Subject: Evergreen Point Road Sidewalk Improvement Project
BACKGROUND:
The Evergreen Point Road Sidewalk Replacement Project that began on June 7`h with the
removal of the street trees was followed with the removal of driveways and various planting
areas in the right-of-way and construction of the new curb & gutter and concrete sidewalk.
The existing gravel apron fronting the homes was graded and paved with new asphalt during
the asphalt overlay of the street roadway. The curbed landscape islands on each side of the
driveways were installed to prevent parking in the driveway entrances, and striping was
added to delineate the parking stalls. Landscape planting with drought tolerant shrubs and
ground cover will be installed in early October to promote better survival of the plantings with
rainy season assistance to minimize watering.

1. As everyone may already be aware, Pam Greytak's last day with the City was August 2,
2013. She has been with the City since August 2006. While she was here, she served the
public and her co-workers in a helpful and professional manner and was instrumental in
ensuring the annual holiday giving tree and food drives occurred. We wish her well with
whatever she does next.
2. Drew Blazey, with the Parks & Recreation Board reported that all went well on the August
3rd Park Beautification Day. Volunteer turnout included Park Board members and some of
their spouses plus four or five other people who turned out to help. The volunteers cleared
out blackberries and did some weeding and trimming at various points in the park.
3. Several weeks ago, the City received a report of a child playing basketball at the play area
at Fairweather being injured when the child tripped over a concrete parking stop located at
the edge of the play area. The parking stops are intended to keep vehicles out of the play
area. The incident was reported to the City's insurance carrier and the parking stops were
painted to make them more visible. It should be noted that the play area around the
basketball hoop is not designed or intended for basketball games. The play area is meant
for those who want to practice for single tennis/ or shooting basketball shots.
4. We continue to remind residents of volunteer opportunities that are currently being
advertised:
• Park Board Member
• Emergency Preparedness Committee Members
We encourage anyone who has an interest in knowing more about these positions to please
contact city hall and they will be directed to the right staff person.

Subject: Monthly Development Services Department Report
Planning Commission Meeting Recap: The Planning Commission held public
hearings on a Tailored Construction Mitigation Plan (File No. CMP 13-012) and a
Site Plan Review (File No. PL-13-015). The Tailored Construction Mitigation Plan
was for redevelopment of a residential property at 7635 NE 121h Street. The Site
Plan Review was to add a guest cottage to an existing accessory building and
construct a new teahouse at 7755 Overlake Drive W. The Planning Commission
approved each subject to conditions.
Discussion continued on the Comprehensive Plan amendment regarding
streetscape. There were varying opinions among the commissioners about the
language pertaining to trees and vegetation. The commissioners also discussed
the scope of the amendment and whether changes should be narrowly focused on
the streetscape aspects, or more broadly focused with a more comprehensive
view. The discussion was continued to the next meeting.
Hearing Examiner Decisions:
• There were no Hearing Examiner decisions in July.
Land Use Administrative Decisions:
• A Determination of Nonsignificance (File No. PL-13-021) was issued to
construct 2,163 square feet of additions to a single-family residence and
remodel portions of the interior. Site work includes excavation of up to 502
cubic yards of earth. The applicant is Dana Oliver of Overbrook Construction
(agent).
• A Determination of Nonsignificance (File No. PL-13-002) was issued to install
three boatlifts and resurface the deck of an existing pier, and construct a 51-
foot long shoring wall within a geologically hazardous area to create a
garden/yard area. The applicant is Craig Stillwell of Stillwell Hanson Architects
(Agent).

mooring piles and three dock support piles on an existing dock. The applicant

Other Items of Interest:
Comprehensive Plan Update Grant. RCW 36.70.130(5) requires the City to
review and, if needed, revise its comprehensive plan and development
regulations by June 30, 2015. To help with the review, the Department of
Commerce has reserved a grant of $10,000 to assist in completing our update
work. The funding is available from July 1, 2013 to June 30, 2015.
To receive the funds, the City must complete a GMA Update Grant Application
by September 30, 2013.

During the month of July, ten crime reports were taken in Medina including four vehicle prowls.
Vehicle prowls continue to occur in groups with three occurring the night of July 5. For the year we
have had 19 vehicle prowls compared to only six last year. With few exceptions there has been no
damage to the vehicles and little to no property has been taken. Of the 19 prowls this year, 17 of the
vehicles were left unlocked. 13 of the 19 prowls occurred in the Medina Heights area on four
separate nights with the other six prowls scattered around different parts of the city on different days.
Officers continue their random patrols given that the prowls have generally been several weeks apart
and have not followed any discernable pattern. We continue to provide crime prevention tips as part
of our E-lerts to increase awareness, encourage the locking of vehicles and homes, and the use of
alarms.
Proactive traffic contacts for the police department are up 44% year to date. Officers have been
focusing on speed complaint areas throughout the city and spending more time around the SR520
construction area.
Lifeguards continue to work at Medina Beach from noon to 7 p.m. seven days a week and their last
day is scheduled to be August 23. Weekly water quality testing has shown that the water at our beach
is safe and contaminants continue to be well below levels of concern. Extra water testing was
completed after reports of a sewage smell at the beach and the results showed the water was still
safe. The milfoil treatment of the water resulted in significantly clearer water and positive comments
from those using the beach.

Sometime between 9:00 PM on 7/5/13 and 10:00 AM 7/6/13, car prowls occurred in the
500 block of Upland Road, the 8400 block of Ridge Road, and the 7700 block of
Overlake Drive West. All of the vehicles were left unlocked and were rummaged
through. So far nothing appears to have been taken.

