Projects included:  Weeding Around Playground Paths  Replacing Tennis Court Chain Link Fence Tie-Downs (Bottom of Fence)  Weeding Tree Wells  Weeding and Trimming Shrubs at the “Five Corner” Park Entrance  Removing Blackberry Bushes from around the Pond and the 12th Street Parking Lot Overtime for Private Events - Apparently the simple concept…City overtime costs for private events should not be passed on to the taxpayers…really struck a chord. The City has received a great deal of positive feedback from around the State and across the country. For the record…President Obama’s July 22, 2014 visit to Hunt’s Point generated $1,295.72 in Police overtime. The City of Clyde Hill also provided Police Officers for the event and may also submit a bill for their Officer’s overtime. WSDOT Tour of the 520 Project – Last month the Department of Transportation arranged for the City Council and staff to tour the 520 Bridge and Lid Projects. We are hoping to arrange another tour later this year. Medina Days 2014 – I would like to publicly thank our Police Department, Public Works maintenance team, and all of the volunteers who made this event such a huge success. The victim reported a large amount of money was transferred from the checking account to the credit card account. No monetary loss to the victim, and the accounts were closed immediately. Fraud 2014-0003054 07/21/14 The victim reported a roommate was given permission to use a credit card for a single purchase. Soon the victim discovered the credit card was used fraudulently for several other purchases. The roommate moved away and the account was closed. Possession of Stolen Property 2014-0003075 07/22/14 Medina officer responded to a report of a suspicious vehicle. Upon investigation the officer confirmed the vehicle was reported as stolen out of Idaho, and the two juvenile occupants were reported as missing. Both juveniles were returned to their respective parents and the vehicle belonging to a family member was returned to the registered owner. Theft 2014-0003098 07/25/14 Victim reported a theft of a Rolex watch taken approximately a year ago after a home party. The victim had been out of town and upon returning home discovered the watch was missing. MISDEMEANOR CRIMES Theft 2014-0003057 07/21/14 Victim reported between July 4 and July 5 during the evening hours, person(s) unknown stole a political sign from the corner of Overlake Drive East and Lake Washington Blvd. No suspects at this time. Theft 2014-0003155 07/30/14 Victim reported person(s) unknown stole a political sign from the 100 block of Overlake Drive East. No suspects at this time. Theft 2014-0003157 07/30/14 As a result of a Craigslist purchase exchange, the parties met at a public parking lot and the subjects were given concert tickets and took off without paying. Hearing Examiner Decisions: • A public hearing was held on Independent Towers Holding’s special use permit and variance applications to install an 80-foot in height wireless communication facility at Fairweather Park. The hearing was held at Three Points Elementary multipurpose room and was well attended. The hearing examiner left the record open until July 28 for the applicant to respond to public testimony presented at the hearing. Parties of record have until August 11, to review Independent Towers’s response and, if any new information was presented, request the hearing be re-opened. Property Tax is deposited into our account during the April/May and October/November timeframes. • Sales Tax Revenues were $160K for the month of July, which includes a one-time purchase resulting in $62K of higher sales tax for the month. July YTD Sales Tax is $701K. Sales Tax is forecasted to be $1.157M for the Year vs. Budget of $920K. • Building Permit Revenue is slightly low for July YTD, at ($52K) under the annual trend for permits. • Intergovernmental Revenue includes Revenue of $8K for Emergency Preparedness that was carryover into 2014. • Planning and Development Revenue is at $172K as of July, slightly lower than YTD Budget. • We have received $19K in wireless facility lease revenue as of July YTD. Additional revenue of $30K related to the Independent Towers Facility Lease will be received during Q3. The $15K Budgeted as a placeholder for a City Hall Flagpole facility lease will not be realized this year. Expense: • Finance paid 2014 annual WCIA Insurance Liability premium in January of $129K. IT Equipment and Services for City Hall is $17K higher than budget as a result of replacements of old (crashing) computer equipment, server monitoring/maintenance/backup and a data recovery project (City Clerk’s Office). • Central Services is $13K higher than anticipated due to Repairs & Maintenance to fix the Police Locker room leak. $12K will be reimbursed by insurance. • Police: Reminder that the Police Chief salary is budgeted for nine months for 2014. We are still operating with one Police Officer vacancy. • Development Expense is lower than Budget by approximately ($83K) for July YTD. CAPITAL FUND: Revenue: • Real Estate Excise Tax Revenues are $562K as of July YTD, and are trending $219K over the YTD Budget. We have reached 76% of the annual budget for REET Capital Revenue. Expense: • Capital project expenditures are $396K as of July YTD, primarily related to Public Works Shop Improvements. • Note: Carry forward funds for 2013 for PW Shop Capital Budget will need a 2014 Budget Amendment to account for the total approved budget for the Shop Project and unspent 2013 funds. AUDIT: The Washington State Auditor’s Office arrived to conduct the 2013 Audit on July 28th, 2014. The underground contractor responsible for the new fire service line for the City Public Works Shop Addition completed the 4-inch diameter fire service line installation. The paving sub- contractor completed the trench patching and the shop yard paving following the underground fire service installation. The project was inspected by the Architect and the Public Works Director and a punch list was prepared and submitted to the general contractor. Work on the punch list commenced and is anticipated to be completed by mid-August. 2. The public works crew continued with: removal of blackberry bushes around the north pond in Medina Park, restored the Medina Park sign located at the NE 12th parking lot, sprayed blackberry bushes along Evergreen Point Road, NE 24th, 84th and 80th Ave NE, and continued working on various maintenance items such as repainting of the overlook railing next to City Hall and pressure washing of the City Hall building exterior. Cleanup of the Park focused on weeding at 5-corners, tennis court fencing tie-downs, playground area weeding, and tree well clean up. Medina Park Beautification Day Water treatment applications continue to be applied to the Medina Park ponds to control the algae growth that appears each year in the ponds during warm weather. The treatment is 100% natural and not harmfull to plants, animals, or humans. The treatment works by consuming excess nutrients (nitrogen and phosphorous) in the ponds. The clarity of the pond water has improved, but floating matter is still present. 3. PUBLIC COMMENT Mayor Luis opened the public comment period at 6:31 p.m. and the following individuals addressed the Council: • Cindy Adkins regarding Independent Towers cell tower application. She owns property adjacent to Fairweather Park and said she will be greatly impacted by the project. She wanted to clear up rumors that WSDOT was “out of the cell leasing business”. She spoke with Robin Curl, WSDOT Property Management Specialist, who said WSDOT is bound by state and federal law to accommodate wireless requests where feasible. Ms. Adkins noted that carriers were asked to vacate and temporarily locate to other sites during the SR-520 construction and she confirmed areas will be available once construction is completed. She also wanted to clear up the rumor that because the City has a lease with Independent Towers, the City somehow has less standing. She wants the applicant to provide full and complete information the same as all other building applicants and cited Article 26, paragraph D and E of the lease about liability. She requested that the City Council support the City Manager and staff and fully and faithfully enforce the building and zoning laws, as well as issue a statement to that effect – no favors. She also requested the City hold a town hall meeting, so that all citizens can be involved and heard going forward. AGENDA ITEM 8.2 66 • John Harris regarding lease with Independent Towers for the cell tower. He expressed concerns about setting a precedence compelling the City to accommodate additional cell towers and equipment at Fairweather Park. He also addressed concerns about the project’s impact on the values of homes, radiated emissions and other hazards in close proximity of cell sites as well as servicing of these sites at night between 1:00 a.m. and 4:00 a.m. He requested that the City engage an attorney with specific domain expertise in representing the City interest with cellular carriers, encouraged the City to deem the application for the tower incomplete, and encouraged the City to explore terminating or buying out and terminating the