non-administrative
Special Use Permit to replace an existing wireless communication facility,
including antennas, electronic equipment, and pole. The applicant is Verizon
Wireless. The location of the facility is at St. Thomas Church, 8320 N.E. 12th
Street. A decision is expected soon.
Land Use Administrative Decisions:
A Determination of Nonsignificance (File No. PL-13-019) was issued for the
repair and maintenance of a 100-foot linear section of an existing rock
bulkhead. The applicant is Steve Zuvela for Cascade Trust.

A Determination of Nonsignificance (File No. PL-13-020) to repair a 370-foot
linear section of an existing rock bulkhead. The applicant is Steve Zuvela for
Aspen Ventures.
A Determination of Nonsignificance (File No. PL-13-020) to redevelop a
residential property. Approximately 460 cubic yards of excavation and 400
cubic yards of fill will be imported. Utility work includes installation of 104-foot
segment of 12-inch storm drain line connecting to a stormwater outfall. The
applicant is Tracey Zheng and David Martin (Agent).
A Determination of Nonsignificance (File No. PL-13-018) to redevelop a
residential property. Approximately 277 cubic yards of earth will be excavated
and 166 cubic yards of fill material will be imported. The applicant is Ella
Sheglov (Agent).

COMMUNICATION TO OUR COMMUNITY
E-Notice Program: During the month of June, the City issued 37 bulletins amounting to a total of 11,452
bulletins emailed to subscribers; approximately 20.4% were opened. A summary is attached.
As of June 30, the city has 2,389 subscribers with a combined total of 16,929 subscriptions.
Website Hits: The attached report identifies popular hits on the City’s website pages during the month of
June.

RECORDS REQUESTS
As of June 30, 114 public records requests have been received by central services during 2013. A
total of five requests are ongoing and regular installments are being furnished. A quarterly report is
attached.
PASSPORTS
During the month of June, 30 passport applications were processed at City Hall, totaling 151 for the
year so far. Last June the City processed 43 applications for a total of 198 by June 30, 2012.
According to the US Department of State, passport applications are on the rise nationally.
Customers are continuing to receive their passports within four to six weeks from the date of
application, unless expedited service is requested to receive them sooner.
The City accepts applications by appointment only between 9 am and 3:30 pm daily.
HUMAN RESOURCES - EMPLOYEE WELLNESS COMMITTEE
The employee wellness committee met again during June to discuss the 2013 AWC WellCity
application process, wellness goals and ideas for the year. The committee will be surveying
employees soon regarding the program. A wellness event is being planned for August/September.

1. The building permit application for the Medina Park new picnic shelter was prepared and
submitted to the Development Services Department on July 3rd. The structure has been
ordered and is expected to arrive on July 17th. The Public Works crew will prepare the site for
the erection contractor and assist with the building pad construction. Following the structure
placement, a 4’ high stone veneer with cap will be placed around the steel upright support
posts. The goal is to have the shelter completed by the end of July.
2. The Evergreen Point Road Sidewalk Replacement Project began on June 7th with the removal
of the sweetgum street trees. Curbs were formed and poured on June 14th. The new sidewalk
was poured on June 18th.

Evergreen Point Road New Sidewalk Installation
The existing gravel apron fronting the homes was graded in preparation for the new asphalt
apron that is scheduled to begin next week along with the asphalt overlay of 80th Ave NE
north of NE 24th Street. The contractor, Fidalgo Paving, was responsive to the City’s request
to expedite the new Evergreen Point Road sidewalk construction in order to minimize impacts
to the summer Medina Beach Park congestion and accommodate parking needs along the
street.
The City of Bellevue waterline contractor has completed the new waterline installation on
80th Ave NE and has contracted with Fidalgo Paving to complete the final trench patching.
This will allow the final street overlay and restoration work to be accomplished by the City’s
contractor.
3. The Public Works Crew continues to maintain our parks and street margins.
o Medina Beach Park was set up for swimming and lifeguard watch.
o The Fairweather tennis courts were pressure washed.