1. The new picnic shelter was installed in Medina Park just in time for the Medina Days
celebration. A picnic table will be installed in the shelter.

2. The Evergreen Point Road Sidewalk Replacement Project that began on June 7th with the
removal of the street trees was followed with the removal of driveways and various planting
areas in the right-of-way and construction of the new curb & gutter and concrete sidewalk.
The existing gravel apron fronting the homes was graded and paved with new asphalt during
the asphalt overlay of the street roadway. The curbed landscape islands on each side of the
driveways were installed to prevent parking in the driveway entrances, and striping was
added to delineate the parking stalls. Landscape planting with drought tolerant shrubs and
ground cover will be installed in early October to promote better survival of the plantings with
rainy season assistance to minimize watering.

Some neighbors have contacted the City with concerns about how the final design looks. The
City staff is discussing possible means for softening the parking area and we will have more
information for you at the council meeting.
I The 80th Ave NE street overlay project was accomplished following the City of Bellevue
waterline installation. The project included the removal of the asphalt thickened edge and old
asphalt walkway and replacement with extruded cement concrete curbing and a new asphalt
walkway along the west side of the street. The walkway connects NE 24th Street sidewalk with
the new Points Loop Trail currently under construction by Eastside Corridors Contractors on
NE 281h Street. This improvement completes the walk -to -school route to Three Points
Elementary School and provides a pedestrian walkway connection to the new Points Loop
Trail.
Some residents have contacted the City with concerns about the final look of the roadway.
Those concerns include the centerline striping and the asphalt walkway. The centerline
striping was placed to emphasize two directional traffic lanes. The roadway corridor serves as
a walk -to -school route and bus route and a substantial connection to the Points Loop Trail.
The former asphalt thickened edge and old asphalt pathway were not uniform in grade or
alignment. The replaced walkway provides a delineated location for pedestrians that are
separated from the traffic lane.
4. WSDOT agreed to remove the large cottonwood trees along the north side of NE 281h Street
just west of the new 80th Ave NE walkway connection to make the new Point Loop Trail safer
for pedestrians. This saved the City approximately $12,000 that was quoted by Seattle Tree
Service for their removal.

The Public Works Shop Facility building addition permit application review has caused a delay
in the call for bids for the project. The Bellevue Fire Marshal requires the building to have fire
sprinklers due to low fire flow availability. The architect has estimated this will add
approximately $85,000 to the project cost, but in the long run will improve the buildings' fire
risk and lower insurance costs. Following approval of the permit application, the project will
be ready to solicit bids.
The Public Works Crew continues to maintain our parks and street margins.
o Preparations for Medina Days included installing banners at 5 Corners and NE 24th
and on various street corner poles, garbage receptacles and sani-can disbursements.
o Completion of site work associated with the new Medina Park picnic shelter.
o The Boom Mowing was accomplished on NE 24t", NE 32nd, and along 84" Ave.

COMMUNICATION TO OUR COMMUNITY
E-Notice Program: During the month of July, the City issued 32 bulletins amounting to a total of 13,110
bulletins emailed to subscribers; approximately 22.2% were opened. A summary is attached.
As of July 31, the City has 2,385 subscribers with a combined total of 17,617 subscriptions.
Website Hits: The attached report identifies popular hits on the City's website pages during the month of
July.

RECORDS REQUESTS
As of July 31, 146 public records requests have been received by central services during 2013. A total
of five requests are ongoing and regular installments are being furnished.
PASSPORTS
During the month of July, 4 passport applications were processed at City Hall, totaling 155 for the
year so far. Last July the City processed 28 applications for a total of 226 by July 31, 2012.
The City accepts applications by appointment only between 9 am and 3:30 pm daily.
HUMAN RESOURCES
The City has removed the job announcement for the temporary administrative assistant/deputy city
clerk position and it is anticipated an announcement will be released soon for the permanent
position. Ads were placed for free on AWC and WMCA websites. The city manager job
announcement is still active on ICMA and AWC websites and applications continue to stream in. We
will soon advertise for the part-time payroll assistant vacancy.
Following the resignation of Pam Greytak, the City advertised to fill the administrative
assistant/deputy city clerk position temporarily until a permanent hire can be made. Interviews
were held the week of July 29 for the temporary position and an offer of employment was extended
to Jane Montgomery. Jane comes to Medina with years of public and private sector administrative
experience, including ten years' public service in a municipal setting. Jane's first day is August 13.
Recruitment for the permanent position will be advertised soon.
Pam Greytak was employed by the City since August, 2006. Her dedicated and efficient service will
be missed and we wish her the best in her future endeavors.
Carol Grey was hired by the City this past May to assist the finance director with payroll and other
accounting duties. Carol resigned in July. The City is preparing to advertise in order to fill this
essential position.

CALL TO ORDER
Mayor Luis called the July 8, 2013 Special Meeting of the Medina City Council to order at
6:15 pm.
EXECUTIVE SESSION
Mayor recessed into Executive Session at 6:16 pm for an estimated time of 15 minutes
pursuant to RCW 42.30.110(1)(g) to evaluate the qualifications of an applicant for public
employment or to review the performance of a public employee.
Council members Boyd, Decker, Dicharry, D. Lee, J. Lee, Luis and Phelps; city attorney
Jay Long, Kenyon Disend; and city clerk were present.
Executive session concluded at 6:30 pm.
CALL TO ORDER
Mayor Luis called the July 8, 2013 Regular Meeting of the Medina City Council to order at
6:35 pm and led members of the audience, council members, and staff in the Pledge of
Allegiance.