cell tower lease. • Sheree Wen regarding the phase one tree code, the analysis of the size of trees and according to Washington State Ecology guidance and policy trees should be smaller, and commented on a study of surrounding cities and their mitigation fees. • David Yee regarding his previous request to Council to amend the tree code to allow a tree to be removed when it is blocking a pre-existing driveway easement. He also commented on the cell site project and asked for Council to keep an eye out for the proposed project and allow for more public input. • Wilma Edmonds regarding Phase 1 tree code and moving forward with proposed tree code Phase 2. She also was opposed to spending $30,000 to hire additional help in Development Services. • Miles Adam regarding sidewalks and asked Council to direct the Planning Commission to conduct a study on how to ask citizens of Medina to keep their bushes, shrubs and plantings away from sidewalks. • Donn Foreman regarding cost comparisons of the tree code and asked Council to consider $39,000 to be excessive and putting a maximum limit of $5,000 on tree mitigation. • Hao regarding the proposed tree code and the high cost of tree removal mitigation. Mayor Luis closed the public comment period at 6:59 p.m. 6. COUNCIL / BOARDS AND COMMISSIONS REPORTS 6.1 Mayor and Council Member Reports. Mayor Luis commented on a Yahoo article about Washington being the best place in the country to earn a living. The picture used in the article was taken in Medina from the new 520 lid. He also reported on the Points Mayor’s meeting and guest speaker Julie Meredith, Project Manager for 520. The discussion included the starting process of negotiations for who will be responsible for paying for the maintenance of the lids. The four Cities held the position that WSDOT should pay for maintenance of it. They will look at hiring outside help to get a contract with WSDOT for the maintenance of the lids. He also noted that he and Council Member Boyd attended the Eastside Transportation meeting. AGENDA ITEM 8.2 67 6.2 Commissions, Boards, and Advisory Committee Reports. a) Park Board Mid-Year Report. Park Board Chair Miles Adam reported to Council that the Park Board has its full seven member board for the first time in two years and thanked Council for their help in recruiting members. He reported on the dedication of the new picnic shelter at Medina Park and gave Council an update on the Park Board mid-year report. Adam invited Council to the Annual Park Beautification Day on Saturday, July 19, 2014. Emergency Preparedness Committee Chair Kay Koelemay commended the City Council Members that checked in on Sunday nights with their radios and learned how to use them in case of a real emergency. She noted that the next Emergency Preparedness meeting is Tuesday, July 15, 2014 right before Medina Day and purpose of meeting is to complete plan for Medina Days activities, which includes emergency planning resources, representatives from the American Red Cross, CPR demonstration and participation, and several learning activities for kids. 7. CITY MANAGER’S REPORT 7.1 Department Directors: Police, Development Services, Finance, and Public Works. Acting Police Chief Dan Yourkoski reported on the May police activity report and the corrections from what was provided in the initial agenda packets. The police as well as the rest of City Hall will be hosting about 100 kids from Medina Elementary tomorrow. He updated Council on the patrol officer vacancy and that we have an applicant that made it through the oral boards that is currently going through the background check that may fill that position. Development Services Director Robert Grumbach reported on PSE’s plan to replace the transformer at their site south of the site. He then presented on noise and power tool prohibition during extended hours and recommended waiting on this until after wrapping up on the tree code update. There was a consensus by the council agreeing with this approach. Director Grumbach then reported on the request regarding information on the wireless communication tower at Fairweather Park. He briefed the council on the lease and the permit process. He noted that written public comments would be forwarded to the hearing examiner and included in the record. He also briefed the council on the comments about the lease and said the city attorney reviewed the issues raised and concluded the lease is in effect. He informed the council about the issue raised about SEPA and the lease and the city’s conclusion that the signing of the lease was exempt. He noted the application on the