o Damaged street signs and missing stop signs on Evergreen Point Road have been
replaced.
o Park irrigation systems were repaired.
o The maintenance shop area has been reorganized in preparation for the shop
building addition work.
o The curb stops separating the basketball practice area from the Fairweather parking
lot were painted yellow in conformance with the recommendation of the City’s
insurance carrier (WCIA) following an injury by a person playing on the practice area.
o Trees next to the tennis courts in Fairweather Park have been removed to avoid
future damage to the courts or injury to players.
o Willow tree on Overlay Drive East was pruned off the roadway and Leland Cypress
trees were trimmed on NE 28th Street.
4. Eastside Corridor Contructors (ECC) have started the construction on the new sidewalk in
front of Three Points Elementary School for the relocation of the Points Loop Trail. The new
sidewalk will connect to the sidewalk on the west side of the school and extend to 80th Ave
NE. Their work will require one-way traffic with flaggers during the work since the roadway is
narrow.
I received a quote of $11,500 from Seattle Tree preservation to remove three huge
cottonwood trees along the north side of NE 28th Street near 80th Ave NE (where ECC is in the
process of constructing the new Points Loop Trail sidewalk). I will discuss their removal with
ECC to see if they can accomplish it as part of their work to avoid City expense.

Mayor Luis called the June 10, 2013 Regular Meeting of the Medina City Council to order
at 6:30 pm and led members of the audience, council members, and staff in the Pledge of
Allegiance.

PRESENTATIONS
Lifeguard Program (6:32 pm)
Police records manager, Linda Crum, provided a presentation on the city’s lifeguard
program. She announced this year’s season is expected to begin June 19 and conclude
August 23, with hours from noon to 7 pm each day.
Ms. Crum was recognized by the city manager for her work above and beyond her role as
records manager, including her community service-oriented work such as boater safety
classes, shredder and drug take back days, collection drives for domestic violence families
and management of the lifeguard program.

PUBLIC COMMENT
Mayor read guidelines for public comment period and opened floor at 6:51 pm.
Park board chair Miles Adam made a plea to the council on behalf of the board to include
50,000 discretionary funding in the upcoming budget in order to attend to maintenance of
parks and park equipment. He also asked council to consider whether it would like the
fitness circuit in Medina Park to be refurbished or removed and expressed thanks for
installation of duck crossing signs.
Suzanne Cohen spoke on behalf of the owners’ group, Medina Neighbors on the
Waterfront (Medina Now), regarding Department of Ecology’s conditional approval of
Medina’s Shoreline Master Program and expressed the group’s support for the city’s work
plan and motions before council this evening. She commended development services
director’s work on the project and conveyed her hope the council will rule in favor of the
motions this evening.
Being no further comments, mayor closed comment period at 6:57 pm.
REPORTS AND ANNOUNCEMENTS
Mayor said he has been busy discussing upcoming elections with potential and now
current candidates for city council, and he is happy to continue to do so.
City manager summarized her report and announced another free boater safety class will
be held at city hall on June 22 and reservations are required. She said volunteers are still
needed for city boards and commissions. Council requested discussion of Medina Days
fireworks contract at June 24 study session.
Council member Phelps requested an announcement to residents about spring/summer
clean up in rights of way and asked public works director to estimate costs beside park
board chair’s request for funding in order to establish priorities.
Public works director said residents have been notified of sidewalk project on Evergreen
Point Road and parking will be available again in about two weeks.
Development services director said notice has not been posted yet on eastbound SR 520
ramp closure and mitigation plan but revision plans have been submitted.