PRESENTATIONS
Council member Dicharry motioned to appoint Robert Grumbach as interim city manager
following departure of current city manager with a thirty -day review. Council member
Phelps seconded motion. Motion carried 7-0 a 6:39 pm. Grumbach moved to dais.
Police Chief Thomas introduced Mark Painter, Director of Professional Services,
Washington Association of Sheriffs and Police Chiefs. Mr. Painter congratulated the City
for its reaccreditation and defined the accreditation process.
Police Chief thanked department staff for its contributions to successful accreditation.
Mayor recognized two departing volunteers: Ching -Pi Wang for his service on the planning
commission and Marelaine Dykes for her service to the park board.
Mayor provided comments regarding the agreement for the mutual separation between the
city manager and the City.
PUBLIC COMMENT
Mayor read guidelines for public comment period and opened floor at 6:48 pm
Jim Girardot inquired if the dollar amount of the separation agreement can be provided. He
stated that if the city manager would have resigned there would not have been severance
and suggested hiring of new city manager be delayed until new council is seated.
Bruce Hand said it was with regret he read about the departure of the city manager in the
newspaper. He said her service as a public servant was outstanding and courageous.
Heija Nunn spoke about Medina Days and said the website and calendar of events have
been updated. She added that donations are being accepted. Ms. Nunn disclosed she
read the city manager's release agreement and said language in contract seems to be at
odds and agreed with Mr. Girardot's suggestion to delay hiring of city manager so new
council members can participate in the process.
Being no further comments, mayor closed comment period at 6:55 pm.
REPORTS AND ANNOUNCEMENTS
Planning Commission Chair, Heija Nunn, summarized current work of the commission and
encouraged residents to attend meetings and provide feedback.
Public Works Director Willis reported he requested ECC to look at potentially hazardous
cottonwood trees on NE 28th Street and remove them. He provided summaries on street
overlay project and Evergreen Point Road sidewalk project.
Police Chief Thomas reported on recent vehicle prowls in Medina Heights, said officers
are patrolling the area and all vehicles prowled were left unlocked by owners.

Interim City Manager Grumbach reported back about SR 520 proposed revisions for truck
traffic noting the planning commission will hold a public hearing concerning the matter. He
conveyed WSDOT will hold a presentation on the viewpoint trail platform in the council
chambers on the Monday, July 15, at 1:00 pm.
CONSENT AGENDA
Council member J. Lee expressed she was unable to attend the June 26 meeting and
would like to have her vote concerning the city manager separation agreement reflected in
the record. J. Lee added she agreed with the resignation and separation agreement but
did not agree to the terms of the agreement and her vote would reflect a nay.

Grumbach summarized timeline, highlighted efforts to date, and proposed actions
requested of council this evening.
Mayor opened floor to public comment at 7:14 pm.
Steve Burnstead expressed property owners' rights must be taken into consideration and
he would like to continue his participation in process moving forward. He said land use
attorney Aaron Laing is currently funded by Medina NOW and suggested he could
possibly assist the City with this matter as it advances ahead.
Murray Sargent said he did not understand maintenance of existing structures, for
example bollards under item 29, He said bollards are essential to his property and
grandfather clause does not seem fair.
Suzanne Cohen complimented Grumbach on his work thus far and noted this is not forum
to determine final items, rather details must be studied at greater length. Ms. Cohen
named several items as examples which require additional review and urged council to

accept proposal to form an ad -hoc committee to review these items. She said items 17, 34
are of concern and require further study.
Colin Radford thanked Grumbach for his efforts to make document readable, supports
energies of Medina NOW, and echoes Ms. Cohen's requests. Mr. Radford pointed out
areas of disputable language in document.
Bob Rudolph explained some of Ecology's proposals are capricious and arbitrary and
hopes the City will challenge these. He expressed support for the committee to review
further.
Heija Nunn suggested council consider hiring a consultant to advocate on behalf of the
City with the Department of Ecology.
Jim Girardot commented he is interested in property owner rights and to work for all
citizens, not just waterfront property owners.
Chandau Chauhau reported Lake Washington facts he read from Wikipedia and said it is
in everyone's interest to make lake viable. He expressed this should be a partnership
effort rather than an individual one, and to listen to those who spoke before him.

City Council Aqenda Calendar (8:02 pm)
Study session date changed from July 29 to July 22 and the agenda will include city
manager search and 2014 Budget. Dicharry and D. Lee said they would not be able to
attend.
Aviation Discussion (8.25 pm)
Council member Decker asked why the City would monitor flight paths if its consultant
might not have any influence on the FAA and perhaps the City is wasting its resources.
Discussion followed.

mayor subsequently closed it.

Mayor Luis called the July 16, 2013 Special Meeting of the Medina City Council to order at
2:02 pm.

PRESENTATIONS
Bob Murray, Bob Murray and Associates (in person); Dennis Taylor, Slavin Management
Consultants (by telephone), and John Darrington, Colin Baenziger & Associates (by
telephone) presented an overview of their professional services for managing the City's
city manager recruitment.
Council member Boyd conveyed former Bellevue city manager, Steve Sarkozy, contacted
him and shared he may potentially be interested in the vacant position. Council discussion
followed.

Mayor Luis called the July 22, 2013 Special Meeting of the Medina City Council to order at
6:01 pm.