tower does require SEPA and this is being included in the processing of the applications. The Mayor inquired about the role of public comments in a permitting process. Grumbach clarified that public comments are for completing the record. It is intended to identify specific issues and gave examples of what is a useful comment and what is not. Councilmember Morcos inquired about the approval criteria and Grumbach provided a response. Councilmember Decker asked what influence the council has AGENDA ITEM 8.2 68 over the hearing examiner and Grumbach noted that through the city’s ordinances, the council as a body does not have influence on the hearing examiner’s decision. Councilmember Morcos then inquired about having the tower moved to a place that might be less intrusive. Grumbach replied that was an issue regarding the terms of the lease. He noted that would require negotiations with Independent Towers. Councilmember Pryde commented a problem is that the lease always expected difficulty with meeting zoning requirements such as the 500-foot setback. Grumbach noted that variance and special use permits are common because there are only a few places where a 500-foot setback standard can be met. Councilmember Morcos then returned to his inquiry about moving the tower. He suggested moving the facility away from the sports court and hide it under the WSDOT lid. Councilmember Pryde noted mitigation requirements. Councilmember Boyd commented on the measures taken to mitigate for the facility and the goal of getting reliable revenue for the City. Councilmember Morcos discussed making a motion about moving the facility, which the council discussed. Grumbach noted that the discussion to move seemed to focus on hiding the equipment facility, but he noted the tower would continue to be visible and that seemed to be the focus of public concern. ACTION: Motion Morcos second by Lee and carried by a 5:1 (Maffei absent) (Boyd dissented) vote; Council authorized the City Manager to get in contact with Independent Towers to explore options to move the cell tower to a different location. The City Attorney clarified that the current motion would need to fail before this motion could be offered. The committee meets on Wednesday and has had two meeting to date. The purpose of the meetings is to review the vision statement and try to summarize the tree code to make it easier for the citizens to understand during the public outreach program. Grumbach noted that the first workshop/open house is scheduled for July 15, 2014. He asked Council to keep an eye on the big picture and proceed with caution. • John Harris regarding Independent Towers cell site and complimented staff on outreach program for residents on the tree issue. • Miles Adam regarding public safety on sidewalks and how to ask neighbors to address overgrowth on sidewalks. AGENDA ITEM 8.2 80 • Kay Koelemay Dicharry commended Council on the successful recruitment of the new Medina Police Chief Stephen Burns. She also commented on Phase 2 of the Medina Tree Code and complimented staff on the postcard that went out to residents which seems to be generating interest and the well-developed webpage. Mayor Luis closed the public comment period at 6:49 p.m. 6. COUNCIL / BOARDS AND COMMISSIONS REPORTS 6.1 Mayor and Council Member Reports. Deputy Mayor David Lee attended an all-day Eastside Transportation Partnership Retreat. Discussion included vision and strategy going forward and advocacy versus disseminator of information. Councilmember Morcos reported that the Tree Code Committee has held five meetings about 90 minutes per meeting. The committee has no intention to make suggestions before hearing from the public. They will collect information from the director of development services when all response from the questionnaire has been received. The next meeting has been tentatively scheduled for mid-August. Councilmember Maffei inquired on who wrote questions for questionnaire and Grumbach reported that formulation of the questions involved several consultants and himself. Councilmember Maffei noted that there was not anything on the form identifying the responder on the questionnaire and there were concerns of people filling out the questionnaire several times. Grumbach also noted that as of today, he has received about 100 to 110 responses to the questionnaire both online and in person. 