DISCUSSION
Solid Waste Options (6:00 pm)
City manager introduced Joyce Nichols, Intergovernmental Relations, City of Bellevue. Ms.
Nichols updated council members on proposed amended and restated solid waste
Interlocal agreement with King County.
Chris Bacha, attorney with Kenyon Disend, summarized City’s current solid waste
contract. Upon council direction, Mr. Bacha will provide a letter for council to adopt at a
future meeting.
Medina Days Fireworks Contract (7:12 pm)
Following discussion, council direction was for City to continue with fireworks for Medina
Days on August 10 and to provide public works and police department services.

EXECUTIVE SESSION
Mayor recessed into executive session at 7:21 pm for an estimated time of 30 minutes
pursuant to RCW 42.30.110(1)(i) for the purpose of discussing with legal counsel
representing the agency matters relating to agency enforcement actions, or to discuss with
legal counsel representing the agency litigation or potential litigation to which the agency,
the governing body, or a member acting in an official capacity is, or is likely to become, a
party, when public knowledge regarding the discussion is likely to result in an adverse
legal or financial consequence to the agency.
Council members Boyd, Decker, Dicharry, D. Lee, Luis and Phelps; city attorneys Sand
and Bacha; attorney Bob Sterbank, Kenyon Disend; city manager; development services
director; and city clerk were present.
Executive session was extended five minutes at 7:51 pm and extended ten minutes at
7:56. Development services director departed meeting at 8:04 pm. Executive session
concluded at 8:06 pm.
CALENDAR
Council member Boyd requested a special meeting to occur June 26 or 27, depending
upon council member availability, to discuss performance of a public employee. City
attorney conveyed she would coordinate noticing efforts with the city clerk.

City Manager Search Process (6:01 pm)
Council members discussed search process for city manager. Council planned to hold an
executive session prior to its July 8 meeting to discuss qualifications of internal candidates
for acting city manager. On July 8, council plans to review draft RFP/RFQ, plans to
advertise it by July 11/12, and to receive responses by noon on July 26. Council moved
the July 22 study session to July 29 to review RFP/RFQ submittals.

Key Items for June YTD include:
2013 Revenue:
Property Tax is at $1.409M as of June YTD. Property Tax is deposited into our account during
April/May and October/November timeframes.
Sales Tax Revenues are at $433K as of June YTD. Annualized, the trend would give us $867K in Sales
Tax for the year, ($33K) lower than the 2013 Budget of $900K for the year.
Real Estate Excise Taxes (REET) are $363K as of June YTD. Annualized, the trend as of June YTD
would give us $727K in REET for the year, $107K higher than the 2013 Budget of $620K for the year.
Planning and Development Revenue is at $723K as of June YTD, which represents 97% of the annual
budget of $749K as of June YTD.
Fines, Penalties, and Traffic Infractions (Kirkland Municipal Court) Revenue is trending low at 37% for
the year at $24K for June YTD, compared to $34K for June YTD in 2012. Tickets have picked up over
the last 3 months, so we anticipate that when those revenues come in, they will improve the numbers a
bit.
Wireless Facility Leases: We received $48K in wireless lease revenue during Q2 2013. This completes
the budgeted revenue for this line item for the year, with all 2013 Revenue being received from both
wireless vendors.
2013 Expense:
Key Items for 2013 Expense include:
Legislative expenses are trending slightly higher than budget due to Jet Noise Consultant and King
County Voter Registration Fees.
Legal fees are at $135K as of June YTD, representing 84% of the Budget YTD. $95K of the YTD
expenditures are related to Special Counsel fees.
Total Expenditures (All Funds) are trending at 41% for the period of January - June.