Lee, Michael Luis, and Katie Phelps
City Council Members Absent: Doug Dicharry (excused), and David Lee (excused)
City Staff Present: Robert Grumbach, Interim City Manager; Kari Sand, City
Attorney, Kenyon Disend (arrived at 6:38 pm); Mark
Thomas, Police Chief; Nancy Adams, Finance Director;

Council member Phelps motioned to excuse absences of council members Doug Dicharry
and David Lee and council member Janie Lee seconded motion. Motion carried 4-0
(Decker had not yet arrived) at 6:02 pm.
DISCUSSION
2013 & 2014 Annual Budget Discussion/Planning (6:03 pm)
Finance director provided overview of 2013 budget and forecast leading into 2014. Budget
calendar distributed. Public hearing scheduled for August 12. Council discussion occurred.
City Manager Recruitment Services Agreement/Contract (7:00 pm)
Council discussed interviews held last week and reviewed proposal submitted by Colin
Baenziger & Associates. Council scheduled action for August 12.
EXECUTIVE SESSION
Mayor recessed into Executive Session at 7:12 pm for an estimated time of 20 minutes
pursuant to RCW 42.30.110 (1)(g) to evaluate the qualifications of an applicant for public
employment or to review the performance of a public employee.
Council members Boyd, Decker, J. Lee, Luis and Phelps; city attorney; interim city
manager; and city clerk were present.

Key Items for July YTD include:
2013 Revenue:
Please note that the July Revenue & Expense Summary report has a new column which provides estimated
Year-to-date Budget as of the current month. This provides for anomalies in operations activity, for items
which occur outside of the normal once per month scenario.
• General Revenue:
• Property Tax is at $1.3M as of July YTD. There was a Property Tax adjustment of ($90K)
that lowered deposits for June. July YTD numbers are slightly lower than June as a result.
• Sales Tax Revenues are at $520K as of July YTD. Annualized, the trend would give us
$891 K in Sales Tax for the year, ($9K) lower than the 2013 Budget of $900K for the year.
• Intergovernmental Revenue is low due to timing of Hunts Point invoicing and payments.
■ Planning and Development Revenue is at $814K as of July YTD, which exceeds the annual
budget of $749K by $65K.
■ Fines, Penalties, and Traffic Infractions (Kirkland Municipal Court) Revenue is trending low
at 43% for the year at $28K for July YTD, compared to $39K for July YTD in 2012.
• Wireless Facility Leases: Receipt of $48K in wireless lease revenue during Q2 2013
completes the budgeted revenue for this line item for the year. WA State receives 12.84%
of the revenue, which is reported in Other Revenue as a pass through (in/out).
Street Revenue:
■ We received $128K in July for the Nat'l Pollution Discharge Elimination Grant, which pays
for storm system mapping, aerial photos, catch basins, etc.
Capital Revenue:
• Real Estate Excise Taxes (BEET) are $425K as of July YTD. Annualized, the trend as of
July YTD would give us $729K in BEET for the year against a budget of $620K.
■ TIB and Flood Control Grants will be reduced by ($36K) and ($28K) respectively in 2013.
■ King Co. Conservation and Storm water Revenues of $53K have not come in yet (timing).
2013 Expense:
Key Items for 2013 Expense include:
• Legislative expenses are trending slightly higher than budget due to Jet Noise Consultant and King
County Voter Registration Fees.
• Legal fees are at $155K as of July YTD, representing 97% of the Budget YTD. $101 K of the YTD
expenditures are related to Special Counsel fees.
Total Expenditures (All Funds) are trending at 48% for the period of January -July.
Public Hearing:
An electronic copy of the 2013 Budget will be made available on the City website for reference as we move
into development of the 2014 Budget.

A change to Medina Municipal Code 10.40.020 is necessary as several parking violations are
not currently addressed in the Municipal Code. In the past, infractions were written under the
Revised Code of Washington (RCW). State law only allows for a $20 fine for parking violations
written under the RCW. The court charges $30 for the filing of each parking ticket creating a
loss of $10 to the City for each violation written. The changes essentially incorporate the
violations listed in the RCW into one Municipal code with a fine amount of $45.
The amended 10.40.020 includes the violation contained in 10.40.061 allowing for its repeal.

WASHINGTON, AMENDING CHAPTER 10.40 OF THE
MEDINA MUNICIPAL CODE BY AMENDING SECTION
10.40.020 RELATED TO PARKING INFRACTIONS AND BY
REPEALING SECTION 10.40.061 IN ITS ENTIRETY
WHEREAS, the Medina Municipal Code provides for penalties only for limited parking
violations; and
WHEREAS, the City Council desires to establish additional parking violations and
penalties for the general health, welfare and safety of the citizens;
NOW THEREFORE, THE CITY COUNCIL, OF THE CITY OF MEDINA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Section 10.40.020 Amended. Section 10.40.020 of the Medina Municipal
Code is hereby amended (with legislative revision marks) to read as follows:
10.40.020

with law or the directions of a police officer or official traffic control device no

a. On the roadway side of any vehicle stomped or parked at the edge or
Curb of a street;
b. On a sidewalk or street planting strip
c. Within an intersection;
d. On a crosswalk;
e. Between a safety zone and the adjacent curb or within thirty feet of
points on the curb immediately pposite the ends of a safety zone
unless official sins or markings indicate a different no -parking area
opposite the ends of a safety zone;
f. Alongside or opposite any street excavation or obstruction when
stopping standing or parking would obstruct traffic;
g. Upon any bridge or other elevated structure upon a hi�-Yhway;

h. In the area between roadways of a divided highway including
crossovers;
i. At any place where official signs prohibit stoppin • or
1. Within a private land in such a manner or under such conditions as to