6.2 Commissions, Boards, and Advisory Committee Reports. Emergency Preparedness Committee Chair Kay Koelemay reported that the next meeting is tomorrow, July 15 at 7:00 p.m. following the tree code workshop/open house. Clyde Hill Council Member Marianne Klaas and other members of the Clyde Hill community who has expressed interest in Emergency Preparedness will be attending the meeting. They will be exchanging ideas on how they can work collaboratively in preparedness planning and the Points Communities as a whole. 7. CITY MANAGER’S REPORT 7.1 Department Directors: Police, Development Services, Finance, and Public Works. City Manager Michael Sauerwein introduced new Chief Police Stephen Burns to Council and attendees. Steve will be joining City staff on September 2, 2014. AGENDA ITEM 8.2 81 Acting Police Chief Dan Yourkoski reported that a suspect from a previous burglary has been apprehended in Chicago and sent back to Florida for warrants. This was due to the help with the camera system. He also reported that the City will begin recruitment again to fill the patrol officer vacancy. Director of Development Services Robert Grumbach highlighted his report including the July 16 hearing date on the Independent Towers applications. He briefed the council on the affects a SEPA appeal might have on the hearing schedule. He also reported, along with the city manager, that the City contacted Independent Towers regarding the lease and they are open to amending the lease; however, they are not open to ending the lease. They plan to continue moving forward with their applications regardless of any discussions on amending the lease. Grumbach answered questions about the hearing process should a SEPA appeal be filed. Grumbach also announced the July 15, 2014 open house/ workshop for the Medina Tree Code Update outreach from 4:00 p.m. to 7:00 p.m. He presented some board designs that will be included at the workshop. Council Member Maffei requested a policy that staff reach out to residents first prior to trimming trees and bushes in the public right-of-way. Council directed staff to do more outreach to educate residents on keeping the public right-of-way clear. Finance Director Nancy Adams reported that homes sales in Medina were $44M during the month the June, which will bring in $220,000 of Capital Revenue in July. She directed Council to page 25 in the agenda packet where included a quarterly cash flow fund balance for them to review. She then reported on the audit at City Hall. The Washington State Auditor’s Office scheduled the 2013 Audit to begin on July 22, 2014 and they will be here for two weeks. Public Works Director Joe Willis reported back on the hedge issue and how he handles enforcement. The City has an ordinance that says owners are required to maintain their frontage; however, he usually leaves his business card or a letter for the owners to call him. He also reported that the fire services have been installed at the new Public Works shop addition and they have paved the yard. He also noted that there are new crosswalk flags at 12th and 84th. Councilmember Maffei noted that new buoys were put in place at Fairweather Bay and now they are gone. He inquired about posting a sign at Lake Lane dock that either says “No Speeding/No Wake Zone”. 7.2 City Manager City Manager Michael Sauerwein reported on the Special Events ordinance up for discussion and voting on Other Business. Council discussed options for collections for citizens not pulling permits. Medina Days finances, gave break down of expenses, develop city policies in how funds are spent. Councilmember Boyd requested another WSDOT presentation with regards to landscaping and trash pick-up at the 520 lid. AGENDA ITEM 8.2 82 8. Washington State Department of Transportation (WSDOT) has tentatively agreed to reimburse the City of Medina, Clyde Hill, and the Town of Hunts Point if we do the channelization and re-striping work ourselves. Result of Recommended Action: Approval will authorize the City Manager to enter into a contract agreement with the Connections Group for public relations services for the City of Medina in an amount not to exceed $35,000.00. OTHER BUSINESS ITEMS ADDED AGENDA ITEM Personnel Committee Discussion Councilmember Maffei commented on the challenges of the process of the personnel committee and stated that everyone should have the opportunity to sit in on these interviews and have input. He suggested that interviews should be open public meetings and then any of the Councilmembers can attend and be involved. Councilmember Boyd asked the city attorney if the vote they took was to affirm or not affirm. City Attorney Kari Sand clarified that they confirmed the Mayor’s recommendation and that the Municipal Code gives the Mayor the power of appointment. By consensus amongst the Council, the personnel committee interviews