Summary:
State law requires all municipalities to prepare and submit their planned six year
transportation improvement plans to the State Department of Transportation by July of
each year and in addition, to qualify for grant funding, each project for which funding is
requested must appear on the adopted City TIP. The attached draft plan merges the
CIP and TIP into one document for overall fiscal planning. A Public Hearing to consider
the annual plan was held on June 10, 2013.
The CIP/TIP Plan for years 2014 through 2019 was developed from street and right-of-
way improvement condition assessment, storm drainage deficiencies, public facility
evaluations, and incorporates planned improvements such as crack sealing of four
streets in 2014 to prolong the surface condition of the paved streets to by preventing
water infiltration into the sub-base that leads to pavement failures, bridge repairs, street
pavement overlays to restore street surfaces, storm drainage projects, sidewalk repairs,
and park improvements. The attached 2014 – 2019 CIP/TIP Project Summary lists the
projects by year, project scope, budget, and revenue source.
The annual expenditure for the Plan ranges from $ 560,000 to $410,000.

Summary:
Medina Municipal Code states that members of the Civil Service Commission of the City shall
be appointed by the City Manager with the approval of the City Council.
Anthony Shapiro’s six-year term in position three expired June 30. He reapplied for his position
on April 17.
Mr. Shapiro was appointed to the Commission June 12, 2007. He is a knowledgeable and
experienced member of the commission and I recommend his re-appointment to the position for
the six-year term. The term begins immediately and expires June 30, 2019.

Summary:
The personnel committee and planning commission vice chair met with three planning
commission applicants, including incumbent Heija Nunn and two new applicants Shawn
Schubring and Tim O’Hara.
The committee recommends the re-appointment of Heija Nunn to Position 1 and the
appointment of Shawn Schubring to Position 5. Position 5 was vacated by Ching -Pi Wang on
June 30. Mr. Wang did not reapply.
Positions 1 and 5 will begin immediately and expire 06/30/2017.
Tim O’Hara’s application will remain on file to be considered when filling a future vacancy.

Chair Adam called the May 20, 2013 Park Board meeting to order at 6:03 pm.

ANNOUNCEMENTS (6:03 pm)
Adam announced that the city council passed an ordinance that changed the definition of a
quorum from four board members to the majority of the board.
APPROVAL OF MINUTES
PUBLIC COMMENT (6:06 pm)
No audience in attendance therefore no public comment.
OTHER BUSINESS
Parks and Open Spaces Cleanup Day (6:06 pm)
After discussing the possibility of supporting a litter cleanup day, the board agreed time would be
better spent assisting the crew with parks maintenance tasks.
The board also requested that additional trash cans be placed in Medina Park and Fairweather
Park.
Organizing Future Easter Egg Hunts (6:14 pm)
Adam recognized Dykes for all her hard work organizing past Easter egg hunts. He also noted
that included in the agenda packet was a how-to guide she wrote for future organizers reference.
Parks Tour Discussion (6:16 pm)
Willis circulated the maintenance list and 2013 work plan for board members use while touring
the parks following the meeting. Adam stated that board members would each discuss the park
they are responsible for reporting on.

The board discussed Loren-Taylor’s inquiry about the possibility of the park board meeting mid-
afternoon rather than at 6:00 pm. Adam requested that Willis follow-up with the City Council
regarding changing the start time to 5:00 pm.
PARK REPORTS (6:25 pm)
Flagg reported there was a decrease in duck droppings on Lake Lane dock and weeds were
thick in the typical place along Indian Trail.
Adam noted that a willow tree has grown over the path leading to the View Point dock. Willis
confirmed for Adam that repairing the table and bench in View Point Park is on the crew’s
schedule.