2. Stand or park a vehicle whether occupied or not except momentarily to

B. Parking or standing shall be permitted in the manner provided by law at all
other places except a time limit may be imposed or parking restricted at other
places, but such limitation and restriction shall be by city ordinance or county
resolution or order of the secretary of transportation upon highways under their
respective jurisdictions.
C. No person shall move a vehicle not lawfully under his or her control into any
such prohibited area or away from a curb such a distance as is unlawful
D. It shall be unlawful for any person to reserve or attempt to reserve any portion
of a highway for the purpose of stopping standing or parking to the exclusion of
any other like person nor shall any person be granted such right
Section 2. Section 10.40 061 Repealed. Section 10.40.061 of the Medina Municipal
Code is hereby repealed in its entirety.
Section 3. Severability. If any section, sentence, clause, or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity
or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase
of this ordinance.
Section 4. Effective Date. This ordinance shall be published in the official newspaper
of the City, and shall take effect and be in full force five (5) days after the date of publication.

Summary: With the Administrative Assistant -Deputy City Clerk position opening, management
is evaluating the work assignments of the people working the City Hall front counter. In order to
complete this evaluation and to ensure the skills of the next Administrative Assistant -Deputy
City Clerk fits the needs of the organization, a temporary employee is being hired to fill the
position until a permanent employee can be hired.
The Local Union No. 763 Agreement, under which the Administrative Assistant -Deputy City
Clerk is subject to, does not contain contract language pertaining to temporary employees. As a
result, Article IV, Paragraph 4.1 requires employees covered by the Agreement to join the union
not later than 30 days from their date of employment subject to the options in the Agreement to
opt out. This includes temporary employees performing work covered by the Agreement.
Management discussed the temporary hire with the Union and requested a one-time 90-day
suspension of this provision. The language for this suspension is set forth in the attached
Memorandum of Understanding. In order for the language to go into effect, both the Local 763
union membership and the City Council must approve the attached Memorandum of
Understanding. The attached Memorandum of Understanding has been approved by the Local
763 union membership.

It is understood and agreed, the CITY OF MEDINA, WASHINGTON ("Employer") and
PUBLIC, PROFESSIONAL & OFFICE -CLERICAL EMPLOYEES AND DRIVERS,
TEAMSTERS LOCAL UNION NO. 763 ("Union" or "Teamsters") affiliated with the
International Brotherhood of Teamsters, enter into the following Agreement modifying the
current (,January 1, 2012 through December 31, 2014) Collective Bargaining Agreement
("CBA") for the purpose of addressing the Employer's requr,st to hire a short-term, temporary
individual to fill the soon -to -be vacant administrative assistant/deputy clerk position as fellows:
Whereas, the Teamsters' member who is currently in the administrative assistant/deputy clerk
position has offered her resignation effective August 2, 2013;
Whereas the Employer believes the position must be filled because the essential functions are
critical to the operation of the agency;
Whereas the Employer believes that other feamster members/City employees have fully utilized
positions and are unable to temporarily perform the duties ofthe administrative assistant/deputy
clerk position;
Whereas the Employer recognizes the Union as the exclusive bargaining representative for all
employees in the bargaining unit and all positions contained in Appendix A of the current CRA-,
Whereas per Article 4, the current CRA states the following:
Section 4.1 Employees covered by the Agreement shall be required as a condition of
employment, not later than thirty (30) days following ratification of this
Agreement or their- date of employment, whichever is later, to become and
remain members in good standing in the Union during the term of this
Agreement, except as provided as follows:
if an employee does not desire to become a member of the Union, the
employee shall either:
(a) Pay each month an agency fee equal to the amount of dues to the
Union for the administration of the contract; or
(b) Pay each month an amount of money equivalent to regular current
Union dues to a charity that is atrreeable to the Union and to the
employee.

Whereas the Employer has requested a one-time 90 day suspension of the above contract
language (Section 4.1 only) to allow an opportunity to:
(a) Review, update and. if changes are made, negotiate the effect of any change made to the
job description for the position of administrative assistant/deputy clerk;
(b) Post/advertise the stated vacancy (see "a"):
(c) Interview and hire for the vacant administrative assistant/deputy clerk position.
Whereas the temporary 90 day suspension period begin and end dates will be mutually agreed to
between both parties;
Therefore, let it be resolved that if the 90 day suspension period expires before the Employer
completes the work described above, the current contract language contained in Section 4.1 will
supersede, supplant, and/or set aside this Memorandum of Understanding.
Whereas nothing contained in this Memorandum of Understanding deletes, negates, or otherwise
changes any Article or Section in the current CBA between the two parties.

Summary: In April 1995, the Eastside Transportation Partnership (ETP) revised its voting
structure and allowed the Points Communities to become members on a joint basis. The
Mayors of Beaux Arts and Medina served as the initial Points Community ETP delegates.
Currently, the Mayors from Yarrow Point and Clyde Hill are the Points Community delegates.
Two other Points Community mayors serve as alternate representatives. The purpose of the
ETP is to "provide a central forum for information sharing, consensus building, and coordination
to resolve transportation issues."
The ETP group has functioned as a recommendation body to provide the Puget Sound Regional
Council (PSRC) with recommendations on specific transportation projects from an Eastside
perspective. The PSRC is empowered to arrive at a Metropolitan Transportation Plan that
serves as our region's Transportation Improvement Plan. This metropolitan plan is necessary to
receive federal grant money. The ETP also discusses and provides its opinions on other
transportation issues like the regional transit plan and the SR-520 project/tolling.
The existing Interlocal Agreement is set to expire at the end of the year. The attached Interlocal
Agreement will extend Medina's participation in ETP through December 31, 2015, with an option
to extend beyond to December 31, 2017.