will be noticed as public meetings and anyone can attend. The Mayor will still make a recommendation to Council to be voted on. 10.1 Subject: Marijuana Businesses and Zoning Discussion Recommendation: Discussion item only; direction on how to proceed required. Result of Recommended Action: Action on this item will provide guidance on developing a zoning code amendment regarding marijuana businesses and cannabis collective gardens. Staff Contact: Robert Grumbach, Development Services Director Development Services Director Robert Grumbach reported back to Council regarding marijuana businesses and whether our zoning code allows for medical marijuana businesses to be allowed in the City. Analysis shows an argument could be made on allowing these in the SR-30 zoning or home businesses. Grumbach directed Council to the staff report for possible options and guidance on possible approaches to amending the zoning code. ACTION: By consensus Council directed staff to move forward with Option B - Prepare and ordinance amending the zoning code that prohibits marijuana businesses in all zoning districts. This might be expanded to include prohibiting medical cannabis collective gardens as well. 10.2 Subject: An Ordinance Related to Special Events Permits and Specifically Amending Section 9.40.010 and Adding Section 9.40.145 of the Medina Municipal Code Recommendation: Adopt Ordinance. PUBLIC COMMENT Mayor Luis opened the public comment period at 9:44 p.m. The following individuals addressed the Council: • John Harris encouraged the Council to embrace the Comprehensive Plan which specifically calls for Fairweather Park and Nature Preserve to be maintained in a natural state. He also commented that it should not be viewed as a source of revenue to be leased out to a for-profit company. He noted that the lease the previous City Manager signed is for Independent Tower’s exclusive use of the property that they have leased and they have the right to build a fence around the property. He is supportive of working with T-Mobile and finding other opportunities to co-locate with other facilities. • Cindy Adkins clarified to the Council that the situation with the cell tower at Fairweather Park was because the City contracted with Independent Towers instead of T-Mobile. She said the City negotiated terms on an agreement with T-Mobile in 2010, but ended up giving the contract to Independent Towers. She believes this should be investigated. Ms. Adkins also commented on the permit hearings coming up and about concerns with the hearing procedures. She also stated she arranged a meeting with a WSDOT team of engineers and former CEO of US West Cellular and thought they were meeting to negotiate an alternative location (for the cell tower). The engineers walked around the 520 lid and found numerous areas that would work for T-Mobile and Independent Towers rejected them all. She believes Verizon withdrew from the application; possibly, because they could not submit a new needs letter without perjuring themselves. • Wilma Edmonds regarding long discussion on 84th Street going into Medina Circle and the request for a traffic study. Would like to see the traffic study begin when school starts. She was concerned that Council is jumping on the traffic study too soon. Mayor Luis closed the public comment period at 9:51 p.m. 12. After Adoption After Adoption Copies of 2015 Final Budget are filed with the Washington State Auditor’s Office, MRSC and AWC. 98 100   {KNE1177788.DOCX;1/00019.900000/  }   INTERLOCAL AGREEMENT REGARDING CHANNELIZATION PLAN FOR 84TH AVENUE NE AND NE 28TH STREET/POINTS DRIVE NE THIS AGREEMENT is hereby executed this _______ day of _________, 2014, by and between the City of Clyde Hill (“Clyde Hill”), the Town of Hunts Point (“Hunts Point”), the City of Medina (“Medina”), and the Washington State Department of Transportation (“WSDOT”), collectively referred to hereinafter as the “Parties.” WHEREAS, Clyde Hill, Hunts Point, and WSDOT previously executed a Letter of Expectation regarding Lane Marking on Points Drive NE/NE 28th Street (“Points Drive”) in the summer of 2001 whereby WSDOT agreed to re-stripe and revise signing on Point Drive NE, which eliminated city on-street parking on Points Drive between 84th Avenue NE and 86th Avenue NE; and WHEREAS, due to the SR 520 construction, modification to the 84th Avenue on-ramp to SR 520 will take place, including a new roundabout design and a half-diamond on-ramp configuration will be installed; and WHEREAS, due to these modifications to the on-ramp, the roads leading to the 84th Avenue/Points Drive intersection will