Summary: At the June 10 council meeting, the City Council scheduled a public hearing on the
Department of Ecology’s conditional approval of the Medina Shoreline Master Program (SMP).
The purpose of the hearing is to provide an opportunity for public input in helping to shape the
development of a formal response to Ecology’s required changes.
ANALYIS OF THE REQUIRED CHANGES:
City staff and the City’s shoreline consultant reviewed and analyzed Ecology’s findings
associated with their conditional approval of the City’s SMP. A summary of our analysis can be
found in the attached document. The analysis includes an evaluation of impacts anticipated
from the changes as proposed by Ecology as well as possible proposed alternative language for
consideration when the City submits its formal response to Ecology.
As previously presented, Ecology approved Medina’s SMP with conditions for 48 required
change. The City Council accepted 11 of these changes at their June 10 council meeting.
Within the attached analysis are five items (Nos. 8, 14, 17, 34 and 43) that staff developed
proposed alternative language, which are recommended for acceptance by the City Council.
WORK PROGRAM TO DEVELOP A FORMAL RESPONSE TO ECOLOGY:
In preparing a response to Ecology’s conditional SMP approval, staff recommends creating a
small advisory committee that can assist the staff and the council as a whole in formulating the
City’s formal response to Ecology’s required changes. Depending on the level of interest to
participate, one of the following committee configurations are suggested:
Option 1: Three council members, one planning commission member, and a MedinaNow
representative (preferred);
Option 2: Three council members; or
Option 3: Variations of Option 1 or 2.
The scope of the advisory committee’s work would be limited to providing input and feedback in
developing alternatives language we want to propose to Ecology and to help educate the rest of
the council on the proposed alternatives. The committee’s purpose would not be to participate
in direct negotiations with Ecology. Also, while there will be informal discussions with Ecology,
the City’s formal response would not be submitted without approval by the City Council.
Note: committee members should be available to meet as frequently as once a week, or as little
as once a month. The goal is to formulate a formal response by the September council meeting
at the latest.

Summary:
At the June 10 council meeting the City Council provided direction to staff to add to the
proposed ordinance on the zoning code update some additional flexibility regarding property
owners’ ability to maintain an existing nonconforming condition. New language was added to
the ordinance, which is shown as underlined in the attached documents. The language is
derived from the same adopted language in the shoreline master program update. It would
allow for a nonconforming structure to be rebuilt within its existing footprint provided certain
conditions are met.
The attached documents replace the same pages in the proposed ordinance presented at the
June 10 council meeting. The complete ordinance is available on the City’s website.
It should be noted that the ordinance also authorizes the City Clerk or designee and the code
reviser to make necessary corrections to the ordinance regarding references, punctuations and
similar minor fixes that are likely to be found when Code Publishing prepares the code for
publishing.
The ordinance also provides an effective date of Monday, September 2, 2013, to give staff and
the public time to prepare for the changes.

A. This chapter applies to an amendment of the city’s official zoning map adopted pursuant5
to MMC ((17.04.010)) 20.20.020. This chapter does not apply to a site-specific6
reclassification of land that is a quasi-judicial rezone subject to ((Chapter 17.94)) MMC7
20.72.050. 8
B. The review procedures set forth in this chapter shall apply to an area-wide zoning map9
amendment: 10
1. That is consistent with and implements the land use map of the comprehensive plan; 11
and12
2. An amendment to the comprehensive plan is not required. 13
C. If an amendment to the comprehensive plan is required, the city has the option to: 14
1. Combine the area-wide zoning map amendment with the comprehensive plan15
amendment under the procedures set forth in Chapter 20.83 MMC; or16
2. Process the area-wide zoning map amendment separately from the comprehensive17