Attached is the new Eastside Transportation Partnership Agreement, which was approved by the
Partnership on July 12, 2013. This agreement, as well as the agreements for the South County
Area Transportation Board (SCATBd) and the Seashore Transportation Forum, was developed by
a joint committee composed of the chairs and vice chairs of all three King County Transportation
Boards. The changes are intended to streamline the agreements and the approval process, allow
each board to tailor procedural items as needed, and reflect the reduced King County staffing
levels in the adopted 2013-2014 King County budget. Highlights of the proposed changes include
the following:
• Signatories to the agreement will no longer include agencies and organizations, or
jurisdictions not in King County.
• Subsequent to adoption of the Agreement, each board will now adopt their own individual
procedures that will identify agencies and organizations, and jurisdictions not in King
County, as limited voting members or non -voting members.
• The language has been simplified and updated from the prior agreement.
• The agreement is for a two-year period with an automatic two-year extension.
As a member of ETP, we are sending this to you to request approval by your city council.
Because the current agreement expires at the end of this year, we hope to obtain approval by all
cities this summer so that final approval by the King County Council can occur this fall. We
would appreciate your prompt action on this.
Following your city's approval, please transmit the signed agreement to Wes Edwards, King
County Department of Transportation, 201 S. Jackson Street, Seattle, WA 98104, or provide an
electronic signature via email to wesley.edwards@kingcounty.gov. The signed agreement will

as follows:
1.0 Purpose of this Agreement
The purpose of this Agreement is to recognize the Eastside Transportation Partnership as the
transportation board for the area East of Lake Washington in. King County to share information, build
consensus, and provide advice on plans, programs, policies and priorities for countywide, regional, state,
and federal transportation decisions.
2.0 Members and Voting
Members shall have full voting rights, limited voting rights or shall be non -voting members, as follows:
2.1 Members with Full Voting Rights: Only jurisdictions which are signatories to this agreement
shall have full voting rights on all of the following issues before the Eastside "Transportation Partnership,
unless otherwise noted, including:
1. Administrative issues, such additional members and use of dues.
2. Recommmendations to Sound Transit on policies and capital and service plans and
implementation.
3. Recommendations to King County on Metro Transit planning, development and implementation
of products and services.
4. Identification of projects for the regional competition, if prescribed by the process approved by
the King County caucus of the Transportation Policy Board.
5. Recommendations to WSDOT on policies, programs and projects.
6. Recommendations to the PSRC on plans, policies, programs and projects such as Transportation
2040 updates and regional funding policies, strategies or programs.
7. Input to the State Legislature and committees and con nissions established by the Legislature on
transportation policy, budget and priorities and legislative proposals and studies.
8. Recommendations to the federal delegation on federal legislation including reauthorization and
funding priorities and other transportation -related programs.
2.2 Members with Limited Voting Rights: The Eastside 'Transportation Partnership may add members

3.2 Elected officials shall be appointed to the Eastside Transportation Partnership by their cities and
counties for a one-year term. King County representation shall be a maximum. of two Councilmembers
and the King County Executive.
3.3 Each city or county participating member may appoint an alternate for a one-year term.
Designated alternates may vote in place of designated voting representatives in the absence of the
designated representative.
4.0 Operating Procedures
4.1 The Eastside Transportation Partnership shall adopt operating procedures to specify limited voting
members and non -voting members, if any, dues for limited and non -voting members, if any, and
operational issues such as election of officers, formation of subcommittees and rules of order. A chair(s)
and vice -chairs) shall be elected per the operating procedures and shall be responsible for setting
meeting agendas, running meetings and any other activities identified in the operating procedures

5.1 King County will be the Lead Agency for receipt and disbursement of funds collected through
annual dues, and general administrative and program support for the Eastside Transportation
Partnership. King County assumes wage and benefit costs of its staff performing Lead Agency
responsibilities to the extent that King County appropriates such lands. The Lead Agency shall, in its
sole discretion, determine the level of staffing available based upon funding.
5.2 Lead Agency responsibilities may be limited to: maintaining Eastside Transportation Partnership
membership rosters and distribution lists; arranging for Partnership meetings, including scheduling,
agendas and rooms; collecting, administering and disbursing Partnership dues; providing Partnership
meeting support to the chair(s) and vice chair(s); attending Partnership meetings; and preparing
Partnership meeting summaries.
6.0 Financing and Cost Sharing Guidelines
6.1 Yearly Dues: The Eastside Transportation Partnership members shall pay a minimum $100 per
full voting representative in annual dues to remain in good standing. The Lead Agency will bill annually
at the end of each year, and dues are to be paid within ninety days after receipt of the invoice. Members
not in good standing shall lose voting rights until the required dues are paid. Additional dues above
$100, and any dues required by limited or non -voting members, will be determined by the Eastside
Transportation Partnership and included in the operating procedures. Revenue from dues shall be used
for special events, public education, or other expenses authorized by the Eastside Transportation
Partnership. The designated Lead Agency shall not be required to pay yearly dues.
6.2 Annual Review of Nnancing: The Eastside Transportation Partnership shall determine by June
30 of each year whether additional annual dues above $100 per voting representative will be required of
the Eastside Transportation Partnership member jurisdictions for the following year.
6.3 Additional financial contributions: If additional financial contributions beyond an increase in
dues are determined to be necessary, costs shall be shared annong all voting members, with an option for
King County to recuse itself from further financial obligations. Recused members may not vote on
determining the additional financial contribution or uses for the additional funds.
6.4 Modification to Agreement Required: If additional. funds are determined to be necessary, a
modification to this agreement specifying cost -sharing, purpose, scope of work, administration,
collection and disbursement of fiends and other details is required. in order to obligate a member
jurisdiction to funding participation.
7.0 Withdrawal of a Party from this Agreement
Each party, for its convenience and without cause or for any reason whatsoever, may withdraw from
participation in this Agreement by providing written notice, sent certified mail, return receipt required,
to the chair(s) of the Eastside Transportation Partnership at least thirty (30) days in advance of the
effective date of the withdrawal. A withdrawing party shall not be entitled to a refund of any payments
to Eastside Transportation Partnership and shall pay any dues required to be paid under this Agreement
for costs which had been obligated prior to the effective date of the withdrawal. All obligations other
than dues cease upon withdrawal.