be modified, including Points Drive and 84th Avenue NE; and WHEREAS, WSDOT, as set forth more fully herein, agrees to pay for the re-striping of Points Drive and 84th Avenue NE leading to the revised 84th Avenue intersection if Clyde Hill, Hunts Point, and Medina agree to a channelization plan for Points Drive and 84th Avenue NE; and WHEREAS, Clyde Hill and Hunts Point share jurisdiction of Points Drive leading up to the 84th Avenue NE intersection and desire to work together to address the concerns of both communities, including access to Hunts Point and access to the Hawthorne Court and 86th Avenue neighborhoods located in Clyde Hill as well as vehicle queuing and congestion along Points Drive and 84th Avenue NE to access SR 520; and WHEREAS, Clyde Hill and Medina share jurisdiction of 84th Avenue NE leading up to the 84th Avenue NE/Points Drive intersection and desire to work together to address the concerns of both communities, including access to Medina Circle located in Medina and vehicle queuing and congestion along Points Drive and 84th Avenue NE to access SR 520; and WHEREAS, this Agreement is intended to establish a channelization plan that Medina will implement and WSDOT will pay for and the rights of each respective local jurisdiction to modify the channelization and striping in the future; NOW, THEREFORE, the Parties mutually agree as follows: ATTACHMENT 1 101   {KNE1177788.DOCX;1/00019.900000/  }   KNE1056603.DOCX;1\00019.900000\     1. Purpose. The purpose of this Agreement is to establish a channelization plan for Points Drive and 84th Avenue NE, to be constructed and implemented during the SR 520 construction by Medina and reimbursed by WSDOT and to establish the rights of each respective local jurisdiction to modify the channelization plan and striping in the future. 2. Channelization Plan Established. Clyde Hill and Hunts Point hereby agree to the channelization plan of Points Drive attached hereto as Exhibit A, incorporated by this reference as if set forth in full. Clyde Hill and Medina hereby agree to the channelization plan of 84th Avenue NE attached hereto as Exhibit B, incorporated by this reference as if set forth in full. 3. Medina’s Re-striping Obligations. Medina shall implement both channelization plans attached hereto as Exhibits A and B as early as possible following the completion of the intersection modification at 84th Avenue NE and Points Drive. WSDOT will keep Medina, Clyde Hill, and Hunts Point apprised of when the intersection modification will occur and shall be responsible for scheduling completion of this work. Medina shall be responsible for observing and following all state law bidding requirements in advertising and awarding the contracts to have the channelization work completed and shall be responsible for managing such work. 4. WSDOT’s Reimbursement Obligations. WSDOT shall reimburse Medina for all work related to implementation of the channelization plans attached hereto as Exhibits A and B. WSDOT shall reimburse Medina within 30 days following receipt of invoices from Medina. 5. Further Evaluation of Channelization/Re-Channelization. If in the future any of the local jurisdictions determine that the channelization plans in Exhibits A and B, as implemented, are problematic for any reason, the local jurisdictions agree to engage in discussions regarding re-channelization of Points Drive and/or 84th Avenue NE to address the issues of the concerned jurisdiction. If following the discussions, the concerned jurisdiction determines, in its sole discretion, that any re-channelization work is required to address the problems encountered, including re-striping or new signage, the concerned jurisdiction reserves the right to modify the channelization agreed upon in Exhibit A or B within its corporate boundaries at its own cost. WSDOT shall bear no further costs for re-channelization after channelization in accordance with Exhibits A and B have been completed. 6. General Provisions. No separate legal or administrative entity shall be created by this Agreement. The City Administrator for Clyde Hill, the Mayor for Hunts Point, and the City Manager for Medina shall act as administrators of this Agreement. This Agreement shall be recorded with the King County Recorder’s Office or listed on each Party’s website. This Agreement constitutes the entire agreement and understanding between the Parties concerning the subject matter herein and shall supersede all prior agreements, oral or otherwise. No modification or amendment of this Agreement shall be valid or effective unless evidenced by a writing signed by all Parties.