20.36.060 Nonconforming structures. 4

The following shall apply to all nonconforming structures: 6
A. Any legally established nonconforming structure may continue until such time that the7
rights for the nonconformity are abandoned pursuant to MMC 20.36.070(D). 8
B. Where multiple structures exist on the same lot, the requirements of this section shall9
apply to each structure independent of the other structure on the same lot; except where10
the nonconformity is due to exceeding the applicable structural coverage maximum, the11
requirements of this section shall apply to the combined structural coverage of all12
structures on the same lot as if they were one structure (example: a nonconforming13
structural coverage for a single-family dwelling and a detached garage would be14
considered abandoned if the total exterior walls of the single-family dwelling plus the15
exterior walls of the detached garage were demolished consistent with the threshold16
established in MMC 20.36.060(D)). 17
C. A nonconforming structure may be enlarged, expanded, extended, repaired, remodeled, 18
or structurally altered provided the work does not increase the nonconformity as19
specified in MMC 20.36.060(G), except nonconformity may be increased if: 20
1. A minor deviation is approved pursuant to Chapter 14.08 MMC to match an existing21
nonconforming setback or nonconforming height; or22
2. An intrusion into a setback, or additional structural coverage exceeding the zoning23
maximum, is determined by the City to be (i) reasonably necessary and (ii) the24
minimum necessary to improve access for elderly or disabled persons. 25
D. Except as provided for in MMC 20.36.060(F), a nonconforming structure shall be26
determined to have its nonconformity abandoned and all nonconforming rights lost27
where: 28
1. Any single-family dwelling, or any detached accessory building associated with a29
single-family dwelling, experiences substantial destruction; or30
2. A structure, not listed in MMC 20.36.060(D)(1), experiences either substantial31
destruction or reconstruction. 32
E. Where the rights to a nonconforming structure have been abandoned, continuation of33
the nonconformity shall cease and any subsequent repair, remodel, alteration, or34
rebuilding shall require the entire structure to be brought into compliance with all35
development regulations in effect. 36
F. A nonconforming structure that experiences substantial destruction or reconstruction37
may maintain the condition of nonconformity provided that: 38
1. The substantial destruction and/ or reconstruction is the result of a fire, natural39
disaster or other casualty not intentionally caused by any owner or tenant of the40
property, and a complete building permit application is filed with the City within six41
months of such fire or casualty event; or42
2. The nonconforming structure, or portion thereof, was declared to be unsafe by the43
City’s Building Official, and the property owner submits an application for a building44
permit to reconstruct within six months of said determination. 45
3. The Director may grant up to a six month extension to the time limitation set forth in46
MMC 20.36.060(F)(1) and (2) provided: 47
a. The property owner requests the extension in writing prior to the expiration of the48
time limitation; and49

b. The property owner demonstrates extenuating circumstances not of the property1
owners making that delay submission of a building permit application, such as2
resolution of an insurance claim. 3
4. In addition to the provisions set forth in MMC 20.36.060(F)(1) and (2), an existing4
single-family dwelling, accessory patio and/ or accessory deck, not complying with a5
zoning setback may experience substantial destruction or reconstruction while6
preserving the right to the existing nonconforming zoning setback provided: 7
a. The replacement dwelling, patio or deck is reconstructed within the footprint of8
the existing structure; and9
b. Any expansion of the footprint, including any addition to the dwelling, or adding a10
cover to an uncovered patio or deck, shall conform to the setbacks prescribed by11
this title; and12
c. A complete application for a building permit to construct a new dwelling, deck or13
patio is submitted within six months following substantial destruction or14
reconstruction of the structure; and15
d. A patio not requiring a building permit is replaced immediately following16
reconstruction. 17
G. A nonconforming structure that is enlarged, expanded, extended, repaired, remodeled, 18
or structural altered shall comply with the following: 19
1. All applicable development regulations including, but not limited to zoning and20
building; 21
2. The work shall not add any new structure size or area to those parts of the existing22

3. Upper level additions to a structure, where the total structural coverage on the lot the25
structure is located exceeds the maximum structural coverage allowed on the lot, are26
permitted provided: 27
a. The total footprint of the upper level including modifications does not exceed the28
maximum structural coverage prescribed for the lot; and29
b. The maximum height of the structure shall be limited as follows: 30
i. If the structure is located in the R-20, R-30 or SR-30 zone, the maximum31
height of the structure shall be the lower of 25 feet above original grade or 2832
feet above finished grade as measured pursuant to MMC 20.23.060(C); or33
ii. If the structure is located in a zone other than those set forth in MMC34
20.36.060(G)(3)(b)(i), the maximum height shall be pursuant to the height35
standards prescribed by the zone where the structure is located; 36

A. Uses and structures that did not comply with applicable development regulations in40