Eastside Transportation Partnership Agreement: Authorized by ETP on July 12, 2013 for transmittal to members
Each parry's funding to perform its obligations under the Agreement, beyond the current appropriation
year, is conditional upon appropriation by the parry's governing body. Should such an appropriation not
be approved for a future year, a party may exercise its right to withdraw from the Agreement.
8.0 Duration
This Agreement shall take effect upon being duly adopted by the governing bodies of all parties and
executed by the authorized representatives of all parties. This Agreement shall remain in effect until
December 31, 2015, unless terminated earlier in accordance with Section 9.0. This Agreement shall be
automatically extended upon the same tenns or conditions for another tern commencing January 1,
2016 and ending no later than December 31, 2017.
9.0 Termination
All parties to this Agreement must agree to terminate this Agreernent in order for such termination to be
effective. If all parties desire to terminate this Agreement, they shall execute a Statement of
Termination. Upon termination, no party shall be required to make any additional contributions. Any
remaining funds shall be refunded to the parties to this Agreement according to Section 11.0.
10.0 Real and Personal Property
The acquisition of real property is not anticipated under this Agreement. Any personal property acquired
pursuant to this Agreement shall be held by the Lead Agency. In the event this Agreement expires or is
terminated in accordance with Section 8.0 or 9.0, any personal property other than cash shall remain
with the Lead Agency.
11.0 Return of Funds
At such time as this Agreement expires without being terminated or revised, or is terminated in
accordance with Section 9.0, any unexpended and uncommitted fiends shall be distributed
proportionately to those parties to this Agreement at the time of ternination based on each party's
percentage share of the total balance at the time of termination.
12.0 Filing
This Agreement shall be filed with the King County Department of Records and Elections.
13.0 Legal Relations
13.1 The parties shall comply with all applicable state and federal laws and regulations.
13.2 This Agreement is solely for the benefit of the parties hereto and gives no right to any other
party. No joint venture or partnership is formed as a result of this Agreement. No employees or agents
of one party or any of its contractors or subcontractors shall be deemed, or represent themselves to be,
employees of any other party.
13.3 Each party shall defend, indemnify and hold harmless the other party and all of its officials,
employees, principals and agents from all claims, demands, suits, actions, and liability of any kind
whatsoever which arise out of, are connected with, or are incident to any negligent acts of the first party,

Eastside Transportation Partnership Agreement: Authorized by ETP on July 12, 2013 for transmittal to members
its contractor, and/or employees, agents, and representatives in performing the first party's obligations
under this Agreement. The parties agree that their obligations under this paragraph extend to claims
made against one party by the other party's own employees. For this purpose, the parties, by mutual
negotiation, hereby waive any immunity that, as respects the other party only, would otherwise be
available against such claims under the industrial insurance provisions of RCW Title 51. In the event
either party incurs attorney's fees, costs or other legal expenses to enforce the provisions of this section,
against the other party, all such fees, costs and expenses shall be recoverable by the prevailing party.
13.4 The provisions of this section shall survive and remain applicable to each of the parties
notwithstanding any termination or expiration of this Agreement and notwithstanding a party's
withdrawal from this Agreement.
14.0 Entirety and Modifications
14.1 This Agreement merges and supersedes all prior negotiations, representations and agreements
between the parties relating to the subject matter hereof and constitutes the entire agreement between the
parties.
14.2 This Agreement may be modified only by ATitten instrument signed by all the parties hereto.
15.0 Counterparts
The signature pages of this Agreement may be executed in any number of counterparts, each of which
shall be an original.

The Park Board has discussed moving the regular scheduled Park Board meeting time that
occurs on the third Monday of each month to an earlier time frame to accommodate Board
members and Staff time demands. The proposal to change the meeting time was first
introduced during the May 201h Park Board meeting and formalized by a motion of the Board on
June 171h to propose a change of the meeting time to 5:00 p.m. to the City Council for approval.

WHEREAS, the Medina Municipal Code provides that meetings times of the Parks and
Recreation Board shall commence at 6:00 p.m.; and
WHEREAS, the City desires to amend the meeting time to commence at 5:00 p.m.;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Subsection 2.40.030(D) Amended. Subsection 2.40.030(D) of the Medina
Municipal Code is hereby amended to read as follows:
D. Time. The regular meeting of the parks and recreation board will be held on
the third Monday of each month, commencing at 5:00 p.m.
Section 2. Severability. If any section, sentence, clause, or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity
or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase
of this ordinance.
Section 3. Effective Date. This ordinance shall be published in the official
newspaper of the City, and shall take effect and be in full force five (5) days after the date of
publication.

Announcements
Councilmember and volunteer Dicharry announced that the Seattle Emergency
Communications Hubs will be exercising, simulating the Christchurch Earthquake event on
Saturday May 11th, from 9:00 a.m. to noon. The Emergency Communication Hubs are
locations around the Seattle area which have been designated by neighborhood leaders and
volunteers as community gathering sites if a major disaster makes it impossible to get
information and help in the usual ways. Dicharry suggested that those interested might like
to take a field trip to further explore these groups.
Communications
Humphreys reported that all was going well with the weekly check- ins and the new radios.
Sultan familiarized the group with digital computer equipment that he had set up in the
council chambers. He explained that the small computer was capable of sending and
receiving data. His suggestion was for one or two people on each block to obtain the
inexpensive routers which would give them a local, battery- run, intranet for use at time of
disaster. It was decided that the group would do some preliminary testing and report at the
next meeting.

Medical
Koelemay reported that some of the medical supplies are either expiring or have already
expired. She said that it has been decided to keep some of the expired IV fluids for
irrigation. She noted that the goal of the medical group would be to offer first aid and basic
stabilization, during time of disaster.
Discussion followed regarding the Vial of LIFE (Lifesaving Information For Emergencies) the
joint effort of Medic 1 and Bartell Drugs, to alert emergency responders to personal medical
information. Purchase of a number of the vials for distribution is being considered.
Koelemay announced that she, Dicharry and Finnigan would be attending a medical
committee meeting on April 25'h, at Mercer Island. Also in attendance would be Vashon
Island. Koelemay will report back on the meeting in July.
Medina Days
Koelemay also announced that there will be a Medina Days planning meeting the third week
of May. She indicated that a concept being explored is that of the Zombie Apocalypse.
Discussion followed regarding the scavenger hunt and the idea going forward is to base the
hunt on older kids' phone's abilities.
Emeraencv Preparedness Calendars
Emergency Preparedness Calendars, assembled by Clackamas County Oregon Department
of Emergency Management were shown and discussed. It was decided that $100 in value of
these calendars will be purchased and advertised to the public as being available free of
charge until they are all distributed — sometime in the fall of 2013. Finnigan will work with the
county regarding information specific to the City of Medina that will appear on the back of the
calendars.
Town of Hunts Point
Bruce Swenson, Town of Hunts Point, reported that their communications group now had
three channels. He said that their frer�uency is "3" and that "2" is back up. He announced
that they will be exercising on May 17' and obtaining new equipment in the fall.
Swenson also related that Hunts Point had purchased medical supplies recently. He noted
that they had combined their Block Watch Program with the Map Your Neighborhood
Program.

The next Medina Emergency Committee Meeting was scheduled for Tuesday, July 16, 2013,
at 6:00 p.m. The meeting adjourned at 7:50 p.m.

Summary: Pursuant to RCW 35A.13.010, the City Council appoints the City Manager in a
council-manager plan of local government. The City Manager serves as the chief executive
officer and head of the administrative branch of the city government.
The City Council interviewed three search firms to help in the search for a new City Manager
and expressed a preference for Colin Baenziger & Associates. John Darrington would be
responsible for the search for candidates. He is available to assist the City starting August 19,
2013. This would be the latest start date to ensure the hiring process can be completed before
the end of the year.
Colin Baenziger & Associates charges a fixed fee of $22,500 for their services. However, they
indicated a willingness to offer a modified fix fee of $19,950 for lesser services. The difference
with the lesser services is that Colin Baenziger & Associates would not participate in the
interview process and would offer only minimal support during this phase of the process. It
would be the City's responsibility to prepare, coordinate and conduct the interviews.
PRICE OPTION 1: $22,500 for full services.
PRICE OPTION 2: $19,950 City responsible for planning, coordinating, and conducting
interview process.
Note: If the City Council wishes to have further discussions before hiring a City Manager
Recruiter, it is recommended to wait on making a motion to take any actions.

Below I have outlined Colin Baenziger & Associates' standard pricing and an alternative.
Standard Process and Fee Schedule
CB&A offers a firm, fixed fee of $22,500 which includes all our expenses and costs. In other
words, the only thing the City will pay CB&A is the agreed upon fee. The only other costs the
City will be responsible for are the costs associated with the candidates' (and spouses, if invited)
travel, accommodations and meals for the interview process. The advantage to the City is it
knows exactly what it will pay. The advantage to CB&A is that we do not have keep track of
every minor expense.
We will bill the fee as the phases are completed and according to the following schedule:

We understand the City has asked if any overlap exists with what we are doing for Bellevue and
if it could save some money if it did some of the work itself.
To answer the first question, some overlap does exist but it is not enormous. Already having
developed an understanding of the area does help with the Phase L Still, Medina is considerably
different from Bellevue. Thus the description of the community, its government, its challenges
and what it is looking for in the ideal candidate will be different. The candidates we will recruit
for
City Manager - Process and Pricing Options
Bellevue will also be different from those we are seeking for Medina'. Hence, we do not
anticipate any overlap in terms of candidate screening.
To answer the second question, it is not absolutely critical for us to be present for the interviews.
Instead, we can make suggestions and advise from afar. We do generally play some role since
we will have established a relationship with the finalists in the initial phases and they will
continue to consult us. The same is true of the negotiations'.
All in all, we are comfortable offering the following modified pricing schedule to the City. The
total remains a firm, fixed price.

1. Even if we find the two cities are seeking candidates with the same skills, demeanor, etc.,
Bellevue is likely to pay a higher salary and hence attract different candidates.
2. Assistance will be minimal and provided by telephone. Additionally, if the City accepts
the schedule we proposed, we will have a representative in the area during the Medina
interviews and selection. This individual will be able to provide some emergency on -site
assistance if needed.
